HomeMy WebLinkAbout3207ORDINANCE NO. 3 2 0 7 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF ALLEY RIGHT-OF-WAY, SITUATED SOUTH OF 1ST STREET S.W. BETWEEN "A" AND "B" STREET S.W., SITUATE WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN. WHEREAS, the City Council of the City of Auburn, have passed and adopted Reolution No. 819, resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described alley right-of-wa.v located south of 1st Street S.W. between "A" and "B" Street S.W., within the corporate limits of the City of Auburn, shall be vacated, said portion to be vacated being hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain alley right-of-way located south of 1st Street S.W. between "A" and "B" Street S.W~ lying within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 819 was held on the 6th day of September, 1977, and continued to September 19, 1977, at 8:00 P.M. in the temporary Council Chambers at the Auburn School District Adminis- tration Building in the City Of Auburn, Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEREAS, the City Council, having deem that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portion of a certain alley right-of- way located south of 1st Street S.W. between "A" and "B" Street S.W., within the corporate limits of the City of Auburn, Washington, and more particularly described as follows: That portion of Block 4, Town of Slaughter as recorded in Vol 2, of Plats, page 56, records of King County, Wash., described as follows: Ordinance No. 3207 Page One 9-26-77 Beginningi~t the SE corner Lot l; thence West to the SW corner of Lot 2; thence South to the NW corner of Lot 5; thence East tO the NE corner of Lot 6; thence North to the point of beginning. be and the same is hereby vacated, and the property lying in said portion of a certain alley right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain alley right-of-way located south of 1st Street S.W~ between "A" and "B" Street S.W., lying.within the corporate limits of the City of Auburn. Section 2. That the request for vacation of alley right-of-way be granted subject to a public utility easement over, across, upon and underneath the entire vacated alley for ingress and egress for the purpose of installing and maintaining all public utilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 4. That this Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
