COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Hitchcock,
Flechsig, and Lea.
It was moved by Hitchcock, seconded by Larson that the minutes of the November 20, 1978,
council meeting be approved as mailed.

PUBLIC HEARINGS
1. Mayor. Kersey declared the public hearing open on the request of Sandra Cheney
tlr.ibar to rezone from Unclassified to M-1 (Light Industrial) a parcel of land
5 acres in size Zy.ing on the west side of Auburn Way North in the 4300 block.
(Application 46-78) The Planning Commission recommends denial of the M-1 (.Light
Industrial.) request and approval o.f C-3 (Heavy Commercial) zoning on the east
250 feet and trze balance of the approx.i.mately 750 feet be zoned M-1 (Light
6n Industrial) .in conformance with our Land (Ise Plan as well as being compatible
~.I with exi_sti.ng and other planned uses on adjoining properties.
~~'!~! John Dayhoff, 1600 Washington Plaza Building, Tacoma, attorney representing
the applicant, stated the applicant had made the adjustments recommended by
t_he Planning Commission. He added he was in the audience to answer any questions.

MOTION CARRIED
Councilman Craig pointed out Marv 5eabrands letter of October 18, 1978, indicating
water and sewer problems particularly with sewer lift station. Craig added
that the request could be approved if the applicant understood that these problems
would have to be worked out with staff and the Utilities Committee.
It was moved by Larson, seconded by Craig, to dopy the request of Sandra Cheney
Hribar to rezone from Unclassified to M-1 as recommended by the Planning Commission.
MOTION CARRIED
It was moved by Larson, seconded by Craig, to approve C-3 (Heavy Commercial)
zoning on the east 250 feet and the balance of approximately 750 feet M-1 (Light
Industrial) zoning on the request of Sandra Cheney Hribar (Application 46-78)
and further instruct the city attorney to draw up the necessary ordinance.

2. Mayor Kersey declared tl~e public hearing open on the request of Miles Sand and
Gravel for a Conditional Use Permit to construct a seafood packaging and storage
facility on a parcel of land approximately 10 acres in size zoned M-2 (Heavy
Industrial) located on the west side of "C" St. N.W. in the 400 block. (Applica-
tion 47-78) The Planning Commission recommends approval of the request for a
Conditional Use Permit to construct a seafood packaging and storage facility
and that the following conditions become a part of the permit: In order to
provide adequate controls of possible odors, there sh311 be no outside storage
of waste seafood materials. All waste seafood materials shall be kept inside
the building in closed containers and shall be removed from the site on a regular
basis.
No one in the audience spoke for or against the request.
It: was moved by Flechsig, seconded by Hitchcock, that the public hearing be closed.

3. Mayor Kersey declared the public hearing open on the request of Vic Sheppard to
rezone from R-2 (Single Family) to R-4 (Mu1ti-Family) a parcel of Land on the
northeast corner of 30th and "M" Street S.E. (Application 48-78) The Planning
Commission recommends approval of this request because it does conform to the
Comprehensive Land Use Plan and wi11 not be detrimental to the uses on adjoining
properties. Also that the site plan submitted with the application be attached
to and become a part of any ordinance approving this request.
Robert Zanoni, 508 W. 49airr, designer for the applicant, stated he was in favor
of approval of the request. No one else spoke for or against the request.
It was movexi by Larson, seconded by Hitchcock, that the public hearing be closed.

It ~~as moved by Flechsig, seconded by Larson, that the request of Vic Sheppard
to rezone from R-2 to R-4 (Application 48-78) be approved to include the recom-
mendations of the Planning Commission and the city attorney be instructed to
draw up the necessary ordinance.

