ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig and Lea. COUNCILMEN F,XCUSFD: Councilmen Larson, Hitchcock and Flechsig. Mayor Kersey dc~cZarcad ti~c~ public hearing open on the request of James N. Stubbs tv rezone from Unc.lassificd to C-3 (Heavy Commercial) a pa r.cel of land 40,150 sq. ft. in size located on the southeast corner of 49th St. N.E. and Auburn Way North. (Application 34-77) The Planning Commission recommends approval o.f ti.is request because' it. does conform to our Comprehensive Land Use Plan for highway oriented commcrc.ial uses. No one .in the audience spoke for or against the request. Q It was moved by Lea, seconded by Roegner, that the public hearing be closed. MOTION CARRIED It was moved by Lea, seconded by Craig, that the request of James N. Stubb to rezone from Unclassi.fi.ed to C-3 be approved to include the Planning Cvmmission and Engi.neer's comments and the city attorney be instructed to draw up the necr~~ssary ordinance. KOLL CALL. Mayor Kersey dec.Za.red the public hea.riny open on the request to annex approximately 240 acres of land Zy.iny between the present north city limits and S. 277th Street and lying between the Valley Freeway and the Burlington Northern Railroad Right of_ Way. The city clerk read three Letters supporting the annexation from Carl A. Pozzi, David L. Smith and Sam F. Parker. Steve Meyer, Burlington North Central Building, Seattle, representing Carl Pozzi and Sam Parker, who own approximately 150 acres of the property considered for annexation, was in the audience to voice support for the annexation and answer any questions. No one else in the audience spoke for or against the annexation. It was moved by Roegner., seconded by Kitchell, that the public hearing be closed. MOTION CARRIED Counc.i.lman Cra_iq asked what the advantage was to the city? Councilman Roegner responded that the role of the Planning Commission was not to determine wZi<~ther the annexation was good or bad. Tonight was the first opportunity :_:fo fa.1k...:abo.ut-the pros and cons. Craig mentioned that utilities and roads servicing this area are non-existent at this time and should be considered before annexation. Butko for approval of preliminary plat to be known as Cedar Woods 1orated on the south side of Oravetz Road in the 2200 block. (Application P-7-78) 3. Zone Change Application .from John& Dorothy Monson and henry & Jeanette Gretzner to change from Unclassified to R-1 (Sing.Ze Family), property located on the south _.~ side of Oravetz Road in the 2200 block. (Application 45-78) It was moved by Lea, seconded by Craig, that applications 44-78, P-7-78 and 45-78 be referred to the next regular meeting of the Planning Commission. MOTION CARRIED AUDIENCE PARTICIPATION George Wilborne, member of the State Mobile Homes Owners Association and owner of a mobile home i.n Auburrn, was in the audience representing petitioners from Auburn Manor. He stated that NCC Investments, new owners of Auburn Manor, are trying to condominiumize the mobile home park. He and other mobile home owners had gathered a petition opposing the proposal and wanted to ask the Council what they cou.Zd do to fight the proposal. Jack Bereiter responded that it appears a proposal to condominiumize would not fall within legal requirements of the State Condominum Law and, in fact, may be an attempt to subdivide. He added that he had talked with the attorney representing NCC Investments and was promised a copy of the proposal since the main problem now is that of not having the proposal in writing. Mayor Kersey expressed sympathy to the mobile home owners and stated the City was watching the situation. The petitioners could best help themselves by getting something in writing. Jack Bereiter added that once the City had the proposal the matter could be checked to see .if it was in conformance to City code and State statutes. BID OPENINGS Bids were opened October 2, 1978, at 11:00 a.m. on two motorcycles for the Auburn Police Department. The following bids were received. Tacoma Sports 6 Cycle $6.978.64 No bid bond Greenlake Kawasaki 7,936.62 No bid bond Kent Kawasaki 7,346.38 5% bid bond Federal Way Kawasaki 7,345.92 21/2 bid bond The Auburn Police Department_ recommends the bid for two Kawasaki motorcycles be awarded to Kent Kawasaki for $7,346.38. It was moved by Roegner, seconded by Kitchell, that the awarding of the bid be tabled until the next regular meeting of the Council on October 16, 1978. MOTION CARRIED RECOMMENDATIONS The Department of Planning and Community Development recommends a call for public hearing on the following: 1. The r.<-quest of TransCanada Enterprises, Ltd. to rezone from Unclassified to R-2, R-3 and R-4 property located on the south side of the Stuck River approximately 1 m_i1e east of "R" Street S.E. (Application 39-77) -2- 105 AUBURN, WASHINGTON MONDAY OCTOBER 2, 1978 2. The request of TransCanada Enterprises, Ltd. to rezone from Unclassified to R-2 (Single Family) property Located 1/2 mile east of "R" Street S.E. south of the Whig River and northerly and southerly of Stuck River Road. (Application 40-78) 3. An amendment to the Subdivision Ordinance under Title 17, repealing Sections 17.08.110, 17.28.070, 17.36.010 and 17.36.020 in their entirety and creating new sections to be known as 17.08.065, 17.08.110, 17.24.260, 17.28.070, 17.36.010 and 17.36.020 to provide for Large Lot Subdivisions. It was moved by Craig, seconded by Roegner, that a public hearing be held October 16, .1978, before the City Council at the Auburn School District Administration Building, _ at 8:U0 p.m. on Applications 39-77, 40-78 and Item 3 above. -" MOTION CARRIED The Department of Public Works recommends the following items for Council approval: 1. Authority to hold public hearing on assessment roll for L.I.D. 291 (8th Street S.E. from "B" to Auburn Way South) construction on November 6, 1978. Zt was moved by Lea, seconded by Craig, that a public hearing be held November 6, 1978, befor.~ the City Council at the Auburn School District Administration Building, at 8:00 p.m. on the assessment roll for L.I.D. 291.
