The regular meeting of the Auburn City Council convened at B:DO p.m. in the City of
Auburn Council Chambers.
ROLL CALL
COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Hitchcock,
Flechsig and Lea.
It was moved by Flechsig, seconded by Larson, that the minutes of the December l8,
1979, council meeting be approved as mailed with a correction under Council Committee
Reports, Page 5, Finance Committee. The motion for wage increases for supervisory
_ "~ and non-union personnel should indicate that there was a ROLL CALL VOTE and AZI
Councilmen voted YES with the MOTION CARRIED.
MOTION CARRIED
Mayor Kersey introduced Ron Cude of the Auburn Police Department, 1977's recipient
of the City of Auburn Employee of the Year Award, to present the 1978 Award. Officer
Cude presented the 1978 Employee of the Year Award to Dave Fugit of the Auburn Fire
Department.
PUBLIC HEARINGS
1. Mayor Kersey declared the public hearing open on amendments to 1978 Budget. The
following appropriations are needed:

It was moved by Flechsig, seconded by Kitchell, that the public hearing be closed.

It was moved by Flechsig, seconded by Kitchell, that the city attorney be instructed
to draw up the necessary ordinance to amend the 1978 City Budget.

2. Mayor Kersey declared the public hearing open on the request of Stephen A. Hynes
to rezone from M-2 (Heavy Industrial) to R-4 (Multi-Family) a parcel of Land
approximately 22 acres in size lying on the south side of 29th St. S.E. between
"D" and "F" Streets 5.E. (Application 25-78) The Planning Commission recommends
approval of this request because it would be a down-zoning of the property and
would provide a transitional zone from the heavy industrial uses and would conform
to the land uses on adjoining properties as designated on the Comprehensive Land
Use Plan.
Mayor Kersey noted that this hearing had inadvertently not be properly published.
It was moved by Larson, seconded by Hitchcock, that the public hearing be tabled
until the next regular council meeting at 8:00 p.m., January 15, 1979, in the
City of Auburn Council Chambers.

3. Mayor Kersey declared the public hearing open on the request of Hiro Nakai to rezone
from Unclassified to C-3 (Heavy Commercial) a .parcel of land approximately 5 acres
in size located at the northeast corner of 40th St. N.E. and Auburn Way North.
(Application 51-78) The Planning Commission recommends approval of this request
because it will conform to the Comprehensive Land Use Plan and existing zoning
and development in the area. Consideration should also be given to the dedication
of the necessary right of way for the construction of the Auburn Way North U.A.B.
Project which will provide 4 traffic lanes and a left-turn Zane that will benefit
the development of this property. Let it be known that the petitioner is willing

Steve Harris, Western City Properties, representing Hiro Naka.i, was in the audience
to answer any questions. No one else in the audience spoke for or against the
request.

It was moved by Craig, seconded by Larson, that the request of Hiro Nakai to
rezone from Unclassifed to C-3 (Application 51-78) be approved and the city
attorney instructed to draw up the necessary ordinance to include the recommendations
of the Planning Commission and Marv Seabrands'letter of November 28, 1978.