4. Mayor Kersey declared the public hearing open on the request of Mt. Rainier
Vista, Inc. to rezone from Unclassified to R-1 and R-2 (Single Family) a parcel
of land approximately 145 acres i.n size Zying on the north side of 53rd St. S.E.
in the 3400-3600 block. (Application 49-78) The Planning Commission recommends
approval of the R-.Z and R-2 (Single Family) request per the application because
the proposed use wi11 conform to the Comprehensive Land Use Plan and the uses
wi11 be compati_b1e with other planned uses in the area. It is further recommended
that the rF~quest for a Conditional Use Permit for 4-plexes be denied at this time
and that the Conditional Ilse Permit be considered at a Zater date under a separate
application.
Tire city clerk read letters from John J. and Opal V. Winkelman and Roger M. Leed
opposing the rezone and plat. application.
Thomas Brucker, speaking for Roger Leed, was present to voice his opposition to
the request.
Gary Crowell, 53rd Street S.E., read a statement in opposition to the request
signed by 161 mer~bers of the community mostly Living in the approximate area
of the rezone. Their opposition was because (1) rezone was not compatible with
existing laird use in the area, (2) environmental impact has not been adequately
investigated, (3) the access road, Oravetz Road, cannot feasibly support additional
traffic, (4) necessity for deep we11s to support area may have detrimental effect
on water table, (5) there is no assurance there would be adequate police protection,
(6) rezone constitutes spot zoning. He added that he personally felt tPrere was
a great need to maintain the quality of living in the area and while those opposing
the r•czone were not opposed to growth they were opposed to spot zoning and unplanned
urban sprawl.
Bob Smythe, 29 1st N.E., attorney representing petitioners, wanted to respond to
some of opposition and outline some of the points they felt supported a zoning
request being .in order at this time. (1) A11 zoning is for single family resident
which is compatible to existing uses in area now, (2) City has control over final
plat, (3) Water and sewer systems wi11 be subject to approval of the city, (4)
Because of the type of development do not believe an Environmental Impact Statement
is required, (5) Not spot zoning because an apellete decision defined spot zoning
as arbitrary and unreasonable action by which a smaller area is singled out of
a larger area or district and specifi_ca11y zoned for a use classification totally
different from and inconsistent with the use classification of the surrounding
land and not in conformance with the Comprehensive Land Use Plan, (6) Argument

for a mor.itorium of zoning changes until the Comprehensive Land Use Plan can
be updated would be stultifying to the Ci.ty's growth because .it would eliminate
consideration of all land use changes, (7) The need of more fire and police
protection is no different than would be required from the economic growth
that is presently goi.nq on in the area now. It will be paid for by new tax
base brought in by new citizens mov.i.ng in, (8) Do not believe comparison to
Unh and development is meaningful since the five acre developments were done
to avoid coming within the City's requirements of the plat ordinances. He
sununarized his remarks by stating they felt the request was compatible with
the Comprehensive Land Use Plan and will provide an orderly plan for development
of the area.
r'red Poe, member of the Mt. Rainier Vista Group, supported the request by stating
t_he property owners and developers have worked with the City to iron out the
problems of putti.ny together a single family development of this size. He stated
that the problems of water, sewer and density had been worked out with the city.

Land Use Plan calls for. Mr. Poe stated he felt land owners have .rights also

he felt those who Live in the area have more rights .in ongoing processes than
W those who come after. This area is the only area where people can live on 2-1/2

those who bought land for that particular type of Life style.

13ob Peters, 53rd St. S.E., spoke against the application. He submitted a map
drawn Dike the plot plan of the area as Exhibit "A" showing those contacted.
He stated that_ 100 of those people contacted were against this type of development.
Th~;~y were riot against development, however, they were. against the type of
development wr'zich did not permit them to raise horses or have a cow.
~7ohn Winkelman, 8814 Densmore N., Seattle, added to his letter read by the city
clerk by st_ati.ny he had been a builder for many years and was especially against
tizc_~ request because of the size of the lots. He said he felt the land would not
handle this type of density with the water and sewer problems.
Joe Mould, 53rd Street S.I:., chairman of the S.E. Auburn Citizen's Committee,
stated they would like to work with the present committee that is proposing
the new Camprehensive Plan. He said they were not against development but would

Tom 13arghausen, Cavness Engineers, representing Key West Development Corp., pointed
out what he stated cvas a discrepancy in the map entered into the record as Exhibit
"A". He asked if every area colored represented someone cvho had signed the petition.
.Bob Pr=tens responded yes;. Mr. 23arghausen pointed out one area that had recently
been approved <is a preliminary plat for 100 lots by the council and was no longer
owned by tize~ Antone's. He then covered points that had been brought out in the
Planning Commission hearing: (1) Traffic up to 7500 vehicle trips per day could
be handled on crxisting road going into City from 53rd (per Pierce County Traffi c
and Planning study). It is estimated that this development would bring vehicle
trips up front 2300 to 5500-6500 per day which would still be under the maximum.
This does not take into account the plan to eventually widen Oravetz Road, (2)
studLl was done by Dames and ldoore which indicated that size of catchment area
and depth of water table would create a negligible impact from a Large septic
tank concent.rat_ion avove the Coal Springs headway, (3) development of utilities
in this area would benefit present owners in the area because they may hook up
if_ they choose and receive better pressure, adequate water supply, better fire
protection yet they do not have to hook up if they don't want, (9) density is
not as high as Comprehensive Land Use Plan permits.

