HomeMy WebLinkAbout3572 h!Ao r 4.01 7 ORDINANCE NO. 3 5 7 2 n Ln co AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR THE VACATION OF ALLEY RIGHT-OF-WAY, SITUATED ON THAT PORTION OF LAND DESIGNATED AS A PUBLIC ALLEY RUNNING BETWEEN "C" AND "D" STREET N.W., NORTH OF WEST MAIN STREET, AND SITUATED WITHIN THE CORPORATE LIMITS OF THE CITY OF AUBURN. WHEREAS, the City Council of the City of Auburn, Washington, have passed and adopted Resolution No. 1136, resolving that a public hearing shall be had for the purpose of determining whether or not the hereinafter described alley right-of-way located on that portion of land designated as a public alley running between "C" and "D" Street N.W., north of West Main Street, within the corporate limits of the City of Auburn, shall be vacated, said portion to be vacated here- inafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public'hearing to vacate the portion of a certain alley right-of-way located on that'porti,on of land designated as a public alley running between "C" and "D" Street N.W., north of West Main Street, within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No. 1136 was held on the 3rd day of November, 1980, at 8:00 P.M. in the Council Chambers of the Auburn City Hall, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing; and WHEREAS, the City Council, having deemed that the petition for vacation was proper and that no vested rights would be affected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described portion of a certain alley right- of-way situated on that portion of land designated as a public alley running between "C" and "D" Street N.W., north of West Main Street, within the corporate limits of the City of Auburn, Washington, and more particularly described as follows: RECORDED THc!)AY ---------------------- Ordinance No. 3572 Page One 11-25-80 F a ''S 2 35 PP. '81 1 , r H l 1 That portion of the alley lying north of West Main Street between "C" and,"D" Streets N.W. particularly described as follows: Beginning at the southeast corner of Lot 16, - Block 2, Meades 2nd Addition to Slaughter as` - recorded in Vol 7 of Plats, pg 63, records of King County, WA; thence north along the east line of said Block 2 to the northeast corner of Lot 10 of said Block 2, thence easterly to the northwest corner of Lot 16, Block 3 of Ballards Park and Replat of Block 3, 1st Addition, both of Slaughter as recorded in Vol 3 of Plats, pg v) 91, records of King County, WA; thence south .0 along the west line of said Block 3 to the south- west corner of Lot 9 said Block 3; thence west O 20 feet more or less to the point of beginning. CV O be and the same is hereby vacated, and the property lying in said portion of a co certain alley right-of-way described hereinabove, shall be returned and belong to the abutting property owners, of said portion of a certain alley right-of-way located on that portion of land designated as a public alley running between "C" and "D" Street N.W., north of West Main Street, lying within the corporate limits of the City of Auburn. Section 2. That an easement over, under and across the vacated alley in favor of Puget Sound Power & Light Company be retained for electrical transmitting facilities. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor. Section 4. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
