RpL7. CALL COUNCILMEN fRF.SENT: Councilmen Roegner, Kitchell, Craig, Larson, Hitchcock, Flechsiq and Lea. It was moved by I~'lechsiq, seconded by Hitchcock, that the minutes of the January 2, 197.9 r_ouncil meeting be approved as mailed with the following addition and correction: Addition to Paye 1, Public Hearing, No, 2. The Mayor questioned the audience whether anyone wanted to speak for or against the request of Stephen A. Hynes. No one in the audience spoke .for or against the request. Correction to Paye 9, Miscellaneous Business. Mayor Kersey stated he did not have the power to veto just those items he did not agree w_i.th so he would have to veto the entire ordinance. MOTION CARRIED ~~^^ PUBLIC HEARINGS l.9.J 1. Mayor Kersey declared the public hearing open on the request of Stephen A. Hynes to rezone from M-2 (Heavy Industrial) to R-4 (Multi-Family) a parcel of land approximately 22 acres in size 1y_ing on the south side of 29th Street S.E. between "D" and "F" Streets S.E. (Application 25-78). The Planning Q Commission recommends approval of this request because it would be a down- Q zoning of the property and would provide a transitional zone from the heavy industrial uses and would conform to the Land uses on adjoining properties as designated on the Comprehensive Land Use Plan. Jack Ewing, 24032 137th Avenue S.E., Kent, representing the applicant, was i.n the aud_i.ence to answer questions. He stated the original request had been reduced since Mr. Hynes had sold 1 0 acres of the northwesterly portion of the parcel. It. was moved by Larson, seconded by Flechsig that the public hearing be closed. MOTION CARRIED Craig asked Jack Bereiter if this change would cause any problems. Bereiter responded that he saw no problems in a situation of decreasing the request. Craig and Hitchcock asked if this property was in the area of the moritorium. Gearge Schuler responded the property which was left was not in the moritor- ium area. It was moved by Larson, seconded by Craig, that the request of Stephen A. Hynes to rezone from M-2 to R-4 (Application 25-78) be approved and the city attorney instructed to draw up the necessary ordinance with the recom- mendations of the Public Works Department. Mayor Kersey declared the public hearing open on the request for vacation of a portion of 9th Street North East lying west of "I" Street North East. It .is recommendcad by the Utility and Street Committees and the Public Work Department to deny the vacation to provide access for maintenance of an existing san.i.tary sewer under the right of way proposed for vacation. Mayor Kersey noted that this hearing had not been properly advertised. The request of Z,andon Development Company to rezone f-rom Unclassified to R-2 (Single Family) a parcel of land 40 acres in size located on the west hill northeasterly of `;8th Avenue South (Application 52-78) was again brought be'~o~~e the council. Lea mentioned that recent correspondence from Water Distrir..t No. 124 and the Fire Department was generally favorable. He stated he was concerned about a bottleneck on 58th and asked George Schuler _if the City could get improvemt:nts from King Countt,7 or. if there was any way the City could get the developer to enter _into an agrt~e~ment to resolve the ,problem. ,Schuler. resZx~nded he was sure that something could be worked out between King County and the developer. It would mean, however, that action could not bc? taken on the plat at this time since it could not be made a condition of the plat but, he addc:~d, that something could be worked out. Schuler asked Lea if there weree some guidelines that could be proposed to the developer. Lea responded hi.s concerns were basically over open drainage ditches and the road being widened enough to handle two Lanes of traffic comfortably. Craig suggested to the council that maybe the problems they were having was with the plat rather than the rezone and to get things moving the rezone could be approved and hold up the preliminary plat until additional questions could be answc:gyred by the staff. He stated .it appeared the Council's concerns were with an area the city had no jurisdiction and the way thfa plat provides access.