Councilman Craig explained a dry sc,wer is when the city does riot put in sewer
or trunk lines unt:.i..Z we have customers. The developer is required to put in
the sewer lines. When the city gets in there with sewer trunks then sewer
lines would be hooked up and residents required to abandon septic tanks and
drain fields. He added that the questions raised were good points but he believed
the city has considered these problems and the area is being developed as planned
for single family residents.
C'oun~•.ilrnarl Lena questioned George Schuler as to what criteria is used to determine
whether an Environmental Impact Statement is required.
Schuler responded that the questions brought out in an EIS had been answered by
information and studies already available. ~.
It was moved by Flechsiq, seconded by Hitchcock, that the request for a Conditional
Use Permit by Mt. Rainier vista, Inc., be denied and considered at a Later date
under a separate application.

Corporation for consideration of a preliminary plat to be known as Rivendell
Fatates on a parcel of Land 4 acres in size located on the east side of "D" St.
S. F,. _in the 3700 block. (Application P-9-78) The Planning Commission recommends
approval of the preliminary plat to be known as Rivendell Estates because it
will meet the minimum requirements of our subdivision and zoning ordinances
and that the owner and/or engineer prepare the plans and specifications for all
public improvements and submit them to the Auburn Public Works Department for
the necessary reviews and approvals. And let the owner be advised that a sewer
moratorium is in effect in this area and no new connections can be made .into
t1'ic existing sanitary sewer until the new storm drain is installed in "A" St.
S.E. or the force main bypass is constructed. A connection charge will be

AUDIENCE PARTICIPATION
Pam B., 101 "L" Street S.E., asked the Council to pass a resolution opposing the
proposed rate hike by Puyet_ Sound Power and Light.
Patty Korthas, 2609 "B" St. S.E., spoke against the rate hike because of the
hardship it placed on people living on fixed incomes.
Rena Be11, 303 "A9" St. N.E., also spoke against the rate hike because of the money
that would be used for nuclear plants that as let have no location planned.
Cindy Wi11_i.ams, 2722 West Valley Highway, stated there were petitions available that
presently have 303 si.gnatu.res opposing the rate hike.
Jack tierc~.i ter reported that.. he is nevi sing his recent opinion that the city could not
take a position an the matt~~z'. Hc:> wi1.1 be issuing another opinion soon.
R. T. O'Conn~~r, manager, l'ugr>t Power, a_skad thr~ council not to take any action until
thc~ hc~~rrinq is ht:~ld with tlze~ Washington State Department of Utilities and Transporta-
tion. He stated he felt the council should not act until they have all the informa-
tion on the -issue and that tr'zere were questions that were still unanswered.
Julie Matusick, 315 Ist N.F.., spoke against the rate hike and asked that the council
take ar_t.ion tonight because hearings for this area are to be held soon.

Bob Crucirank, `i30 3rd Street N.E., Apt..#1, read a letter from Harold E. Jones, 502
8th Street N.E., Apt. #22, opposing the rate hike by Puget Power on the grounds $16
million of tl'ie money received would be used for construction and then pay Puget Power
for the use of the facilities which the rate payers had supplied amounting to paying
for the property twice.
Gary Tz~ippe, attorney for new owners of Auburn Manor, spoke in favor of passage of
Ord.iriarrr c:~ tvo. 3340 with one .reservation. He stated he felt the ordinance, which was

Gravel Company on their. low bid of $13,066.50 (sales tax not applicable). Funding:

tax not applicable) wi th funding from one-half cent gas tax.

RECOMMENDATIONS
The Department of Public Works recommends the following for council approval:
Correct error in Uti1_ity Committee record and recommend Terry Bartlett's attendance
at the PNPCA meeting and correct Council motion to include both Bob Kinderknect and
Terry Bartlett as being approved to attend the meeting.

corrected to recommend Terry Bartlett's attendance at the PNPCA meeting and the

as being approved to attend the meeting.

The Mayor recommended he be given authority to apply for CETA positions when those
positions will enhance the ability of the City of Auburn to fulfill the obligations
to the citizens of Auburn at no cost or within allowable budgeted amounts. Notifica-
tion of project funding was mailed November 28 and responses or proposed programs
have to be submitted prior to December 8. This does not allow adequate time to
prepare an adequate presentation. Present plans are to request Jailers and for a
person at the Senior Citizen Center.
It was moved by Roegner, seconded by Hitchcock, to authorize the Mayor to apply for
CETA positions as planned.
