HomeMy WebLinkAbout3524,, ~; _ ... .. d ~ ~ ~ 3, .. ~ ~ ORDINANCE N0. 3 5 2 4 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING `; FOR THE VACATIOPV OF ALLEY RIGHT-OF-WAY, SITUATED ON THAT PORTION -= OF LAND LYING BETWEEN 13TH AND 14TH STREET SOUTHEAST EAST OF "A" ~ STREET SOUTHEAST, AND SITUATED WITHIN THE CORPORATE LIMITS OF THE ..~ CITY OF AUBURN, WASHINGTON. _~ ~ WHEREAS, the City Council of the City of Auburn, Washington, have passed and adopted Resolution No. 1087, resolving that a public hearing shall be had 3' r.,, for the purpose of determining whether or not the hereinafter described alley a right-of-way located on that portion of land lying between 13th and 14th Street Southeast, east of "A" Street Southeast, within the corporate limits of the City --; of Auburn, shall be vacated, said portion to be vacated hereinafter legally ~, described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain alley right-of-way located on that portion of land lying between 13th. and 14th Street Southeast, east of "A" Street Southeast, within the corporate limits of .the City ~. of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 1087 was held on the 19th day of~Piay, 1980, at 8:00 P.M. in the Council Chambers of the Auburn City Hall, at which time, the~Auburn City P' Council referred this request for alley vacation to the Street Committee for study and recommendations thereon; and WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected 6y the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portion of a certain alley right-of- t way situated on that portion of land lying between 13th. and 14th Street Southeast, east of "A" Street Southeast, within the corporate limits of the City of Auburn, Washington, and more particularly described as follows: ------------------ Ordinance No. 3524 Page One 6-23-80 :. ~ . ._ Beginning at the northeast corner of Lot 1> Block 2, Terminal Park Addition, as recorded in Volume 21, page 17, records of King County, Washington; thence southerly 120.82 feet, following the east line of Lots 1, 2 and 3 of said Block 2 to the southeast corner of Lot 3 of said Block 2; thence easterly 16 feet to the southwest corner of Lot 4 of said Block 2; thence northerly 120.77 feet following the west line of said Lot 4 to the north- west corner of Lot 4; thence 16 feet westerly to the TPOB. be and the same is hereby vacated, and the property lying in said portion of a certain alley right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain alley right-of-way c~ located on that portion of land lying between 13th and 14th Street Southeast, east of "A" Street Southeast, lying within the corporate limits of the City of Auburn. ~ Section 2. The City of Auburn shall retain an easement over, underneath, upon~and across the entire vacated alley for ingress and egress for the purpose of laying, maintaining and installing all public improvements. Section 3. The vacated alley shall be used far parking lot purposes only at existing grade. No buildings or structures shall be constructed on the vacated alley. Section 4. The planting of trees or other vegetation in the vacated alley that would develop a root depth of more than four (4) feet shall not be permitted. Section 5. If it becomes necessary for the City of Auburn to, excavate within the vacated alley to repair the existing sanitary sewer, any paving or other amenities that are required to be removed to make said repairs shall be replaced and restored by the owners of record to whom the alley was vacated. Section 6. If gates are installed across the vacated alley a key shall be provided to the City of Auburn for emergency access. Section 7. If solid curb, fence or landscaping is installed across the ends of the alley restricting access to the easement specified in Section 2, the owners shall provide the City with an easement across their property to provide access to the existing sanitary sewer line. ------------------ Ordinance No. 3524 Page Two 6-23-80 r i ^ ,_z Section 8. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 9. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
