AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, REPEALING AUBURN CODIFIED CITY
ORDINANCE 5.52.060 (MERCHANT PATROLS AND PRIVATE DETECTIVES LICENSES -
APPLICATION INVESTIGATION - ISSUANCE - CONTENTS) AND ENA.CTTNG A NEW
AUBURN CODIFIED CITY ORDINANCE 5.52.060 PERTAINING TO SAID SUBJECT;
REPEALING AUBURN CODIFIED CITY ORDINANCE 5.52 (PERTAINING TO
MERCHANT PATROLMEN - POWER AND AUTHORITY); AND AMENDING AUBURN
CODIFIED CITY ORDINANCE 5.52.140 (PERTAINING TO MERCHANT PATROLMEN -
REPORTS TO POLICE).
THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS
FOLLOWS:
Section 1. Auburn Codified City Ordinance 5.52.060 (.pertaining to
Merchant Patrols and Private Detectives Licenses - Application Investigation -
Issuance - Contents) is herewith repealed.
Section 2. There is herewith created a new Auburn Codified City Ordinance
5.52.060, pertaining to Merchant Patrols and Private Detectives, which shall read
as follows:
"5.52.060 License - Application investigation - Issuance - Contents.
The city clerk before acting upon an application shall request the chief
of police to investigate the truth of the statements contained therein and any
other matters which might aid in whether or not the application shall be granted.
The applicant shall submit to fingerprinting and photographs by the Auburn Police
Department to aid in its background investigation. The chief of police shall,
within ten days after the date of the applicant's request, furnish a written report
to the city clerk containing the results of his investigation. The chief of police
shall determine the applicant's fitness by the following standards: The applicant's
prior criminal record, physical or mental fitness, addiction to narcotics or other
habit-forming drugs, satisfactory completion of required fingerprints, satisfactory
completion of all information required on the application, and type of discharge from
the armed forces. With. the exception of merchant patrol agency and detective agency
licenses, if the results of the investigation by the police department show the
subject applicant should be granted a license, the chief of police shall so certify
to the city clerk who shall then, issue the license upon the applicant's filing with

the city clerk two recent photographs of a size designated by the city clerk
and which, may easily be attached.to.the license to be issued, one which shall
be attached to the license to be issued and the other shall be filed in the
office of the city clerk with the application. The photographs shall be attached
to the'license so that it is not possible to remove same and substitute another
photograph without the probability of detection. The license, in addition to
displaying the photograph thereon, shall contain a name and residence address
of the licensee and shall bear the imprint of the seal of the city and the
thumbprint of the licensee. Every licensee so licensed shall upon demand of the
city clerk or any policeman of the city exhibit his license and photograph for
inspection. Every person employed as a merchant patrolman by a merchant patrol
agency or private detective by a detective agency pursuant to the terms of this
chapter must be individually licensed as provided hereinabove.
With reference to applicants for merchant patrol agency licenses and
detective agency licenses, if the results of the investigation by the police
department show the subject applicant should be granted such a license, the chief
of police shall so certify to the city clerk who shall then, with the approval of
the city licensing committee, issue the license upon the applicant's filing with
the city clerk two recent photographs of a size designated by the city clerk which
may easily be attached to the license(s) to be issued for each.employee of such
agency that will engage in merchant patrol or detective duties, one which shall
be attached to the individual licenses to be issued and the other shall be filed
in the office of the city clerk with the application(s). The photographs shall be
attached to the license(s) so that it is not possible to remove same and substitute
another photograph without the probability of detection. The license(s), in
addition to displaying the photograph thereon, shall contain a name(s) and residence
address(es) of the licensee(s) and shall bear the imprint of the seal of the city
and the thumbprint of the licensee(s). Every licensee(s) so licensed shall upon
demand of the city clerk or any policeman of the city exhibit his license and

Section 3. Auburn Codified City Ordinance 5.52.130 (-pertaining to
Merchant.patrolmen,- Power.and authority) is herewith repealed.
Section 4. Auburn Codified City Ordinance 5.52.140 (Merchant patrolmen -
Reports to police), which. reads as follows:
"Every merchant patrolman shall make a written report to the police

department of the city immediately after the conclusion of the daily hours of
work of such patrolman or sooner, if possible, upon forms to be furnished by
the police department, with any irregularities tending to show that a crime
has been committed or may be committed which such patrolman may have found
during the time of his immediately preceding work hours. In the event no such
irregularities have occurred, the merchant patrolman need not make such report."
is hereby amended to read as follows:
"5.52.140 Merchant patrolmen - Reports to police.
Every merchant patrolman shall, as soon as practical, after the
conclusion of the daily hours of work of such patrolman, report any irregularities
tending to show that a crime has been committed or may be committed which such
patrolman may have found during the time of his immediately preceding work hours."
Section 5. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.

going is a full, true and correct copy of Ordinance No. 3531 of the
ordinances of the City of Auburn, entitled "AN ORDINANCE
of the City of Auburn, Washington, repealing Auburn Codified City Ordinance
5.52.060 (Merchant patrols and private detectives licenses-application
investigation-issuance-contents) and enacting a new Auburn Codified City
Ordinance 5.52.060 pertainign to said subject; repealing Auburn Codified
City Ordinance 5.52.130 (pertaining to Merchant-Patrolmen-power and
authority); and amending Auburn Codified City Ordinance 5.52.140
(pertaining to merchant patrolmen - reports to Police).
I certify that said Ordinance No. 3531 was duly passed by the Council
and approved by the mayor of the said City of Auburn, on the 91- ay of
July A.D., 19 80.
I further certify that said Ordinance No. 3531 was published as provided
by law in the Daily Globe News, a daily newspaper published in the City of
Auburn, and of general circulation therein, on the 27th day of july
A.D., 19 80.
