ROLL CALL COUNCILMEN PRESENT: Councilmen Roegner, Kitchell, Craig, Hitchcock and Flechsig. COUNCILMEN EXCUSED: Councilmen Larson and Lea. It was moved by Flechsig, seconded by Kitchell, that the minutes of the February 5, 1979, council meeting be approved as mailed. MOTION CARRIED PUBLIC HF•,ARINGS 1. Mayor Kersey declared the public hearing open on the assessment roll of L.I.D.'s t~1 294, 301 and 302, sanitary sewer mains and appurtenances in the area ~.f the West ~lr nJ Valley Highway, 15th Street N.W. and vicinity. The City Clerk read into the record a letter from John Milich, Auburn Park o.f W Industry, asking three questions on L.I.D. 294. Q Q John Milich, Auburn Park of Industry, was in the audience to speak in favor of the assessment rolls. Pat Nevins answered Mr. Milich's questions: (1) The areas have been computed on gross land area, (2) The topographic maps are old that were used to compute the square footage, however, he and his staff would be glad to sit down with Mr. Milich to come to an agreement on the square footage and (3) Service will be available later this summer or early fall. No one else spoke for or against the assessment rolls of L.I.D.'s 294, 30I and 302. It was moved by Craig, seconded by Flechsig, that the public hearing be closed. MOTION CARRIED It was moved by Craig, seconded by Flechsig, that Ordinance No. 3370, entitled, "AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 294, WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWER AND APPURTENANCES ON THE WEST VALLEY HIGHWAY BETWEEN A POINT 850 FEET SOUTH OF 15TH STREEW N.W. Mayor Kersey declared the continued public hearing open on tree request of TransCanada Enterprises, Ltd. to rezone from Unclassified to R-2, R-3 and R-4 .property located on the south side of the Stuck River approximately 1 mile east of "R" Street S.E. (Application 3q-78) The Planning Commission recommends approval of the request for R-2 (Single Family) zoning which is in conformance with the Comprehensive Land Use Plan, and that the request of the R-3 (Duplex) and R-4 (Multi-Family) zoning be denied. In addition, no approval is to be granted until the Flood Control Zone Permit is approved on the property. The City Clerk read into the record a Ietter from David R. Millard, Land Planning & Management, asking for another continuance on a "call" basis. Only one citizen expressed an interest in the request but did not wish to speak for or against it. It was moved by Flechsig, seconded by Roegner, that the request of TransCanada Enterprises, Ltd. to rezone from Unclassified to R-2, R-3 and R-4 (Application 39-78) and to rezone from Unclassified to R-2 (Application 40-78) be tabled until Flood Control Zone Permit problem is resolved and, further, costs-of readvertising of the continued public hearing be assessed to TransCanada Enter- prises, Ltd. MOTION CARRIED 3. Mayor Kersey declared the continued public hearing open the request of TransCanada Enterprises, Ltd. to rezone from Unclassified to R-2 (Sin_g1e Family) .property located Z/2 mile east of "R" Street S.E. south of the White River and northerly and southerly of Stuck River Road. (Application 40-78) The Planning Commission recommends approval of this request because it conforms to the Comprehensive Land Use Plan and will allow the developer to proceed with his plan for servicing the area with all the necessary public improvements. Action taken under previous hearing. 4. Mayor Kersey declared the public hearing open on the request for vacation of a portion of 9th Street N.E. lying west of "I" Street N.E. It is recommended by the Utility and Street Committees and the Public Works Department to deny the vacation to provide access for maintenance of an existing sanitary sewer under the right of way proposed for vacation. The City Clerk read into the record a Ietter from Bob L. Weiss, The New Orleans Apartments, recommending that the City Council grant the vacation with an easement. Bob Weiss, Managing Partner, The New Orleans Apartments, stated he understood the reason the Department of Public Works was recommending denial of the vacation was because of the need to provide access to a sanitary sewer. He felt there was no problem to granting an easement which would satisfy the need for access. No one else in the audience spoke for or against the vacation. It was moved by Flechsic, seconded by Kitchell, that the public hearing be closed. MOTION CARRIED Craig stated that if the area would be used for grass there would be no problem. (Application 6-79) It was moved by Flechsig, seconded by Roegner, that applications 4-79, 5-79, P-3-79, P-4-79 and 6-79 be referred to the next regular meeting of the Planning Commission. MOTION CARRIED The City Clerk noted that a Letter to the City Council from Lyle R. Schneider, attorney for Mrs. Theresa Pfu1g, regarding a problem over Mrs. Pf1ug's water bill had been received and forwarded to the Utility Com„*^ittee. AUDIENCE PARTI"IPATION Colleen, Moen, 30625 56th South, spoke against approval of the request for approval of a preliminary plat to be known as Sunrise Addition to be considered tonight under Old Business. She presented a letter for the record from State