AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE
ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 297,
WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE CON-
STRUCTION AND INSTALLATION OF UNDERGROUND POWER AND TELEPHONE IN THE
FIRST ALLEY SOUTH OF MAIN STREET BETWEEN AUBURN WAY SOUTH AND "A" STREET
SOUTHEAST, INSIDE THE CORPORATE LIMITS OF THE CITY OF AUBURN; AS PRO-
VIDED BY ORDINANCE NO. 3298, OF THE CITY OF AUBURN, AND LEVYING AND
ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS, PARCELS
OF LAND AND OTHER PROPERTY UPON SAID ROLL.
WHEREAS, the assessment roll levying the special assessments against the
properties located in the Local Improvement District No. 297 of the City of
Auburn, Washington, created under Ordinance No. 3298, has been filed with the
City Clerk of the City of Auburn, as provided by law; and
WHEREAS, notice of the time and place of hearing thereof and making
objections and protests to said roll was duly published at and for the time
and in the manner provided by law, fixing the time and place of hearing thereon
for the 6th day of October, 1980, at the hour of 8:00 P.M. in the Council Chambers
of the Auburn City Hall, Auburn, Washington, and further notice thereof was duly
mailed by the City Clerk to each property owner shown on said roll; and
WHEREAS, at the time and place fixed and'designated in said notice of
hearing was duly held, at which time the public hearing was continued until
October 20, 1980, at the hour of 8:00 P.M., in the Council Chambers of the Auburn
City Hall; and
WHEREAS, at the time and place fixed and designated for the continued public
hearing, said hearing was duly held, and no protests were filed at said hearing; and
WHEREAS, after the hearing was held the assessment roll was accepted as
presented and ordered confirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section 1. That there is hereby in all respects.approved and confirmed
the assessments and assessment roll in Local Improvement District No. 297, providing
for the construction and installation of underground power and telephone in the first
alley south of Main Street between Auburn Way South and "A" Street Southeast, inside
the corporate limits of the City of Auburn, according to plans prepared and on file
in the office of the City Engineer of the City of Auburn, for the benefit of the
following described property:

That portion of River View Add as recorded in Volume.
9 of Plats, page 90, records of King County, WA, des-
cribed as follows:
The East 24 feet of Lot 1, all Lots 2, 3, 4, 5, 6, 7,
8, and Lot 9, lessth.e West 50 feet thereof.
Section 2. That each of the lots and other property upon said assessment
roll is hereby declared to be especially benefited by said improvements in at
least the amount charged against the same, and that the assessment appearing
against each of the same is in proportion to the several assessments appearing
on said roll. That all of the property shall be assessed according to the lineal
frontage of the property abutting said property to be improved and shall be
assessed according to their proportionate share of the several assessments
appearing upon the said assessment roll and there is hereby levied and assessed
against such lots and other property appearing upon said roll, the amount finally
charged therein against the same; said amount, or any portion thereof, may be paid

at any time within thirty (30) days-from the date of the first publication of the
Notice of Collection of4said assessments'without penalty, interest or cost; there-
after the sum remaining unpaid, if any, may be paid in ten (10) equal annual
installments, with"interest on,the whole unpaid sum at the rate of seven and
one-half percent (7.5%) per annum.
Commencing with the first year after the last day, such assessments, or
any portion thereof, may be paid without penalty, interest or cost (30 days from
the date of the first publication of the Treasurer's Notice of Collection of
Assessments) and each year thereafter, one of said installments, together with
the interest due, shall be collected as provided by law and the Ordinances of
the City of Auburn, assessments or installments of assessments not paid when
due shall be delinquent and there shall be added to the same a penalty of five
percent (5%) of the amount of the overdue installment and interest, and such
penalty shall become a part of the lien upon the property assessed.

Section 3. All monies collected by the City Treasurer upon any of the
assessments levied, as authorized herein, shall be paid into "Local Improvement
District No. 297 Fund" created by Ordinance No. 3298, and shall be used only
for the purpose of redeeming warrants and/or bonds drawn upon or issued against
said fund.
Section 4. This Ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.

of the City of Auburn, a Municipal Corporation and Code City, situate in
the County of King, State of Washington, do hereby certify that the fore-
going is a full, true and correct copy of Ordinance No. 3557 of the
ordinances of the City of Auburn, entitled "AN ORDINANCE 77THE CITY OF
AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT
ROLL OF LOCAL IMPROVEMENT DISTRICT NO. 297, WHICH DISTRICT HAS BEEN CREATED
AND ESTABLISHED PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF UNDER-
GROUND POWER AND TELEPHONE IN THE FIRST ALLEY SOUTH OF MAIN STREET BETWEEN

I certify that said Ordinance No.3557 was duly passed by the Council
and approved by the Mayor of the said City of Auburn, on the Zothday of
October A.D., 19 80
I further certify that said Ordinance No. 3557 was published as provided
by law in the Daily Globe News, a daily newspaper published in the City of
Auburn, and of general circulation therein, on the 26th day of October
A.D., 1980
