ORDINANCE NO. 3 2 1 7

AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING
FOR THE VACATION OF ALLEY RIGHT -OF-WAY, SITUATE EAST OF "B" STREET
N.E., IN THE 300 BLOCK, SITUATE WITHIN THE CORPORATE LIMITS OF THE
CITY OF AUBURN, WASHINGTON.

WHEREAS, the City Council of the City of Auburn, have passed and adopted
-. Resolution No. 829, resolving that a public hearing shall be had for the purpose

of determining whether or not the hereinafter described alley right-of-way located

east of "B" Street N.E., in the 300 Block, within the corporate limits of the City

of Auburn, shall be vacated, said portion to be vacated being hereinafter legally
described in Section 1 of this Ordinance; and
WHEREAS, notice of public hearing to vacate the portion of a certain alley
right-of-way located east of "B" Street N.E. in the 300 Block, lying within the
corporate limits of the City of Auburn, in the time and manner provided by law,
giving notice that the hearing on said Resolution No. 829 was held on the 17th day
of October, 1977, at 8:00 P.M. in the temporary Council Chambers at the Auburn
School District Administration Building in the City of Auburn, Washington, no
objections thereto were filed with the City Clerk or presented to the City Council
at said hearing; and
WHEREAS, the City Council, having deemed that the petition for vacation was
proper and that no vested rights would be affected by the same;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the following described portion of a certain alley right-of-way
located east of "B" Street N.E. in the 300 Block, within the corporate limits of the
City of Auburn, Washington, and more particularly described as follows:
Beginning at the Northwest corner of Lot 1, Block 2,
Meadow Addition as recorded in Volume 18 of Plats,
page 68; thence East along the North line of said
Lot 1 94.15 feet; thence North to the Southeast
corner of Lot 8, Block 1, New Auburn Addition as
recorded in Volume 44, pages 8 & 9; thence West
along the South line of said Lot 8 to the Southwest
corner thereof; thence South to the point of beginning,
situate in the City of Auburn, County of King, State
of Washi ngton.

be and the same is hereby vacated, and the property lying in said portion of a
certain alley right-of-way described hereinabove, shall be returned and belong
to the abutting property owners, of said portion of a certain alley right-of-way
located east of "B" Street N.E. in the 300 Block, lying within the corporate 1 imits
of the City of Auburn.
Section 2. That the request for vacation of alley right-of-way be granted
subject to a public utility easement over, across, upon and underneath the entire
vacated alley for ingress and egress for the purpose of installing and maintaining
all public utilities.
Section 3. Upon the passage, approval and publication of this Ordinance,
the City Clerk shall cause a certified copy of this Ordinance to be recorded in
the office of the King County Auditor.
Section 4. That this Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.
