ORDINANCE NO. 3 4 2 4 -, , AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF A PARCEL OF LAND 63.47 ACRES IN SIZE LYING BETWEEN 29TH AND 37TH STREET N.W. AND BETWEEN THE VALLEY FREEWAY AND THE MILWAUKEE RAILROAD RIGHT-OF- WAY, SITUATE WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED TO M-l WITH A CONDITIONAL USE PERMIT . WHEREAS, a petition dated June 4, 1979, together with plot plans and exterior elevations therefor has been submitted to the Council of the City of Auburn, by PUGET POWER and MIGA ASSOCIATES, requesting an M-l with a Conditional , Use Permit which would allow for the construction of an electrical power sub- ._J station on a parcel of land 63.47 acres in size lying between 29th and 37th Street N.W. and between the Valley Freeway and the Milwaukee Railroad right-of- way, within the City of Auburn, Washington, which property hereinafter described in Section 1 of this Ordinance and which property presently carries an Un- classified classification; and WHEREAS, said request above referred to was referred by the City Council to the City Planning Commission for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider the request in the Council Chambers of the Auburn City Hall, at 7:30 p.m. on July 3, 1979, and subsequent thereto the City Planning Commission approved the issuance of the rezoning of Unclassified to M-l with a Conditional Use Permit, finding that the proposed use illustrated by the site development plans of the petitioners would not be unduly detrimental to the adjacent and surrounding properties and the enjoyment thereof; and WHEREAS, the City Council of the City of Auburn, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall at 8:00 p.m. on August 6, 1979, at the conclusion of which the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ------------------- Ordinance No. 3424 Page One 8-8-79 J ~ ... § .... I Section 1. That an M-l (Light Industrial) with a Conditional Use Permit be granted for the purpose of constructing an electrical power substation on a parcel of land 63.47 acres in size lying between 29th and 37th Street N.W. and between the Valley Freeway and the Milwaukee Railroad right-of-way, within the City of Auburn, and legally described as follows: Parcel "A": Tracts 3,4,5 & 6, Block 2, Christopher Garden Tracts according to Plat re- corded in Vol 23 of Plats, pg 6, in King County, WA. Parcel "B": Lots 9,10,11 and 12, Blk 2, Christopher Garden Tracts as recorded in Vol 23, pg 6 of Plats, records of King County, WA, situated in Section 1, Twp 21 N, R 4 EWM City of Auburn, County of King, State of WA. in accordance with the plot plans and exterior elevations for said development submitted with the request for an M-l with a Conditional Use Permit, a copy of which is attached hereto, designated as Exhibit "A" and by this reference made a part hereof as though set forth in full herein. Section 2. That the electrical substation site on the northerly portion of the property as shown on the site plan submitted with the application and designated as Christopher Substation site plan dated June, 1979, be restricted to the approximate location as shown on the plans the improvements on the southerly portion of the property lying south of the Bonneville Power Line Easement shall be subject to the approval of the Auburn Planning and Public Works Department. Section 3. That Mill Creek which now runs through the proposed site be reconstructed and maintained in its present location or relocated along the westerly and southerly boundaries of the site. The final location and design shall be subject to the approval of the City of Auburn Public Works Department and any other governmental agency having jurisdiction. Section 4. That an easement be granted to the City of Auburn along Mill Creek in its present or relocated alignment for maintenance purposes. Said easement to be of sufficient width and location to provide access for mechanical equipment utilized in maintaining Mill Creek. - -----....:-"'..-,;.,....,..__.;.,.._-~ Ordinance No. 3424 Page Two 8-8-79 " ,.I ,... 8 - .. I Section 5. That the frontage road or an alternate street be improved and extended northerly to provide a connection between 29th and 37th Street N.W. The final alignment of said street to be subject to approval of the Auburn Planning and Public Works Departments. Section 6. That the owners agree to participate in their pro-rata share of any Local Improvement District initiated by the City or property owners in the vicinity for the construction or installation of all public improvements. Including but not limited to water mains and fire hydrants, sanitary sewers, street improvements, etc. Section 7. That the site plan designated as Christopher Substation site plan dated June, 1979, be attached to and become a part of the permit. Section 8. The City Clerk of the City of Auburn is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. Section 9. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
