AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, REPEALING
AUBURN CODIFIED CITY ORDINANCES 18.06.130 RELATING TO BOARD OF
ADJUSTMENTS REGULATIONS FOR HEARING DATES AND PUBLIC NOTICES AND
18.06.070 RELATING TO BOARD OF ADJUSTMENTS REGULATIONS REGARDING

N THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN
AS FOLLOWS:

Section 1. Auburn Codified City Ordinances 18.06.130 relating to Board
of Adjustments regulations for hearing dates and public notices and 18.06.070
relating to Board of Adjustments regulations regarding variance application
consideration are herewith repealed in their entirety.
Section 2. There is herewith created a new Auburn Codified City Ordinance
No. 18.06.130, which shall read as follows:
"18.06.130 Hearing-Date-Notice:
When an application addressed to the Board has been filed in
accordance with the provisions of this Chapter, the secretary
of the Board shall set a date for hearing the.same. Notice
of such hearing shall be given not less than ten (10) days prior
to the date in the form prescribed by the Board and shall set
forth. the time, place and purpose of such hearing.
A. By pasting not less than three (3) notices in colpicuous
places within 300 feet of the property submitting the H OKE'
application.

B. By mailing notices thereof to owners of all lands lyin?j `?,
within two hundred (200) feet from the exterior boundaries
of the land involved as the names appear on the latest
County Treasurer's Real Estate Tax Records."

Section 3. There is herewith created a new Auburn Codified City Ordinance
No. 18.06.070, which shall read as follows:
"18.06:070 Variance Application Consideration:
Subject to conditions, safeguards and procedures provided by ordinance,

the Board of Adjustments may be empowered to hear and decide applications for
variances from the terms of the Zoning Ordinance (Chapters 18.02, 18.04 and
18.08 through 18.78) the official map ordinance or other land use regulatory
ordinance under procedures and conditions prescribed?by'City ordinance, provided
such variance does not allow a-land use not permitted under the land use
classification governing the property and further such variance shall change
any regulations established by Special Property Uses:and/or Conditional Use
Permits authorized by the City Council, and further provided that no application
for variance shall be granted unless the Board.of Adjustments finds that:
A. The variance shall not constitute a grant of special
privilege inconsistent with the limitations upon uses
of other properties in the vicinity and zone in which
the property on behalf of which the application was
filed is located; and
B. Such variance is necessary, because of special circumstances
relating to-the size, shape, topography, location or
surroundings of the subject property, to provide it with
use rights and privileges permitted to other properties in
the vicinity and in the zone in which the subject property
is located; and
C. The granting of such variance will not be materially detrimental
to the public welfare or injurious to the property improvements
in the vicinity and zone in which the subject property is
situated."

Section 4. This Ordinance shall take effect and be in force five (5)
days from and after its passage, approval and publication, as provided by law.

I certify that said Ordinance No. 3585 was duly passed by the Council
and approved by the Mayor of the said City of Auburn, on the 15th day of
December A.D., 19 80.
I further certify that said Ordinance No. 3858 was published as provided
by law in the Daily Globe News, a daily newspaper published in the City of
Auburn, agg of general circulation therein, on the 22nd day of December
A.D., 19 tSU
