AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR
THE CONDEMNATION OF EASEMENTS ACROSS TRACTS OF LAND BY'THE CITY OF
AUBURN FOR SANITARY SEWER CONSTRUCTION PURPOSES LOCATED EAST OF S.R.
167, NORTH OF WEST MAIN STREET, WITHIN THE CITY OF AUBURN, WASHINGTON.
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. That in order to promote public health. and improve the
sanitary sewer facilities of the City of Auburn, it is necessary to acquire
ownership by the City of Auburn easements across tracts of land located within
the corporate limits of the City, and in order to acquire ownership of said
easements thereof by the City of Auburn, public condemnation proceedings shall
be immediately commenced on said land, described as follows:
A permanent easement across that portion of the fJW l/4 of the NW
1/4 of Sec 13, Twp 21 N, R 4 EWM, included within the limits of a
strip of land 20 ft Yn width the centerline of which is described
as follows:
Beginning at the intersection of the N line of sd NW 1/4 of the
NW 1/4 with. a line which is 130 ft westerly of and parallel with
the westerly margin of S.R. 167 as delineated on that certain
Washington State Highway Commission right-of-way drawing S.R. 167
MP 13.66 to MP 17.42, AUBURN: 17th St. S.W. to S. 285th St.,
sheets 5 and 6 of 30 sheets, bearing date of approval June 12,
1969 and revised Sept. 25, 1969; thence southerly along sd parallel
line to its intersection with the S line of the sd NW 1/4 of the
NW 1/4 and the terminus of said centerline description. TOGETHER
WITH a temporary construction easement 100 feet in width the center-
line of which. is the same as that described above.
A 10 foot permanent easement desc as the S 10 ft of the W 335 ft of
the NE 1/4 of the NW 1/4 of Sec 13, Twp 21 N, R 4, EWM;
TOGETHER WITH a 30 ft temporary construction easement desc as the S
30 ft of the tJ 355 ft of the NE 1/4 of the Nld 1/4 of said Sec 13;
AND ALSO a 10 foot permanent easement desc as the S 10 ft of por of
the NW 1/4 of the NW 1/4 of Sec 13, Twp 21 N, R 4 EIJM lying easterly
of the easterly margin of S.E. 167 as delineated on that certain
Washington State Highway Commission right-of-way drawing S.R. 167
MP 13.66 to MP 17.42, Auburn: 17th St. SW to S. 285th. St., sheets
5 and 6 of 30 sheets, bearing date of approval June 12, 1969 and
revised Sept. 25, 1969; TOGETHER WITH a 30 foot temporary construction
easement described as the S 30 ft of por of the NW 1/4 of the. NW 1/4
said Sec 13 lying easterly of the easterly margin of sd S.E. 167.

Section 2. That public condemnation proceedings shall be instituted
without delay by the City of Auburn to secure the ownership and possession of
said property hereinabove described for sanitary sewer construction purposes of
the City of Auburn.
Section 3. That the Mayor, City Clerk and City Attorney of the City of
Auburn are hereby authorized and directed to proceed without delay to file the
proper petition for the condemnation of said private property hereinabove described
on behalf of the City of Auburn.
Section 4. All applicable costs of acquiring these easements will be paid
for by property owners througli.a Local Improvement District.
Section 5. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.

going is a full, true and correct copy of Ordinance No. 3521 of the
ordinances of the City of Auburn, entitled
"AN ORDINANCE of the City of Auburn, Washington, relating to and providing
for the condemnation of easements across tracts of land by the City of
Auburn for sanitary sewer construction purposes located east of S.R. 167,
north of West Main Street within the City of Auburn, Washington
I certify that said Ordinance No. 3521 was duly passed by the
Council and approved by the Mayor of the said City of Auburn, on the 16th
day of June A.D., 19 80 .

provided by law in the Daily Globe News, a daily newspaper pub~shed in the
