ROLL CALL COUfJCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Larson, Hitchcock, Flechsig and Lea. It was moved by Flechsig, seconded by Kitchell, that the minutes of the January 15, 1979, council meeting be approved as mailed. MOTION CARRIED Mayor Kersey presented George Schuler an award from himself and a letter from the - Nominating Committee of the Employee of the Year thanking George for the tremendous effort and time he put in as Project Coordinator for construction of the new City Hal 1 . PUBI_ I C HEARINGS 1. Mayor Kersey declared the public hearing open on the request of Rochelle Bassan to rezone from Unclassified to R-1 (single family) on a parcel of land approximately ~ 53 acres in size lying on the south side of Oravetz Road in the 2400-2700 blocks. (Application 53-78) The Planning Commission recommends approval of this request (~ because it will conform to the Comprehensive Land Use Plan and will conform to V,J planned development on abutting and other properties in the area. Q Tom 6arghausen, Cavness Engineers, representing the applicant, stated he was in Q concurrence with the recommendations of the Planning Commission and that he felt the R-l zoning would allow a suitable and compatible use of land. Gary Crowell, 2815 - 53rd St. S.E., asked the Council to hold off the rezone until a preliminary plat could be .viewed. He stated the rezone was not compatible with crarrent land use in the surrounding area. Also, the request was not in accordance with the Comprehensive Land Use Plan and he cited Part 3, Land Use, Page 69 of the Auburn Comprehensive Land Use Plan covering the Stuck River. He referred the Council also to the Dames and Moore report stating that high volume community wells in the highlands may endanger the water supply of Coal Creek Springs area. Tom Barghausen, Cavness Engineeers, rebutted Mr. Crowell's statements quoting from the same section of the Comprehensive Land Use Plan which said approximately half of the topography consists of slopes of 5 to 20`% and upon these areas single family densities of 4 residences per net acre were proposed. He added that he felt the rezone should be considered separately as a first step in order to proceed with the preliminary plat. It was moved by Larson, seconded by Flechsig, that the public hearing be closed. P10T I ON CARRIED Hitchcock asked George Schuler to elaborate on whether the request is in conformance with the Comprehensive Land Use Plan. George Scfruler responded that this request was in conformance to the Comprehensive Land Use Plan. Larson asked George Schuler for clarification on the total area that could be developed since there was acreage that would be under the power line easement and area that had too great of slope. George Schuler replied there was approximately 14 acres in the power line easement plus a small portion along Oravetz Road several hundred feet deep that had too great of slope. Ilowever, he added, it still is in conformance with the Comprehensive Land lJse Plan as far as density. Roegner questioned George Schuler about the environmental impact on the area.. Geroge Schuler stated there was Borne impact but it wasn't felt the impact was such to require a full Environmental Impact Statement. -1- ~~ AUBURN,_ WASHINGTON MONDAY FEBRUARY 5, 1979 It was moved by lea, seconded by Craig, that the request of Rochelle Bassan to rezone from Uncla~~sified to R-1 (Application 53-78) be approved and the city attorney inslructed to draw up t:he necessary ordinance with the recommendations ~~f the Planning Commission and continents of t:he Engineering Department. Mayor Kersey declared the public hearing open on the request of ~1aurine Barrett to rezone from t~-1 (Light Industrial) to C-3 (Ileavy Coirnnercial) a parcel of land approximately one (1) acre in size located on the west side of Auburn Way North in the 3300 block. (Application 54-78) The Planning Coirnnission recommends approval of this request because it will be a down-zoning and it will conform to the Comprehensive Land Use Plan and will be compatible with existing development on both sides of the property. Loren Combs, 3204 Auburn Way North, representing the applicant, stated that this request was fora Mini-Mart and there were representatives from Coastal Oil Co. to answer any questions. No one else spoke for or against the request. It was moved by Flechsig, seconded by Kitchell, that the public hearing be closed. MOTION CARRIED Craig noted that the sewer lift station in the area was at its capacity and that he thought the applicant should be aware of this. It was moved by Craig, seconded by Flechsig, that the request of Maurine Barrett to rezone from M-1 to C-3 (Application 54-78) be approved and the city attorney instructed to draw up the necessary ordinance to include the Planning Commission recommendations and the comments regarding the sewer lift station and the Engineering report of Marv Seabrands of January 23, 1979. ROLL CALL VOTE: All councilmen voted YES MOTION CARRIED 3. Mayor Kersey declared the public hearing open on the request of Jack L. Sprenger to rezone from R-4 (Multi-Family) to C-1 (Light Commercial) a parcel of land 11,000 square feet in size lying on the north side of 3rd Street N.E., AKA 311 and 317 3rd Street N.E. (Application 55-78) The Planning Commission recommends approval of this request because it will conform to the Comprehensive Land Use Plan and any new development will tend to upgrade the entire area. Jirn Sprenger, Auburn, was in the audience to answer any questions and stated that the purpose of this was to get rid of buildings that were eyesores by tearing them down and making parking lots out of them. Also, he added they planned to building a private club for hand ball on the 11,000 sq. ft. of premises. No one else in the audience spoke for or against the request. It was moved by Craig, seconded by Roegner, that the public hearing be closed. MOTION CARRIED Hitchcock asked if sufficient parking was allowed for. Jlm Sprenger replied there more than enough