AN ORDINANCE OF THE CITY OF AUBURN, RELATING TO AND PROVIDING FOR THE VACATION
OF A PORTION OF ALLEY RIGHT-OF-WAY SITUATE WITHIN THE CORPORATE
LIMITS OF THE CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn have pass(~d and adopted
Resolution No. 642, resolving that a public heari.ng .~hall be had for the purpose
of determining whether or not the hereinafter described alley right-of-way situate
between 3rd and 5th Streets on the?Eas~.,si.de of..~ Street Northeast. lying within
the corporate limits of the City of Auburn,. shall be'vacated, said portion to be
vacated being hereinafter legally described in Section 1 bf this Ordinance; and,
WHEREAS, notice of publi, c~hearing to.vacate the portion of a certain alley
right-of-way between 3rd and 5th Streets. on.ihe East side of B Street Northeast,
lying within the corporate limits of the City of Auburn, in the time and manner
provided by law, giving notice that the hearing on ~aid Resolution No.642 was to
be held on the 19th day of August, 1974~ at 8:00 'P.M. in the Council Chambers ~
of the City Hall of the City of Auburn, and no objections thereto were filed with
the City Clerk or presented to the City Council at said hearing; and,
WHEREAS, the City Council, ~aving' de6med that the petition for vacation
was proper and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the following described portion of a certain alley right-
of-way situate between 3rd an~ 6th Streets on the East side of B Street Northeast,
lying within the corporate 1.imits Of the City of Auburn, and more particularly
described as follows:
Beginning at the S.W, corner of Lot l, Block 6, New
Auburn Addition to the City of Auburn as recorded in
Volume 44 of Plats, pages 8 and 9; thence East to the
SE corner or.Said Lot !, thence southerly to the NE
corner of Lot l, BTock 3, Meadow Addition to the City
of Auburn, as recorded in Volume 18 of Plats, page 68;
thence West,to~.the NW,corner,of-.saidFLot~l;~then~NOPth·
to the point of beginning. Said property located in
the NW 1/4 of Section 18, Township 21 North, Range 5,
E., W.M , City of Auburn, County of King, State of
Washington.

Be and the same is hereby vacated, and the property lying in said portion of a
certain alley right-of-way described hereinabove, shall be returned and belong
to the abutting property owners, EDWARD EARL BARNHART and KEARMEY J. HEINRICH,
of said portion of a certain alley ~ight~of-way situate between 3rd and 5th Streets
oh the East side of B Street Northeast, lying within the corporate limits of the
City of Auburn.
Section 2. That an easement for public utilities be retained for ingress
and egress for the purpose of laying, maintaining and repairing all public
utilities ~ ~
Section 3. Upon the passage, approval and publication of t~§' q~din~n~,~
the City Clerk shall cause a certified copy of this Ordinance~c~o ~e"reco'~d~d 'i~ ''
the office of the King County Auditor.
Section 4. That this Ordinance shall take effect five (5) days from and
after its passage, approval and publication, as provided by law.
