Lewis called the meeting to order at 7:30 PM in the Council Chambers at Auburn City Hall and led those in attendance in the Pledge of Allegiance. B. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Jeanne Barber, Trish Borden, Fred Poe, Sue Singer, Stacey Brothers and Gene Cerino. Staff members present included: Finance Director Shelley Coleman, City Attorney Daniel B. Held, Public Works Director Christine Engler, Community Development Administrator David Osaki, Employee Relations and Compensation Manager John Fletcher, Fire Chief Bob Johnson, Police Chief Jim Kelly, Planning and Community Development Director Paul Krauss, Parks and Recreation Director Daryl Faber, and Deputy City Clerk Cathy Richardson. C. Announcements and Appointments 1. Announcements a) Re.qional Enterprise Center Ms. Leslie Moore and Mr. Kip Herren gave a brief presentation on the progress of the Regional Enterprise Center. Ms. Moore explained that the Auburn Area Chamber of Commerce and the Green River Community College have collaborated to create a Regional Enterprise Center to provide education, economic development, and community and business resource services to the Auburn community. The center also provides a Visitor Information Center, Business Information Library, community meeting facility, and adult education. Mr. Herren and Ms. Moore reviewed various services offered by the Chamber of Commerce and the Small Business Assistance Center, including one-on-one counseling, career conferences, educational and intern opportunities, leadership programs, and small business development classes and seminars. On behalf of the Regional Enterprise Center, Mr. Herren and Ms. Moore thanked the Mayor and Councilmembers for the support, vision, resources, guidance, and leadership provided by the City of Auburn. D. Agenda Modifications Agenda modifications included a corrected Ordinance No. 5664 transmitted under Item VII.A.5 of these minutes. II. CITIZEN INPUT, PUBLIC HEARINGS & CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Closed Record Hearings The following is a closed record hearing where testimony will be limited to those persons of record who gave public testimony during the Hearing Examiner's hearing. Further, any public testimony must be strictly limited to the issues involving the proposal and must also be limited to comments "on the record". No new or additional evidence may be allowed. Application Number HAP02-0001 A3.23.1 City Council conducted a closed record hearing on an appeal filed by Puget Sound Energy on the Hearing Examiner's decision to affirm the Planning Director's decision that outdoor lighting poles on private property be considered a structure and must meet setback and height requirements. Community Development Administrator David Osaki reviewed the appeal filed by Puget Sound Energy regarding outdoor light poles on privately owned property. The Hearing Examiner decision determined that privately owned light poles on private property fall within the scope of the zoning code and are not specifically exempted from set-back or height restrictions of the zoning code. Based on the Hearing Examiner's decision, staff recommends denying the appeal of Puget Sound Energy. Mayor Lewis opened the closed record hearing. Mary Ausburn, Puget Sound Enerqy (PSE), 6905 South 228th Street, Kent, WA Ms. Ausburn displayed a photograph of the Huttig Building Products service yard. PSE planned to replace three light standards located within the interior of the service yard by relocating them to the perimeter of the service yard for safety purposes. Ms. Ausburn referred to overhead displays of various locations within the City of Auburn containing light standards with similar placement and height proposed by PSE, including Emerald Downs Thoroughbred Racetrack and the SuperMall. Shed Clarke, Puget Sound Energy, 10608 NE 4th Street, Bellevue, WA Ms. Clarke stated that she is an Account Manager for the Street Lighting Department for PSE. Ms. Clarke stated that the proposed floodlights are directional, would be on the perimeter of the property facing into the service yard, and could have shields installed to prevent back lighting. View Drive, Auburn, WA Mr. Seth stated that the types of engineered wood products produced by Huttig Building Products require a wide, open area for the service yard. The service yard also requires appropriate lighting with regard to safety concerns related to night work. The service yard is currently fenced and includes tall evergreens for concealment along the perimeter. No one else requested to speak. Mayor Lewis closed the closed record hearing. Councilmember Poe moved and Councilmember Singer seconded to overturn the Hearing Examiner's decision that a light pole on private property is a structure. Director Krauss clarified that an overruling of the Hearing Examiner's decision and interpretation could imply that height restrictions on light poles in any zone do not exist. Director Krauss urged Council to direct staff to develop standards that are appropriate to lighting poles to eliminate potential problems in the future. Councilmember Poe revised his motion with Councilmember Singer's concurrence to overturn the Hearing Examiner's decision that a light pole on private property is a structure, direct staff that lighting poles in an M-2 zone shall not be considered structures, and to refer the development of amendments to the zoning code related to lighting pole standards in all zones to the Planning and Community Development Committee. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Virginia Hau.qen, 2503 "R" Street SE, Auburn, WA Ms. Haugen questioned how her water rates would be affected by the passage of Ordinance No. 5664. Public Works Director Engler responded that the only rate being changed under Ordinance No. 5664 is the wholesale rate to Covington Water District and Water District 111. Water rates affecting residential accounts were approved by Council earlier this year and include conservation incentives. Joann Fonda, 12'10 - 20~ Court SE, Auburn, WA Ms. Fonda thanked the Mayor and Councilmembers for their efforts related to amendments to the C-1 zoning code changes. D. Correspondence No correspondence was received. