~ AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF LJ
A PARCEL OF LAND LOCATED ON THE NORTHEAST CORNER OF 9TH AND "F°
; STREETS SOUTHEAST, SITUATE WITHIN THE CITY OF AUBURN, WASHINGTON,
CHANGING THE ZONING CLASSIFICATION THEREOF FROM R-3 TO A CONDITIONALC ~

WHEREAS, a petition dated March 1, 1976, together with plot plans and
w exterior elevations therefor has been submitted to the Council of the City af
~j Auburn, by CLIFFORD C. and DONNA M. WESTBY, requesting the rezoning of the real ~

" property hereinafter described in Section 1 of this Ordinance, which would allow
for the construction of business and professional offices on a parcel of land

located on the Northeast corner of 9th and "F" Streets Southeast, within the

City of Auburn and which property presently carries an R-3 (Duplex) classification;
and
WHEREAS, said request above referred to was referred by the City Council
to the City Planning Commission for study and public hearing thereon; and
WHEREAS, the Planning Commission held a public hearing to consider the
request in the City Hall of the City of Auburn, at 7:30 P.M. on April 6, 1976,
at the conclusion of which the Commission determined that the most proper land
use classification for the subject property should be a Conditional Use Permit
rather than C-1 (Light Commercial), as requested by the petition filed as here-
inabove stated and recommended the approval thereof, finding that the prnposed
use illustrated by the site development plans of the petitioner would not be
unduly detrimental to the adjacent and surrounding properties and the enjoyment
thereof; and
WHEREAS, the City Council of the City of Auburn held a public hearing to
consider said petition in the City Hall of the City of Auburn at 8:00 P.M. on
May 3, 1976, at the conclusion of which the City Council concurred with the
recomendations of the Planning Commission as hereinabove stated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO f
ORDAIN AS FOLLOWS:

Section 1. That a Conditional Use Permit be granted for the purpose of
constructing business and professional offices on the following described property,
to-wit:
Lots 29 and 30, Block 2, Walnut Lawn Addition, per plat
recorded in Uolume 21 of Plats, on page 40, records of
~ King County, Washington. Situate in the City of Auburn,
~LO.. County of King, State of Washington.

~ attached hereto, designated Exhibit "A" and by this reference made a part hereof
as though set forth in full herein.
Section 2. That prior to any change in use for business and professional
office purposes, a site development plan be prepared and submitted to the Planning
Department for approval. Said site development plan shall include, but not be
limited to, location of off-street parking, landscaping, screen fencing and ingress
and egress.
Section 3. That the plot plans and exterior elevations be attached to
and become a part of the permit.
Section 4. That the City Clerk of the City of Auburn is hereby authorized
and directed to file a certified copy of this Ordinance with the King County
Auditor's Office.
Section 5. That this Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
