ORDINANCE NO. .4 2 9 2
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING FOR
THE VACATION OF STREET RIGHT-OF-WAY, SITUATED ON THAT PORTION OF LAND
DESIGNATED AS A PUBLIC STREET LOCATED ON 58TH AVENUE SOUTH, WITHIN THE
CITY OF AUBURN, WASHINGTON.
WHEREAS, the City Council of the City of Auburn, Washington, have passed
and adopted Resolution No. 1849, resolving that a public hearing shall be had
for the purpose of determining whether or not the hereinafter described street
right-of-way located on that portion of land designated as a public street
located on 58th Avenue South, within the corporate limits of the City of
Auburn shall be vacated, said portion to be vacated being hereinafter legally
described in Section 1 of this Ordinance; and
WHEREAS, notice of public hearing to vacate the portion of a certain
street right-of-way located on that portion of land designated as a public
street located on 58th Avenue South, within the corporate limits of the City
of Auburn, in the time and manner provided by law, giving notice that the
hearing on said Resolution No. 1849 was held on the 16th day of May, 1988, at
7:30 P.M. in the Council Chambers of the Auburn City Hall; and
WHEREAS, the Auburn City Council at their regular meeting of May 16, 1988,
having deemed that the petition for vacation was proper and that no vested
rights would be affected by the same.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
ORDAIN AS FOLLOWS:

Section 1. That the following described portion of a certain street
right-of-way situated on that portion of land designated as a public street
located on 58th Avenue South within the corporate limits of the City of
Auburn, Washington, and more particularly described as follows, to-wit:
Beginning at the northwest corner of County Tax Lot No.
13 in the Northwest quarter of Section 23, Township 21
North, Range 4 EWM, thence west 30 feet to a point on the
west right-of-way line of 58th Avenue South; thence south
along said right-of-way to the southeast corner of Lot
12, Block 13, Jovita Heights as recorded in Volume 20 of
Plats, page 12, records of King County, Washington; thence
east 30 feet to the east right-of-way of said 58th Avenue
South; thence north along said right-of-way line to the
point of beginning. Situated in the northwest quarter
of Section 23, Township 21 North, Range 4 EWM, City of
Auburn, County of King, State of Washington.
be and the same is hereby vacated, and the property lying in said portion of a
certain street right-of-way described hereinabove, shall be returned and
belong to the abutting property owners, of said portion of a certain street
right-of-way located on that portion of land designated as a public street
located on 58th Avenue South, lying within the corporate limits of the City of
Auburn, Washington.
Section 2. Upon the payment to the City Finance Department the amount of
$1,579.50, for one-half the assessed value of the above described real pro-
perty and upon the passage, approval and publication of this Ordinance, the
Legal Department for the City of Auburn shall cause this Ordinance to be
recorded in the office of the King County Auditor.
Section 3. The Mayor is hereby authorized to implement such administra-
tive procedures as may be necessary to carry out the directions of this
legislation.

Section 4. This ordinance shall take effect and be in force five (5) days
from and after its passage, approval and publication, as provided by law.
