Di.stri.ct to .~,~~scss the cost and expense thereof against the properties specially
benefited thareby.
G. A. GJyrlinger, 2015 "M" Street S.E., spoke in favor of formation of the L.I.D.

2. Mayor. .Yersc.}3 d~:elared the public hearing open on the request of Charles White/
Wa~stern Was?-~.sngton Corp. of Seventh Day Adventists to rezone from M-2 (Heavy
Industz•ia1) t.a R-4 (Multi-Family) with a Conditional Use Permit on the west one-
half of the rite to construct a new church. The parcel of land is approximately
1l1 acres .i.n :size located at the southeast corner of 29th and '°D" Streets S.E.
(Application 29-79) The Planning Commission recommends approval of this request
because .it ia> a downzoning of the property and the proposed uses will be compatible
with ex.ist_in~J anal proposed development in the area. The following conditions
should be ~incor_porated into the permit: (1) The requirements of the Public
Worker Department as outlined in their memo of June 15, 1979, shall be conformed
to. (2) Th~~ westerly driveway on 29th Street as shown on the site plat should
.be relocated to the east or eliminated to remove the hazard at the intersection
of .?.9th and "D" Streets. (3) The site plan and exterior elevations shall be

he wanted to be sure the petitioner was aware a building permit could not be
issued until floe moritorium is lifted. Mr. .iRupert stated there was a way L.hey

It was moved by Larson, seconded by FZechsig, to approve the request of Charles

R-4 with a C~~nditional Use Permit., that the Planning Commission and George
SchzzZer's recommendation far a one year time period on the Conditional Use
Permit bE concurred with and that the City Attorney be instructed to draw up
the necessary ordinance.

3. Mayor Kersey declared the public hearing open on the request of Puget Sound Power &
Light= Camparly and MIGA Associates t;o rezone from Unclassified to M-l (T,ight Industrial)
with a Condit.i.anal Use Permit to construct an electrical power substation on a
parcel °~f land 63.47 acres in size Lying between 29th and 37th St. N.W.. and between
thx= i.~allet~ .Freeway and the Milwaukee Railroad right-of-way. (Application 30-79)
TPze Planning Carnmissiozl recommends approval of this request and that the following
items become a part of the permit along with the compromise of Item No. 4 regarding
the frontage rand, with the final plan being approved by the Public Works Department:
(1) That t11e electrical substation site on the northerly portion of the property
as spawn on the site plan submitted with the application and designated as Christopher
Substation site plan dated June, 1979, be restricted to the approximate location
as shown on the plans. On the '.improvements o.f the southerly portion of the property
lying south of the Bonneville Power, Line Easemera shall be subject to the approval of
the Auburn Planning and Public Works Departments. (2) That M3I1 Creek which now runs
through the proposed site be reconstructed and maintained in its present location
or relocated along the westerly and southerly boundaries of the site. The final
locatiarz and design shall be subject to the approval of the City of Auburn Public
Works Department and any other governmental agency having jurisdiction. (3) That
rzn easement be granted to the City of Auburn along Mill Creek in its present or
rcay.Zocated aligrzmerzt for maintenance pruposes. Said easement to be of sufficient
width and location to provide access for mechanical equipment utilized in maintaining
Mi.Z1 Creek. (4) That the frontage road existing along the west boundary of the
site AKA °'M" St. N.W. be continued north and easterly to a connection with 37th
st. N.W. The final location of its intersection with 37th St. N.W. to be mutually
agreed upon by Puget Power and the Auburn Public Works Department. (5) That the
owners agree to participate in their pro-rata share of any Local Imp.r•ovement: District
initiated by the City or property owners in the vicinity for the construction or
installation of all public improvements, including but not limited,to water mains
and .fire hydrants, sanitary sewers, street .improvements, etc. (6} That the site
plan designated as Christopher Substation site plan dated June, 1979, be attached
to and become a part of the permit.
Diclt Causey, Puget Power, was in the audience to answer any questions. No one else
spoke for or against the request.

F1e~cXas.ig asked for further information on the frontage road referred to in the
Planning Commission recommendations. Push Patel, Puget Power, described a road
wi.11 be constructed to connect 29th and 37th Street N.W. with final alignment
subject to mutual agreement by Puget Power and the Auburn Public Works Department.
Craig asked the size of the substation. Patel reported it would be approximately
60U by 40U feet. He added there is a major substation an Renton and one in the
White River area and they feel there is a need for an a1 ternate source of power
in between.
Craig expressed concern in the restoration of Mi11 Creek and if having natural

habitat would interfere with proposal. Patel stated they had no interest in
covering tho creek or .lining it with concrete and would be working with the Public
Works Department on the matter.