parking planned with possible future use for their office. It was moved by Larson, seconded by Roegner, that the request of Jack L. Sprenger to rezone from R-4 to C-1 (Application 55-78) be approved and the city attorney instructed to draw up the necessary ordinance. ROLL CALL VOTE: All councilmen voted YES MOTION CAP.RIED 4. Mayor Kersey declared the public hearing .open on the request of Bocek Brothers to rezone from Unclassified to R-2 (Single Family) with a Conditional Use Permit to -2- 183 AUBURN, WASHINGTON MONDAY FEBRUARY 5, 1979 construct a 302 unit residential complex consisting of 124 4-plex living units, 122 townhouse and 56 single family units on a parcel of land 42.2 acres in size lying north of 40th St. N.E. between "I" St. N.E. and the Green River. (Applica- tion 57-78) The Planning Commission recommends approval of this request provided the following conditions are incorporated into the site plan and approved by the Planning Department before this request goes before the City Council for public hearing. (1) A minimum of 6,000 sq. ft. of lot area is provided for each living unit, (2) That the mixture of living units (4-p1ex, townhouse and single family) be revised to provide more of a balance, (3) That the public street area be deducted from the total area when computing the density, (4) That the density not exceed 6 living units per acre, (5) That the roadways providing access to the 4-plexes be designed as public streets because it appears that they will be platted and sold individually, (6) That 40th, 41st, "M" 41st Pl. and "K" P1. Northeast be designed to public street standards and dedicated to the City. Don Bocek, Bellevue, stated the plat plan had been changed and a revised proposed plan had been subrni tted. Mayor Kersey asked George Schuler if this plan was the one the Council had been furnished. George Schuler responded yes it was. No one else spoke for or against the request. Q It was moved by Flechsig, seconded by Larson, that the public hearing be closed. Q MOTION CARRIED Craig questioned a drainage easement on the proposed plat and asked if it was the old sewer out fall. Bob Bocke explained that it was a reserve for future use as an overflow and on which they could not build. Craig asked that it be noted by the developer that this area is where there are problems with the sewer lift station. Lea asked George Schuler if the zero lot line is a new concept in the City of Auburn. George Schuler responded yes and no in that it is used in condominiums so they can put the buildings closer together. In this concept presented they stay 2 feet from one property line and 20 feet from the other property line which would give better utilization of the yard area. Lea asked if parking would be provided for recreational type vehicles. George Schuler stated that this area would be developed the same as single family homes and would have to meet the same requirements for off-street parking. Lea and Hitchcock asked for further further clarification on off-street parking in the case of these units becoming rentals. George Schuler stated the lots would be treated as single family lots and would assume they would be sold to individual ownerships. Therefore, they would have to park on their own lot. With this concept they have the opportunity to get to their back yard area. It was moved by Lea, seconded by Hitchcock, that the request of Bocek Brothers to rezone from Unclassified to R-2 (Application 57-78) be approved and the city attorney instructed to draw up the necessary ordinance to include the recommendations of the Planning Commission, Planning Department and comments from the Engineering Departrent. Zone Change Application from Jim Cox and John Porter to rezone from Unclassified to R-4 (Multi-Family), property located on the south side of 37th St. S.E. in the 500 block. (Application 2-79) 2. Zone Change Application from Arthur C. Torgerson and John Rosholm to rezone from R-4 (Multi-Family) to C-1 (i_ight Commercial), property located on southeast corner of "A" and 3rd Streets N.E. (Application 3-79) 3. Request of C. fi. Knechtel for approval of a preliminary plat to be known as Blue Sky located on the easterly end of 21st St. S.E. in the 3300-3400 blocks. (Applica- tion P-1-79) 4. Request of Frank PJeri for approval of a preliminary plat to be known as Neri's Addition located at .the southerly end of Scenic Drive S.E. and east of 20th St. S.E. (Application P-2-79) It was moved by Larson, seconded by Lea, that applications 2-79, 3-79, P-1-79 and P-2-79 be referred to the next regular meeting of the Planning Comr,~ission. MOTION CARRIED 5. Petition for Street Vacation by two-thirds of the abutting property owners, property located approximately 900 feet east from the extended right-of-way of Oravetz Road (formerly South 376th). (Application V-1-79) It was moved by Larson, seconded by Craig, that the city attorney be instructed to draw up the necessary Resolution to Call fora Public Hearing to be held on the vacation request of two-thirds of the abutting property owners, property located approximately 900 feet east of the extended right-of-way of Oravetz Road (formerly South 376th) on March 19, 1979, at 8:00 p.m., in the City of Auburn Council Chambers. MOTION CARRIED BID OPENINGS Bids were opened January 23, 1979, at 11:00 a.m. on cost of printing the City legal advertisements. The only bid from Fournier Newspapers was as follows: 8_Point Type. $3.60 per column inch for first publication .40 cents per line for first publication $3.51 per column inch for additional publications .39 cents per line for additional ,publications It was moved by Flechsig, seconded by Craig, to accept the bid from Fournier Newspapers with rates to be effective February 6, 1979. Authority to call for bids for disposal of sewer rudder which has been declared surplus by the Utility Committee. It was moved by Craig, seconded by Larson, to authorize a call for bid for disposal of sewer rudder which has been declared surplus by the Utility Committee. ROLL CALL.
