The regular meeting of the Auburn City Council convened at 8:00 p.m. in the Auburn
School District Administration Building Board Room.

It was moved by Flechsig, seconded by Larson, that the mintues of the June 19, 1978,

PUBLIC HEARINGS
1. Mayor Kersey declared the public hearing open on the request of F. B. Carlson
to rezone from Unclassified to R-4 (Mu1ti-Family) a parcel of land 2.86 acres
in size located on the westerly side of Auburn Way South in the 5700 block.
(Application 22-78) The Planning Commission recommends that the request be
denied and a Conditional Use. Permit be granted for twenty (20) living units
and that a revised site development plan be submitted and reviewed by the
Planning Department. Also, no building permit can be granted until the require-
ments of the Fire Department regarding fire flow are satisfied.
Tam Barkhousen, representing Mr. Carlson, was in the audience to answer any
W questions. No one else in the audience spoke for or against the request.

Craig expressed concern over the development of this property since there is
a fire flow problem.
It was moved by Craig, seconded by Larson, that the request of F. B. Carlson
to rezone from Unclassified to R-4 be denied and a Conditional Use Permit

to draw up the necessary ordinance using the revised site plan and the recommenda-
bons of the Planning Commission and Planning Director.

2. Mayor Kersey declared the public hearing open on the request of Stephen A. Hynes
to rezone from M-2 (Heavy Industrial) to R-4 (Mu1ti-Family) a parcel of Land
approximately 22 acres in size Lying on the south side of 29th St. S.E. between
"D" and "F" Streets S.E. (Application 25-78) The Planning Commission recommends
approval of this request because it would be a down-zoning of the property and
would provide a transitional zone from the ~F~vy industrial uses and would conform
to the land uses on adjoining properties as xesignated on our Comprehensive Land
Use Plan.
The city clerk read a letter for Mr. Hynes asking that the public hearing be
continued until the August 7, 1978, council meeting.
No one in the audience spoke for or against the request.
It was moved by Larson, secanded by Flechsig, that the public hearing be continued
until the Auyust 7, 1978, council meeting.

3. Mayor Kersey declared the public hearing open on the request of James L. Carpenter
for a Conditional Use Permit to a11ow for the use of an existing single family
'~~'~ residence on commercially zoned property as a duplex dwelling together wi th using
a portion of the building for commercial purposes. (Application ?6-78) The
', ~i Planning Commission recommends approval of this request providing that the require-
~~ ments of the bui.2ding code and C-1 (Light Commercial) regulation: are conformed to
for any additions and/or remodeling including the provisions for off-street parking.
James L. Carpenter, 31?11 55th Avenue South, was in the audience to answer any
questions. No one. el se in the audience spoke for or against the request.

Craig asked if this request was within zoning regulations. George Schuler responded
that yes, if living quarters are built on existing commercially zoned propertyia
Conditional Use Permit is required.
It was moved by Hitchcock, seconded by Larson, that the request of James L. Carpenter
for a Conditional i~se Permit be approved and the city attorney instructed to draw
up the necessary ordinance and that the Planning Commission recommendations be
incorporated into the permit.

4. Mayor Kersey declared the public hearing open on the request of Do S. Uhm, M.D. and `'
Rose Payne to rezone from R-3 (Duplex) to R-4 (Multi-Family) with a Conditianal Use '
Permit for a professional office on a parcel of land 16,000 sq. ft. in size located
at the southeast corner of 12th St. N.E. and Harvey Road. (Application 27-78) The ~.....~
Planning Commission recommends approval of this request provided: (l) That a screen
fence be installed along the east line to protect the adjoining single family dwelling
from cars parking at the rear of the building. (2) That the area not being used
for building or parking shall be landscaped in conformance with the landscaping require-
ments of the City of Auburn. (3) That any sign installed advertising the professional
use being conducted upon the property shall be restricted to a face sign attached to
the face of the building or a Iow profile ground sign not exceeding 42 inches in height.
Lighting for the sign shaI1 be indirect.
Do 5. Uhm, 13631 5. E`. 235th St., Kent, was in the audience to answer any questions.
He stated he would comply with the Planning Commission recommendations.
It was moved by Flechsig, seconded by Larson, that the public hearing be closed.