4. Mayor Kersey declared the public hearing open on the request of Landon Development
Company to rezone from Unclassified to R-2 (Single Family) a parcel. of Land 40
acres in size Located on the west hill northeasterly of 58th Avenue South (Applica-
tion 52-78) The Planning Commission recommends denial of the request for R-2
(Single Family) zoning and recommends approval of R-1 (Single Family) instead
because it will conform to the Comprehensive Land Use Plan and provided that
the east portion of the site that is shown as open space on the Land Use Plan
is left Unclassified.
Peter Buck, 403 Columbia Street, Seattle, attorney speaking for the applicant,
stated that p_Zats were submitted from hi_s client for both R-1 and R-2 zoning. He
said his client_ could live with either R-1 or R-2, however, he asked the Council
to consider R-2. He submitted a map to be entered into the record as Exhibit "A"
which he felt demonstrated the platting activi_ttZ in the surrounding area. He added
that his request was not inappropri.atcr in view of other platting activity .i.n the area.
A letter was also _submitted for the record as Exhibit "B" from Bob Scholes, SEA,
Inc., F.,ngineers/Planners, which .indicated density as would be expected by King Cou
RS 15,00 would run 3.2 to 3.4 dwelli.nq units per. acre. Mr. Duck stated the area
would also be visually buffered, the so_i1 is goad which can handle the natural runo
and drainage and the view is good whi ch makes this site appropriate for developmen .
He added that traffic analysis indicates the streets are very much adequate to
handle the traffic. Also, the area has sewers available which determine that
a greater density can be appropriate.
Robert R. Igielski, 31214 55th Avenue South, representing the West Hi11 Association
for Control of llevelopmcnt Density, opposed the request. He stated they felt that
when a new development is combined with an existing one, it should be done in a mafrner
which wi1Z support the established interests of both the existing community as well
as those who will be new neighbors. He addc>>d there was only approximately 8 acres
of the 42.5 acres in the plat which a~>proached the RS 15,000 density which ex.ist_s
in the immediate community. He sited the Federal Way Communit~l Plan which recommended
dc.•nsi ty of 1 to 3 dwell ing units per acrd for proper. ty to tZze north. He also drew
the Council's attention to a peti.t.ion from .1234 residents in ttre immediate vicinity,.
Meredith Hi11 area, that was submitted last July t_o the King County Council stating
concerns of th<~ intensi ti/ of the developmen t. proposed . He added that Mr. Buzch's
map in dicatiny platting activity did not show a correct picture _in that only two
of the plats proposed have preli.m.inan.~ approval and all thE, ~~~ ~~~n in contention.
Mr. Igi.elsk_i sa.i_d the residents were concerned about the high crirne~ potential
and that there were no provisions for road access from the Cite of Auburn without
going through the county or provisions for added traffic. He stated he felt_ these
reasons were enough to warrant an Environmental Impact Statement. The West Hi11 _
Association felt the dcns_i.ty should be the same as currently proposed for the rest
of_ the county in this area or. not y.reater than 1 dwelling unit per acre or City
of Auburn RS zoning. A compromise would not be what the Planning Commission reco s
but be what they enjoy now or 15,000 sq. ft. per acre per Lot.
Walter O. Smith, 30526 58th Avenue South, stated his chief concern is that the plat
only provides one access road. He said people in the area would eventually want
better. access and he' wanted the Council to consider who would pay for it. Fie a_s.ked

the Counci_1 to consider an amendment to provide access and thus compel the developer
t_o pay for it.
Colleen Moen, 30625 56th South, stated that: rf~si-dents of thr Auburn HE:ights Park
area were aware when theLl bought property of the restrictive covenent stating they
could not subdivide their land. She added they would like the rest of the area to
stay consistent.
Paul Buck added to his previous comments that it is incorrect to think what they
are proposing is less dense than allowed under RS 15,000. He stated that the King
County Plan and the Federal Way Community Plan do not take into consideration that
this area is planned with sewers.
Bogert Igielski_ asked that a count be taken of those in the audience opposing the
request. There were 32 people opposing the request, none of whom lived within
the city limits. There were 6 people in the audience in favor of the request.
Gail Daffer, 30582 58th AvenuE. South, stated that none of those opposing the plat
and rc.~zone live in t_he City of Auburn but those who will 1.i.ve in the proposed develop-
ment will only have access through their neighborhood and she was concerned about
traffic problems.
Rose DeFoor, 30576 58th Avenue South, stated that Mr. Buck's reference to a buffer
zone to the west would be just her and her neighbor`s back yard.
Joseph Muscarnera, 5239 South 312th, stated his opposition to the request reaffirming
Mr. Igielski's comments.
It was moved by Craig, seconded b_y Larson, that the public hearing be closed.

Craig called on Dave Markley of Transpo Group, a traffic, planning and engineering
firm. Mr. Markley stated that concerns on the impact of the added traffic were not
uncommon. The traffic with this development would increase to about double on 5lst
and 305th, however, that increase related to the capacity of the .roadway would still
be less than the .road could handy with .just some added modc.~rn safety devices. He
statn_d he felt the impact would be negl.i.g_ib1e.
Cra.iq asked if the.r.e were immediate plans in the City's Street P1 an for extention
of a road in the area.
Pat Nevins stated there were no immeddate plans, however, there are long range plans
to provide a connection from where the existing gravel pit is from West Valley
up the hill and to this road system. Fie added that whether this plat was developed
or not the growth in the area will eventually create a need to have some type of
connection.
Roegner asked Ed Henderson what the Firc~~ Department response time was in this area
in case of fire.
Ed Henderson .responded somewhere between 10 and _Z2 miinutes. however, there is a
mutual aid agreement with King County District #39 which could lessen the response
time to 4 minutes depending on the time involved for their volunteers to reach the
station.
Roegner also asked what the necessary time was in case of a heart attack.
Henderson stated that generally 5-6 minutes but each case would have to be considered
-individually.
Larson asked Chief Scyler about police protection problems in the area.
Scyler stated they now qo up to the Evergreen School and Cemetery area and there
would be a problem going from city limits to King County then back into the city.
Hitchcock asked Pat Nevins about Water District No. 124 and if there had been problems

