HomeMy WebLinkAbout3582 00 ORDINANCE NO. 3 5 8 2 yov 81/02n74 +1t•44 r RI:Ct1 F 4.0J CASHSL •.. ., Il AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF A PARCEL OF LAND 11.68•ACRES IN SIZE LOCATED ON THE SOUTH SIDE OF SOUTH 285TH STREET ABUTTING THE VALLEY FREEWAY, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM UNCLASSIFIED TO M-1. WHEREAS, a petition has been submitted to the Council of the City of Auburn, Washington, by RICHARD L. KLOPPENBURG, requesting the rezoning of the real property hereinafter described in Section 1 of this Ordinance, which petition was dated August 21, 1980; and WHEREAS, said request above referred to, was referred to the Planning Commission by the Auburn City Council for study and public hearing thereon; and WHEREAS, the Planning Commission held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on November 4, 1980, at 7:30 P.M., at the conclusion,of'which the'P•lanning Commission recommended i i=. , i I I, the approval of the rezoning of the said property; and WHEREAS, the City Council of the'City.of Auburn, held a public hearing in the Council Chambers of the Auburn City Hall, at 8:00 P.M. on December 1, 1980, at which time the City Council concurred with the recommendations of the Planning Commission as hereinabove stated; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the following described property located on a parcel of land 11.68 acres in size located on the south side of South 285th Street abutting the Valley Freeway, situate in the City of Auburn, County of King, State of Washington, be and the same is hereby rezoned from Unclassified to M-1 (Light Industrial), to-wit: Tracts 2, 3 and 4, White River Valley Home Tracts, accdg to the plat recorded in Vol 13 of Plats, pg 17, in King County, Washington, situated in Section 36, Twp 22 N, R 4 EWM City of Auburn, County of King, State of Washington. That the amendment to the Comprehensive Zoning Map of the City of Auburn, Washington, encompassing this zoning use classification change, which amendment is designated as Exhibit "A" hereof, be and the same is hereby approved. Section 3. Concurrent with the passage of this Ordinance, the applicant shall enter into an agreement with the City of ,Auburn, the terms of said agreement which. shall run with the real property described in Section 1 of this Ordinance, and the terms of said agreement which shall run with the said real property and shall provide as follows, to-wit: Sub-Section A: That prior to the issuance of any building permits on the property for industrial purposes the owner shall dedicate to the City of Auburn for street purposes, a strip of land 60 feet in width, the full length of the property, lying adjacent to the East marginal line of the Valley Freeway (sign Route 167). This street will provide local access to the pro- perty and eventually will provide a frontage road adjacent to the Valley Freeway between 15th Street N.W. and South 277th Street, thereby providing access to the Valley Freeway. Section 4. That the City Clerk of the City of Auburn, is hereby authorized and directed to file a certified copy of this Ordinance with the King County Auditor. Section 5. This Ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication, as provided by law.
