ORDINANCE NO. 3 57 3
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING
FOR THE VACATION OF ALLEY RIGHT-OF-WAY, SITUATED ON THAT PORTION OF
LAND DESIGNATED AS A PUBLIC ALLEY RUNNING BETWEEN 1ST AND 2ND STREET
N.E., WEST OF AUBURN AVENUE, AND SITUATED I4ITHIN THE CORPORATE LIMITS
OF THE CITY OF AUBURN.

WHEREAS, the City Council of the City of Auburn, Washington, have passed
and adopted Resolution No. 1137, resolving that a public hearing shall be had
for the purpose of determining whether or not the hereinafter described alley
right-of-way located on that portion of land designated as a public alley
running between lst and 2nd Street N.E., west of Auburn Avenue, within the
corporate limits of the City of Auburn, shall be vacated, said portion to be
vacated hereinafter legally described in Section 1 of this Ordinance; and
WHEREAS, notice of public hearing to vacate the portion of a certain alley
right-of-way located on that portion of land designated as a public alley running
between 1st and 2nd Street N.E., west of Auburn Avenue, within the corporate
limits of the City of Auburn; in the time and manner provided by law, giving
notice that the hearing on said Resolution No. 1137 was held on the 3rd day of
+ November, 1980, at 8:00 P.M. in the Council Chambers of the Auburn City Hall, no
'objections thereto were filed with the City Clerk or presented to the City Council,
at said hearing; and

WHEREAS, the City Council, having deemed that the petition for vacation
was proper and that no vested rights would be affected by the same;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS: "
Section 1. That the.following described portion of a certain alley right- 3
of-way situated on that portion of land designated as a public alley running?betweeO
1st and 2nd Street N.E., west of Auburn Avenue, within the corporate limits o'f
the City of Auburn, Washington, and more particularly described as follows:",. RECORDED TF4;; DAY f

Beginning at the SW corner of Lot 6, Block 3, Supplemental
Plat,of Ballard's,Park Addition to Slaughter, Vol 8, pg 85;
thence easterly'150+ feet along the south line of Lots 4, 5
and 6 of said Block 3; thence southerly 30 ft parallel to the
east line of Section 13, Twp 21 N, R 4 EWM; thence westerly
30 ft parallel.to the north line of Lot 7 of said Block 3;
thence northerly 18 ft to the north line of sd Lot 7; thence
westerly along the north line of sd Lot 7 to the northwest
corner thereof;jthence northerly 12 ft to the true point of
beginning.
be and the same is hereby vacated, and the property lying in said portion of a
certain alley right-of-way described hereinabove, shall be returned and belong to
the abutting property owners, of said portion of a certain alley right-of-way
located on that portion of land designated as a public alley running between lst
and 2nd Street N.E., west of Auburn Avenue, lying within the corporate limits of
the City of Auburn.
Section 2. That an easement be retained under the vacated alley for the
maintenance and operation of a public sanitary sewer system. If a building is
constructed over the vacated alley the Auburn General Hospital, their heirs or
assigns shall enclose the existing sanitary sewer in a sleeve for the portion of the
sanitary sewer under said building and shall be responsible for any repair or
maintenance of said sanitary sewer.
Section 3. That an easement be retained over, under and across the vacated
alley in favor of the Washington Natural Gas Company and Puget Sound Power and
Light Company for transmission facilities. If a building is constructed over said
alley the owners, their heirs or assigns shall pay all costs to re-route said
transmission facilities.
Section 4. Upon the passage, approval and publication of this Ordinance,
the City Clerk shall cause a certified copy of this Ordinance to be recorded
in the office of the King County Auditor.

Section 5. This Ordinance shall take effect and be in force five (5)
days from and after its' passage; approval and publication, as provided by law.