with amount of water and the size of the lines.
Pat Nevins stated that a Ietter from the Water District to the Utility Committee
had indicated that there would not be a problem in this area because i.t is at a
Zower elevation.
Lea asked George Schu.Zer to explain why an Environmental Impact Statement had not
be called for.
George Schuler responded that their Declaration of Non-Sign~l~cance was based on
the fact that Water District #124 .indicated there was sufficient water for domesti.
and fire flow purposes, property owners were willing to participate in an LID to
oversize sanitary sewer on the West Valley Highway, and that analysis of traffic
and storm drainage p-roved adequate.
Lea also asked George Schuler if water and storm drainage was adequately provided
for.
.Schuler responded that the developers would have to conform to the storm drainage
ordinance before the final plat could be approved,
Flechsig asked if under R-1 zoning, would there be no more than 4 units per each
and every acre.
Schuler responded that lots as submitted on the preliminary plat. for R-l shows that
they will meet the minimum requirements under R-1.
Flechsig .also asked why the preliminary plat had threeroads from the area with only
one going into a street.
Schuler responded that p.rovi.sions of the preliminary plat provide roads to a now
undeveloped area of another subdivision. Eventually there w_ilZ be additional streets
as the other properties develop intluding city property and we have made provisions
so that there can be future outlets t_o these properties,
Hitchcock and Craig asked for further clari.f.~:cation of t_he density proposed on thi
request as compared to what is existing now.
Schuler responded olri lot size was based on the fact there wf_'re no sewer prov_i.sions,
however, this is not the case in th_zs situation.
It was moved by Lea, seconded by Roegner, to table this request until the next
regular meeting of the Council on January 15, 1979, 8:00 p.rn, in the Auburn Council
Cl~arnber. s .

Roegner requested that the Fire Department Look into the response time and the
Public Works DF~partment Look into the safety of the roads.
5. Mayor Kersey declared the public hear_inq open on the request of D.M. Young Cont.
Co. for approval of a preliminary plat to be known as "Auburn Ten" on a 10 acre
parcel of Land located on the east side of "B" St. N.W. approximately 224 feet
south of 37th St. N.W. (Application P-10-78) The Planning Commission recommends
approval of the preliminary plat to be known as "Auburn Ten" because it does conform
to the minimum requirements of our subdivision and zoning ordinance and the owner
and/or developer prepare the p.Zans and specifications for all public improvements
and submit them to the Public Works Department for their approval.
Bob Scholes, representing the applicant, was in the audience to answer any questions.
No one else spoke .for or against thE: request.

6. Mayor Kersey declared thca public hs~ariny open on the request of handon Development
Company for approval of a preliminary plat to be known as "Sunrise Addition" on
a parcel of land 40 acres in size located on the west hill northeasterly of 58th
Avenue South. (Application P-11-78) The Planning Commission recommends approval
of the preliminary plat. of "Sunrise Add_i.tion" after it has been resubmitted and
reviewed by the Planning and Engineering Departments as to conformance with the
R-1 (Single Family) minimum square lot footage of 8,000 on all the Lots in the
_ subdivisian. AZso that the owner and/or developer prepare the plans and specifica-
Lions for all public improvements and submit them to the Public Works Department
for their approval. This approval should be conditioned on the following:
1. That a public streetaccess be installed and accepted by ILing County in that
portion of land lying between 58th Avenue South and the west boundary of this
plat or to another public street in the area in the event that the portion
of the subdivision proposed for annexation is not annexed.
2. 'lhat_ on those .lots on cul-de-sacs and elsewhere in the preliminary plat with
less than 80 foot frontage on a street, a building setback Zine shall be
shown on the final plat which will provide a frontage of 80 feet in width
at the front_ building line.
3. That the planter islands located within the street right of way lines be
eliminated unless that _subdivider can show that they will be installed and
maintained by a homeowners association which would guarantee maintenance.
Approval of this preliminary plat should also be conditioned upon the approval of
zoning Application No. 52-78 which will rezone the property from Unclassified to
R-1 (Single Family) residential.
Bi11 Gardener, 5215 South 310th, stated those who Zive in the west hill area have
to be concerned with the approximately 15 different developments that are going
in in the area. He added that the whole picture must be considered not just this
one development.
Robert Igielski, 31214 55th Avenue South, representing the West Hi11 Association
fo.r Control of. Development Density, stated there was definite concern over adequate
water supply for domestic and fire flow purposes citing a resident of the area
who did not have enough water supply to make h.is sprinkler work .in the summer time.
He added that he 1'iad figured the effective density of the plat to be 3.3 dwelling
units per acre.
Peter Buck, representing the applicant, stated that even the density cited by
Mr. Igielski was Less than the Comprehensive Land Use Plan permits and even much
Iess than would be allowed under King County's RS 15,000 zoning which is the
surrounding zoning.
Forrest Boren, 31422 55th Avenue South, stated that he had a pressure gauge on
his water system for approximately a year and the most pressure he has seen on
the gauge was 25 pounds.
James Carpenter, 3I2.Z1 55t:h Avenue South, pointed out that the accesses are through
county roads and stated he fe.It one access is not realistic.
Colleen Moen, 30625 56th South, stated no two cars are going to get through when
cars are parked on either side of the .road.
It was moved by Craig, seconded by Hitchcock, that the public hearing be closed.