Representative Frank Warnke to Ruby Chow, Chairwoman, King County Council District No. 5, expressing his concerns over housing growth in the Federal Way area and the burdens brought on by careless or poorly planned housing developments. BID OPENINGS Bids were opened February 13, 1979, at 11:00 a.m., on Street Improvement 174, three intersections. The following bids were received: Totem Electric of Tacoma $198,959.00 Signal Electric Inc. 232,305.00 The Department of Public Works recommends t_;~at the bids be referred to t^e Street Committee. It was moved by Craig, seconded by Hitchcock, that the bids for Street Improvement 174, three intersections, be referred to the Street Committee. MOTION CARRIED RECOMMENDATIONS The Department of Public Works recommends the following for council approval: 1. Authority to hold public hearing on Assessment Ro11 for L.I.D. 293, undergroundinq Estates located on 29th Street S.E. It was moved by Craig, seconded by Flechsig, that a public hearing be held on the Assessment Ro11 for L.I.D. 293, undergrounding on East Main Street from "D" to "M" Streets on Main Street on March 19, 1979, at 8:00 p.m., in the City of Auburn Council Chambers. ROLL CALL VOTE: All Councilmen voted YES MOTION CARRIED 2. Authority to call for bids for Street Improvement 215, parking Zot construction at East Main and "D" St r.eets. It was moved by Craig, seconded by Hitchcock, to authorize a call for bids for Street Improvement 215, parking _Zot construction at East Main and "D"' Streets. .ROLL CALL VOTE: Councilmen Craig, Hitchcock, Roegner and Kitchell voted YF,S. Councilman Flechsig voted NO. MOTION CARRIED The Department of Planning and Community Development recommends a call for public hearing on the following: 1. The request of Mark Land Development Company to amend an existing Special Property Use Permit to construct and operate asphalt and concrete batch plants on a parcel of land 120 acres in size lying on the east side of Oravetz Road and south of the Stuck River. (Application 56-78) 2. The request of Amelia Bloom to rezone from a Special Property Use Permit for a professional office to R-4 (Multi-Family) on a parcel of land approximately 32,000 sq. ft. in size located on the northwest corner of 20th and "F" Streets S.E. (Application 58-78) 3. The request of the Messiah Lutheran Church for a Conditional Use Permit for construction of additional classrooms on a parcel of Land zoned R-3 (Duplex) and Located on the northeast corner of 4th and "H" Street N.E. (Application 1-79) 4. The request of Jim Cox and John Porter to rezone from Unclassified to R-4 (Mu1ti- Family) a parcel of Land 2.66 acres in size located in the 500 block on the south side of 37th S.E. (Application 2-79) 5. The request of Dr's. A. Torgerson and J. Rosholm to rezone from R-4 (Multi-Family) to C-1 (Light Commercial) a parcel of land 17,500 sq. ft. in size lying at the southeast corner of 3rd and "A" Street N.E. (Application 3-79) 6. The request of THB Development Corporation for approval of a preliminary plat to be known as Shirewood Estates located on a parcel of land 53 acres in size on the south side of Oravetz Road in the 2400-2700 blocks. (Application P-12-78) 7. Consideration of an amendment to Chapter 18.12 R-1 Single Family zoning classifica- tion and Chapter 18.14 R-2 Single Family zoning classification,to prohibit the placement of mobile homes on individual single family lots. COUNCIL COMMITTEE REPORTS Municipal Building Committee - Chairman Bob Roegner It was moved by Roegner, seconded by Kitchell, to authorize the Park Department to caZ1 for .bids for the lease of two small pick-up trucks with the lease to include full maintenance. Hitchcock stated he opposed _.he Leasing rather than purchasing because he figured it would cost $2400 per unit more to lease. Craig stated he would oppose anything that might degrade the Equipment Rental program. Roegner stated the City would have the option to purchase the vehicles. Mayor Kersey stated this action was not intended to degrade the Equipmental Rental -4- 19'7 AUBURN, WASHINGTON ,_~ TUESDAY FEBRUARY 20, 1979 program, however, these vehicles were some that were caught in the change to the Equipment Rental program. He added that it was intended to buy the equipment. ROLL CALL VOTE: Councilmen Roegner, Kitchell and Flechsig voted YES. Councilmen Craig and Hitchcock voted NO. MOTION CARRIED It was moved by Roegner, seconded by Flechsig, that a resolution be adopted establishing 1979 Equipment Rental and Revolving Fund rates. ROLL CALL VOTE: A11 Councilmen voted YES MOTION CARRIED It was moved by Roegner, seconded by Kitchell, that the old Coinfax Olivetti copy machine at the Library be declared surplus and that it be .advertised for. sale. Woodward for services rendered for the surplus material auction held January 13, 1979. AND P.S.C.O.G. be informed the City of Auburn has no objections to their proposed 91 elderly, handicapped or disabled structure providing requirements as set forth by the Planning & Community Development Committee are met. ROLL CALL VOTE: A11 Councilmen voted YES MOTION CARRIED It was moved by Roegner, seconded by Kitchell, to authorize the Park and