Craig expressed confusion as to what was actually being approved. George Schuler
replied a R-4 Multi-Family zoning with a Conditional Use Permit.
Larson asked if the R-3 would still provide what Dr. Ohm was planning to do. George
Schuler answered yes.
Flechsig asked what the advantage would be to R-4 zoning? George Schuler responded
that they could enlarge the building. I
Hitchcock asked if they wanted to enlarge the building, would they have to come back '
for a permit. George Schuler stated they would under a Conditional Use Permit. `°-°'
It was moved by Craig, seconded by Larson, that the request of Do S. Uhm to rezone
from R-3 to R-4 with a Conditional Use Permit be approved and the city attorney
instructed to draw up the necessary ordinance to include the .Planning Commission,
Planning Director and Engineer's recommendations and also the site plot plan.

5. Mayor Kersey declared the public hearing open ~n the request of Donald Torcaso for a
Conditional Use Permit to allow a triplex apartment building on property zoned C-2
(Commercial) fora parcel of land 6500 sq. ft. in size Iocated on the west side of
"D" St. S.E. in the 100 block. (Application 28-78) The Planning Commission recommends
approval of this request provided all the requirements of the C-2 classification are
conformed to.
Don Torcaso was in the audience to answer any questions. No one else in the audience
spoke for or against the request.
It was moved by Flechsig, seconded by Larson, that the public hearing be closed.

portion of 9th St. N.E. west of "I" St. N.E. (Application V-3-78).

Craig reported that it was the Utility Committee's recommendation to retain an

way be returned to the property to the south known as Lots 44, 45 and 46, Block
14, C.D. Hilmans Auburndale Addition to Seattle, Division No. 2 as recorded in
Volume 13 of Plats, page 92, Records of King County Washington and also that
an utility easement be preserved over the said street and further, the-city
.attorney be instructed to draw up the necessary ordinance.

The Department of Public Works recommends the following items for council approval:
1. Change Order No. 7A, Contrract 77-12, St. Imp. 186, 3rd St. N.E./N.W. construction,
to Moss Construction Co. in the amount of increase $587.50, removing of existing
traffic markings at W. Main & "C" Streaets.
It was moved by Craig, seconded by Hitchcock, that Change Order No. 7A to Moss Construc-
tion Co., Contract 77-32, St. Imp. 186, 3rd St. N.E./N.W. be approved in the amount '""`°'~

OLD BUSINESS I
The request of Darrel Fowler to rezone from R-2 with'a Special Property bse Permit
to construct a nursing home to R-4 (Multi-Family) a parcel of land 2.69 acres in size
lying at the southeast corner of 19th and "F" St. S.E. (Application 1-78) was again
brought uefore the city council.
Richard Wilson, representing Darrel Fowler, was in the audience to answer any questions.
He displayed a draft plot plan showing the revisions proposed by Planning Director
George Schuler.
Joe Binetti, 609 21st St. S.E., one of the resi_ents in the area of the rezone request,
asked if Mr. 6Jilson knew the recommendations before the council did.
George Schuler responded that Per. Smythe, attarney for Mr. Fowler, had requested a copy
of the recommendations.

Mr. Schuler replied no one Irad a part in h.is recommendations.
Mr. Schuler then covered his re cornmendatiorrs for the council.

Binetti responded that the whole matter was a gray area of whether to even a11ow
apartments or not.
It was moved by Larson, seconded by Flechsig, that the request of Darrel Fowler to
rezome from R-2 with a Special Property Use Permit to R-4 be approved and the city
attorney instructed to draw up the necessary ordinance to include the recommendations
outlined by George Schuler and the public works department.
