HomeMy WebLinkAbout3568ORDINANCE NO. 3 5 6 8 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION AND INSTALLATION OF STREET IMPROVEMENTS AND WATER MAINS ON "C" STREET N.W. FROM A POINT 400 FEET NORTH OF 6TH STREET N.W. TO 15TH STREET N.W., WITHIN THE CITY OF AUBURN, WASHINGTON; CREATING AND 1 STABLISHING LOCAL IMPROVEMENT DISTRICT NO. 313; PROVIDING THE METHOD-OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR. WHEREAS, the City Council of the City of Auburn has heretofore duly passed and adopted Resolution No. 1125 resolving that a public hearing shall be held to determine whether a local improvement district should be created for the purpose of the construction and installation of street improvements and water mains on "C" Street N.W. from a point 400 feet north of 6th Street N.W. to 15th Street N.W., more particularly described hereinafter in Section 1 of this Ordinance, said pro- perty to be improved being situate within the corporate limits of the City of Auburn; and WHEREAS, notice of the time and place of said public hearing was duly given in the time and manner provided by law; and WHEREAS, a public hearing was held by the Auburn City Council Street Committee to consider the proposed improvement at the time and place fixed and designated in said notice; and WHEREAS, the City Engineer has caused an estimate to be made on the cost and expense of the proposed improvement and has certified said estimates to the City Council, together with.all papers and information in his possession touching the proposed improvements, a description of the boundaries of the district, a statement of what portion of the costs and expense of the improvements should be borne by the property within the proposed district, a statement in detail of any local improvement assessments outstanding and unpaid against the property in the proposed district, and a statement of the aggregate actual valuation of the real estate and the actual valuation of the improvements in the proposed district according to the valuation last placed upon it for the purpose of general taxation; --------------------- Ordinance No. 3568 Page One 11-25-80 WHEREAS, said estimates are accompanied by a diagram of the proposed improvements showing thereon the lots, tracts and parcels of land and other property which will be especially benefitted by the proposed improvements and the estimated amount of the cost and expense thereof to be borne by each lot, tract and parcel of land or other property; and WHEREAS, at the conclusion of the public hearing after considering all matters brought up therein and determining that the estimated costs to the property owners within the proposed assessment district will not exceed the limit established by the law, that all of the property located within the proposed assessment district will be especially benefitted, the City Council Street Committee elected to proceed with the proposed improvements; N041, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, '- t f DO ORDAIN AS FOLLOWS: { Section 1. That "C" Street N.W. from a point 400 feet north of 6th ,. Street N.W. to 15th Street N.W., inside the corporate limits of the City of Auburn, be improved by the construction and installation of street improvements and water mains, all in accordance with plans and specifications prepared by the City Engineer and filed with the City Clerk. Section 2. That there is hereby created and established a Local Improvement District to be designated Local Improvement District No. 313, which said district is described as follows: Section 13, Township 21 N, R 4 EWM described as follows: That portion of the N 1/2 of NE 1/4 said Sec 18, lying west of "C" St. N.W. and east of C.M. & St. P. Railroad right of way Less streets. Section 12, Twp 21 N, R 4 EWM. City of Auburn Short Plat No. SP-8-79 as recorded under King County Auditor's File No. 7904190888. City of Auburn Short Plat No. SP-4-77 as recorded under King County Auditor's File No. 7703250520. --------------------- Ordinance No. 3568 Page Two 11-25-80 Section 3. That the estimated costs in carrying out the foregoing improve- ment is hereby declared to be as near as may be, the sum of $574,980.26. Section 4. Applicable costs and expenses of all engineering, legal, inspection, advertising, publication and notices, and all other expenses incident thereto, shall be levied and assessed against all of the property legally and properly assessable therefor, as provided by the laws of the State of Washington and the Ordinances of the City of Auburn. Section 5. That said improvements shall be made by the City of Auburn under the supervision of the City Council thereof or such committee or person as the City Council may designate. Section 6. Assessments or any portion thereof, may be paid at any time within thirty (30) days from the date of the first publication of the Notice of Collection of such assessments without penalty, interest, or costs, and thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal annual install- ments, with interest on the whole unpaid sum at the rate of one-half (1/2) of t one percent (1%) in excess of the net effective rate of the Local Improvement District bonds with. the interest in no case 'being greater than thirteen percent (13%). Commencing with the first year after the last day; such assessments, or any portion thereof, may be paid without penalty, interest or cost (thirty (.30) days from the date of the first publication of the Treasurer's' Notice of Collection of Assessments) and each year thereafter one of said installments, together with the interest due, shall be collected as provided by law and the Ordinances of the City of Auburn; assessments or installments of assessments not paid when due shall be delinquent and there shall be added to the same a penalty of eight and one-half percent (8.5%) of the amount of the overdue installments and interest, and such penalty shall become a part of the lien upon the property assessed. ---------------------- Ordinance No. 3568 Page Three 11-25-80 Section 7. That there is hereby created in the office of the Finance Director for the City of Auburn, Washington, a fund of the City to be known as "Local Improvement District No. 313 Fund". Warrants shall be drawn on said fund based on estimates made by the City Engineer and approved by the City Council in payment of the costs of construction'and installation of said improvements. Section 8. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law. INTRODUCED: DECEMBER 1, 1980.