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Singer reported that the Municipal Services Committee met this evening at 5:00 PM. The Committee discussed Resolution Nos. 3468, 3469, and 3470. The Committee received reports from Harborview Director of Community Relations Tina Mankowski on Harborview services and from Chief Johnson on basic life support services. The next regular meeting of the Municipal Services Committee is scheduled for June 3, 2002 at 5:00 PM. B. Plannin.q & Community Development Chair Borden reported that the Planning and Community Development Committee met on May 13, 2002. The Committee discussed zoning code amendments for the C-1 district and received a presentation from Tom Holz with the City of Tumwater on zero effect drainage discharge developments. The next regular meeting of the Planning and Community Development Committee is scheduled for May 28, 2002 at 5:00 PM. Page 5 City of Auburn Council Meeting Minutes May 20,200'~ C. Public Works Chair Wagner reported that the Public Works Committee met on May 13, 2002. The Committee reviewed a Right-of-way Use Permit for Clean Sweep, contract administration items, and Ordinance No. 5664. The Committee received an update on groundwater management and the Arterial Streets 102 Budget. The next regular meeting of the Public Works Committee is scheduled for May 28, 2002 at 5:30 PM. D. Finance Chair Poe reported that the Finance Committee met this evening at 6:30 PM. The Committee discussed consent items, Resolution No. 3466, and Resolution No. 3470. The Committee also received a quarterly report on tax revenue, and received reports on Microsoft licensing program and the development of a water leakage adjustment policy and procedure. The next regular meeting of the Finance Committee is scheduled for June 3, 2002 at 6:30 PM at Auburn Riverside High School. IV. CONSENT AGENDA A. Minutes 1. Application Number ZOA01-0006 Amendments to Chapter 18.26, C-1 Light Commercial District 03.4.2.1.2 ZOA01-0006 City Council to confirm proposed amendments to Chapter 18.26, the C-1 Light Commercial Zoning District of the Auburn Zoning Code. Councilmember Borden moved and Councilmember Singer seconded to take from the table the motion to approve the recommendations of the Planning Commission and instruct the City Attorney to prepare the necessary ordinance. MOTION CARRIED UNANIMOUSLY. 7-0. Councilmember Borden moved and Councilmember Singer seconded to approve proposed amendments to Chapter 18.26, the C-1 Light Commercial zone as presented to the City Council on May 6, 2002, and including the additional amendments to Auburn City Code Section 18.26.020(JJ), as recommended by the Planning and Community Development Committee on May 13, 2002, and instruct the City Attorney to prepare the necessary ordinance. NEW BUSINESS There was no item under this section for City Council review. VII. ORDINANCES AND RESOLUTIONS A. Ordinances 1. Ordinance No. 5660 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code Chapter 10.36 entitled "Stopping, Standing and Parking" by revising Sections 10.36.300 entitled "Prohibited Parking Areas - Northwest Auburn" and Section 10.36.380 entitled "One Hour Parking Zones" to prohibit parking on the north side of Main Street between "C" and "D" Streets. Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5660. MOTION CARRIED UNANIMOUSLY. 7-0. 2. Ordinance No. 5661 An Ordinance of the City Council of the City of Auburn, Washington, (hereafter referred to as the City) authorizing the Mayor and City Clerk to execute a temporary extension of the electrical franchise with Puget Sound Energy (hereafter referred to as PSE). Councilmember Wagner moved and Councilmember Cerino seconded to introduce and adopt Ordinance No. 5661. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Ordinance No. 5662 O3.10.1 CUP 02-0001 An Ordinance of the City Council of the City of Auburn, Washington, authorizing a conditional use permit to the Church of the Nazarene to allow the church to expand their services to an adjacent building located at 1235 29th Street SE. Ordinance No. 5663 03.8 REZ02-0001 An Ordinance of the City Council of the City of Auburn, Washington, authorizing the rezone of property located at the southeast corner of South 277th Street and "1" Street NE from P1, Public Use and R-2, Single Family to R-3, Duplex and R-4, Multi Family. Councilmember Borden moved and Councilmember Singer seconded to introduce and adopt Ordinance No. 5663. MOTION CARRIED UNANIMOUSLY. 7-0. 5. Ordinance No. 5664 An Ordinance of the City Council of the City of Auburn, Washington, amending Auburn City Code 13.06.360 pertaining to Auburn water rates. Councilmember Wagner moved and Councilmember Poe seconded to introduce and adopt Ordinance No. 5664. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 3466 A4.6 A Resolution of the City Council of the City of Auburn approving the Collective Bargaining Agreement between the City of Auburn and the Non-commissioned Police Unit, International Association of Machinists and Aerospace Workers District Lodge No. 160, for 2002-2004. Resolution No. 3467 A4.6.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing issuance of a construction permit and authorizing the Mayor to enter into a Temporary Use Agreement with Bruce D. Alverson and Jill B. Alverson to make improvements to certain parking areas within the city. Councilmember Wagner moved and Councilmember Cerino seconded to adopt Resolution No. 3467. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 3468 F4.6.1 A Resolution of the City Council of the City of Auburn, Washington, authorizing the donation of certain City of Auburn Fire Department equipment that has been declared surplus to Fire District No. 5 in Napavine, Washington. Councilmember Singer moved and Councilmember Wagner seconded to adopt Resolution No. 3468. MOTION CARRIED UNANIMOUSLY. 7-0. 4. Resolution No. 3469 03.3.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute a Lease Agreement between the City of Auburn and the Central Puget Sound Regional Transit Authority (Sound Transit).