Hitchcock asked for claz•ification of the plat requirement that a public street

be installed between 58th Avenue ~'nuth and the west boundary of the plat.
George Schuler responded that this requirement was set forth in case the road
as proposed on the plat could not be developed.
It was moved by Lea, seconded by Roegncr, to table this request until the next
regular meeting of the Council on January 15, 1979, 8:00 p.rrt., in t_he Auburn Counc
Chambers.

Rids were opened December 27, 1978, at 11:00 a.m. on legal publications for the City
dur..ing 1979. The only bid received was from Fournier Newspapers with bid listed as

Councilman AI Flechs.ig, Chairman of the Finance Committee, read a letter dated January 2,
1979, from Fournier Newspapers stating an error. had .been made on the original. bid
and it should have been as follows:

Flechsig stated that it was his feeling that unless a good explanation of thc~ error
could be made he was in favor of holding 1-'ournier Newspapers to their original bid.
Larry Hill representing Fournier Newspapers, stated he was not aware of how the error
had occurred, however, the increase in publication charges was not out of line with
increased costs due to inflation and charges throughout the industry.
Jack Bereiter advised the Council in a situation such as this the criteria in making
a decision was (1) there was immediate notification, (2) error was made i_n good faith,
and (3) there was a Zogiea_1. explanation how error occurred.
Hi11 stated he was not aware of what had caused the error.
,lack Bereiter asked Mr. Hi11 if the paper. was willing to continue at_ the 1978 rates
until the matter was resolved.
I1i11 stated yes.
Ct was moved by £'lcchsi.g that Iournier Newspapers be asked for a logical explanation
in writing why the error was made to be presented at the next regular Finance Committee
meeting.
Hitchcock moved that the motion be amended so that the letter be from the president
of the company. The motion died for Zack of a second.
Hitchcock then seconded the original motion as stated.

S.E. between "B" Street S.E. and 200 feet east.

It was moved by Hitchcock, seconded by Flechsi.y, to authorize purchase of f.i.ve four-
door full size cars from the Washington State Patrol bid for $6,903,27 each for a total
of $34,516.00 with cost of cars coming from the 1979 Po]_ice Department budget and any
excess to be taken from other Police Department budgeted areas.

OLD BUSINESS
It was moved by Lea, seconded by Craig, to approve a $44,328 transfer to the 6(11)
and 6(kk) revenue sharing categories to supplement the $80,941 currently remaining
in these categories to enable awarding of Contract 78-05, St. Imp. 184, traffic
signals at 4th St. N.E. and 4th St. S.E. on "M" Street, t_o Totem Electric on their
low bid of $102,091.0.0.

MISCELLANEOUS BUSINESS
Lea asked what had happened to Ordinance No. 3350 which had been vetoed by the Mayor.
He stated that he felt there were no extra charges being added.
Mayor Kersey stated he had not decided whther to veto the entire ordinance or just
do a Line item veto.

Craig suggested the matter be taken bar•.k to th<~ Street Committees and the entire ordinance
reviewed.
Hitchcock requested at this time that the Council recess to an executive session to
discuss matter of personnel.
There being no further. business to come before the Counci_Z, the regular meeting was
adjourned to executive session at 11:25 p.m. to discuss matters of personnel.