Railro,acd rl:ylrt-of-w~:~y. (Application 33-79) The Planning Commission recommends
approval vt'i.his request because it is an allowable use within the M-1 zoning
classi.fi.catic~.ri. It has goad access from the major traffic streets in the area
and has a.l_.t public utilities available and will not be detrimental to existing and
pzoposcd uses pla.nrred for the area. Consideration should be given to any require-
ments. o.f t:1-re d'.ire and Public Works Departments.

Flechsig stated he was concerned about regulation of traffic on "M" Street.
Wagnor repli.~d there would most Likely be a traffic light installed or possibly
anothex• route, The situation will most definitely be looked into.
Craig worrde:~red.whether George Schuler's recommendations should be put into the
ord.inanc°~, He also felt a traffic study should be required before a permit is
issued.
Fi_itchcock stated he felt i•'ire Marshal Gintz's letter should also be listed as
a cond.i t_zon of the Conditional IJse Permit.. •
Flechsiy aslcF~d Jack Bereit~pr if the six items recommended by George Schuler should
be made: a paxt of the Conditional Use Permit. Bereiter stated he agreed with
C.rai.g on the .reduraancy since these items were covered by existing ordinances.
He felt, however, that Items 2 and 6 should be incorporated into the ordinance.
FIeChS1g wondared if the time limit of a year was appropriate in this case. Larson
stated one ye,~r was customary and he believed it was a fair time limit:
Hitchcock asked Wagnor if he was agreeable to a one year time Zimit on the Conditional
Use Permit. Wagnor replied Tess than a year would be difficult to work wi th.
It was moved by Craig, seconded by Hitchcock, that the request of Le Hippodrome
Corp., fora Conditional Use Permit (Application 33-79) be approved, the Planning
Commission an~a Items ?and 6 of George Schuler's July 18, 1979, memo be concurred
with, that a one yeaz° time Limit be put on the Conditional Use Pez;mit and the City
Attorney be iz°~str•urted to draw up the necessary ordinance.

5. Mayor Kersey declared the public hearing open on the request of Cal Scarff to vacate
street right:-•of-way s$tuated an a portion of "B" Street N.E, together with the
a1.1ey lying between "A" and "B" Streets N.E, lying north of 7th Street N.E. within
the corporate 1irn.its of the City of Auburn.
Cal Scarff was in the audience to answer any questions. No one else spoke for
or against the request.
Zt was moved by Larson, seconded by Craig, that the public hearing be closed.

Hitchcock sf~ated he had looked the area over and felt the street should not be
vacated because of a confusing traffic pattern.
Craig questioned Scarff as to whether the alley was to be included or not. Scarff
stated in the original request the a11ey was overlooked. He said he was interested
i.n develap.insg the area at some time in the future and traffic flow into the business
was an important consideration. He added he wanted to know if the street and a11ey
could be vacated or if they would have to work around it. After discussion with
the Street Canunittee, Mr. Scarff said it was apparent "B" Street would need to
be around fo.z• awhile, however, it was suggested the a11ey be included in the same
request because it was tPie same piece of property.
It was moved by Iitchcock, seconded by Craig to vacate the alley on "A" and "B"
Streets N.E. noz•th of 7th Street N.E. and the City Attorney instructed to draw
up the necesc>ary ordinance.

Lea stated at: the Street Committee meetings with the petition he seemed agreeable
with the Committee's feelings to withdraw the request for the street vacation for
"B" Street N.E. bemuse it could bottle up future development of streets in the
area. He urged the Council to deny the request.

right-of-way on a portion of '°B" Street N.E. Zying north of 7th Street N.E.

1. Letter from Kenneth F. Ingalls, attorney representing a group of residents,
expressing concerns over construction of a multi-unit residential structure
on "I" Street N.E.
Craig asked Jack Bereiter if the City could be sued by those who oppose the
project, Bereiter stated the matter had been through litigation when the
permit. was originally requested and the Judge had ruled it was a legal use.
2. Petition for vacation of street right-of-way by two-thirds or mare of the
real pz•operty owners abutting that portion of Howard Road located between
realigned How~~rd Road and State Highway 164 and northerly of 24th Street S.E.