Recreation Department to call for bids for a restroom and spray pool to be Located in the Auburn City Park. ROLL CALL VOTE: All Councilmen voted YES MOTION CARRIED It was moved by Roegner, seconded by Kitchell, to authorize a concession permit to the Auburn Baseball Club to sell sandwiches at Brannan Park and Fulmer Field during the summer season. MOTION CARRIED Utility Committee - Chairman Ron Craiq It was moved by Craig, seconded by Hitchcock, to approve payment to the City of Seattle for services performed relating to cable television management in the amount of $2,332.00. ROLL CALL VOTE: .".11 Councilmen voted YES .MOTION CARRIED It was moved by Craig, seconded by Hitchcock, to authorize a $115.00 credit for each single 3/4" line service or $230 per double service installed for Hill crest Trace and $Z70 credit for each single 3/4" line service installed for Hillcrest East and College Green North subdivision. ROLL CALL VOTE: A11 Councilmen voted YES MOTION CARRIED It was moved by Craig, seconded by Lea, to establish a Right of Way Review Committee to function in reviewing right-of-way negotiations in the City. MOTION CARRIED Public Safety Committee - Chairman Lewis Hitchcock It was moved by Hitchcock, seconded by Flechsig, to authorize the Mayor to sign agreement with CETA for 5 jailers and 1 Senior Resource Developer. ROLL CALL VOTE: A11 Councilmen voted YES MOTION CARRIED Finance Committee - Chairman Al Flechsig It was moved by Flechsig, seconded- by Craig, that accounts payable on checks 398 through 564 in the amount of $387,909.30 and payroll on checks 446 through 713 in the amount of $156,980.34. ROLL CALL VOTE: A11 Councilme; voted YES MOTION CARRIED OLD BUSINESS The request of the Landon Development Company for approval of a preliminary plat to be known as "Sunrise Addition" on a parcel of land 40 acres in .size located on the west hill northeasterly of 58th Avenue So. (Application P-11-78) was again brought before the council. Mayor Kersey read the Letter from State Representative Frank Warnke to Ruby Chow, Chairwoman, King County Council District No. 5, presented to the council by Colleen Moen during the Audience Participation portion of the meeting. The City Clerk read into the record a letter from Robert D. Scholes, SEA Engineers/ Planners, asking the Council to vote favorably on the request. Hitchcock stated that the letter from SEA appears to indicate that King County is going to get something going on the roads. Flechsig said the way he understood the Letter there was no problem as far as traffic was concerned. He added that he felt the County was looking for the Council to approve the plat so they can then start building the roads after development is started.' He stated he voted against the rezone and if the Council decided to approve the plat, it would be his recommendation to require a bond. Lea stated that it appeared to him that there was no other way to provide a road. He felt confident that with the stipulations of Transpa the problems could be resolved through a bond. He added that the reference to 15,000 square foot_ Zots mentioned in Representative Warnke's letter was not the issue. If all the criteria of the City of Auburn has been met then he felt the council had no choice in the matter. Craig questioned if the request could be approved subject to those improvements. Roegner called the council's attention to the paragraph in SEA's letter regarding fire protection. He stated Lhat 10-12 minutes for response time is not acceptable. He added that public safety .,'s a problem and approval of the request would further inhibit it. It was moved by Craig, seconded by Flechsig, to approve the request of Landon Development Company for approval of a preliminary plat to be known as Sunrise Addition (Application P-11-78) with the stipulation that the ordinance includes the improvements for safety on 58th South as specified in the Transpo letter of February 15, 1979, and that a bond be posted to cover improvements. ROLL CALL VOTE: Councilmen Craig, Hitchcock, Flechsig, Lea and Kitchell voted YES Councilman Roegner voted NO MOTION CARRIED -6- AUBURN, WASHINGTON TUESDAY FEBRUARY 20, 1979 Peter Buck asked if the Council would reconsider the motion because he felt it would put the developer irr a difficult position in having to wait for King County to make the improvements. He submitted an amendment to the motion which read, "prior to final plat approval the applicant shall provide a band for 5 years, sufficient for King County to accomplish the improvements listed in the third fu1Z paragraph of the Transpo Group letter to King County dated February 15, 1979. It was moved by Craig, seconded by Flechsig, to amend the motion as outlined by Mr. Buck. KERSEY, TO APPLY FOR BLCJC``. URANT FUNDING TO KING COUNTY FOR THE PROJECTS AND FUNDS AND BASED UPON THE PRTORTTIES HEREINAFTER SET FORTH," be adopted. The Council discussed several possible directions in funding priorities for the block grant funds. It was suggested changing alley paving to pedestrian crossing would ^ reflect the majority of the Councils wishes. Roegner amended his motion to .include changing alley paving to pedestrian crossing.
