HomeMy WebLinkAbout4304 .. 1 2 :3 4 ORDINANCE NO. 4 3 0 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING CERTAIN SECTIONS OF THE AUBURN CITY ZONING ORDINANCE NO. 4229, CODIFIED AS TITLE 18. 5 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: 6 Section 1. City of Auburn Zoning Ordinance No. 4229, adoped June I, 1987. 7 codified at Title 18 (Zoning), is hereby amended to add or modify specified 8 subsections which read as follows: 9 1. Section 18.04.400: 10 Delete "not more than one thousand (1000) square feet in area". 11 2. Section 18.04.440: 12 Add the following to the last sentence: 13 "or which provide services of a nursing home as defined by Section 18.04.660." 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 3. Section 18.04.480: In second sentence insert "and/or" after medical services. 4. Section 18.04.515: Add the following definition of kitchen: "Kitchen means any room or portion of a room, designed to be used for cooking or the preparation of food, having a kitchen type sink and provi- sions available for a permanent gas or electric stove or range." 5. Section 18.04.660: Add the following to the last sentence: "or to a group res i dence faci 1 ity." 6. Section 18.04.880: Revise definition to read as follows: "Public street" includes all streets, highways, freeways, avenues, lanes, alleys, courts, places, or other publ ic ways in the City, l~hether improved or unimproved, held in public ownership and intended to be open as a matter of right to public vehicular travel. 1 7. Section 18.08.020(A)(I): 2 Add the following subsection: 3 4 5 6 7 "1. Keeping of not more than six (6) household pets. ThIs limit shall not include birds, fish, or suckling young of pets;" 8. Section 18.20.020(E): Add the following subsection: "E. Keepi ng of not more than four (4) household pets. Thi s 1 imi t shall not include birds, fish, or suckling young of pets;" 8 9. Section 18.20.040(C)(2)(a): 9 Revise subsection to read as follows: 10 "a. Ten (10) feet between any manufactured home and/or accessory building and the manufactured home and/or accessory building on the adjoining 11 space." 12 10. Section 18.20.040(C)(3)(c): 13 Revise subsection to read as follows: 14 15 "c. Ten (10) feet between any manufactured home and/or accessory buildings and the manufactured home and/or accessory building on the adjoining space. " 16 11. Section 18.20.050(G): 17 Add the following subsection: 18 19 20 21 22 23 24 25 26 27 28 29 "G. For those parks that had been approved prior to June 15, 1987, the adoption date of Zoning Ordinance No. 4229, the placement or replace- ment of any home shall either be in conformance with this chapter or the site plan which had been previously approved by the City. For those parks which do not have an approved site plan the replacement of a home shall either be consistent with this chapter or the location of the previous home. In no case shall any applicable Fire or Building Code requirements be lessened." 12. Section 18.22.020(A)(8) and (9) and (10): Add the following subsections: "8. One detached single family dwelling not to exceed one single family dwelling per lot. 9. Accessory uses to permitted res i dent i al uses to i ncl ude resi dent i al garage, guest cottage, recreation room, tool shed, noncommercial greenhouse, and swimming pool. 10. Keeping of not more than four (4) household pets. This limit shall not include birds, fish, or suckling young of pets." 1 13. Section 18.22.040(F)(5): 2 Add the following subsection: 3 4 5 "5. Accessory structures shall meet all the required setlJacks of the zone with the exception that the rear yard setback may be reduced to five (5) feet, provided that any structure with a vehicular entrance from a street (publ ic or private) or publ ic alley shall be set back a minimum of twenty (20) feet." 6 14. Section 18.24.050(A): 7 Amend to read as follows: 9 8 "A. All uses shall be conducted entirely within a building or structure except: 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 1. Automobile parking lots; 2. Display or sales of goods that do not extend ei~ ht (8) feet past the front of the building, do not block entrance!s or interfere with pedestrian travel, do not interfere with the parking areas and do not encroach upon public property; 3. Outdoor seating for restaurants, theatres, or oUltdoor entertain- ment; 4. Temporary uses as permitted by the Hearing Examiner, Building Official, Planning Director or City EngIneer pur'suant to appl i- cable ordinances; 5. Unloading and loading areas; 6. Refuse containers; 7. Play areas for day-cares." 15. Section 18.32.020(0): Add the following: "...or larger than 50,000 square feet of floor area." 16. Section 18.32.030(P): Amend to read as follows: "Po Retail sales of the following and similar related products." 17. Section 18.32.040(M): Add the following new subsection: "M. Rel igious institutions, to be located in existing facil ities, only;" 18. Section 18.32.060(D): Replace "front" with "have frontage". 1 2 3 4 19. Section 18.32.050(0): Delete "65%" replace with "none required". 20. Section 18.34.020(B): Delete "auction houses, excluding animals". 5 6 21. Section 18.34.020(J): 7 Delete "leasing". 8 22. Section 18.34.020(Z): Add the following: 9 10 "...or larger than 50,000 square feet of floor area." 11 23. Section 18.34.020(FF) and (GG): 12 13 Add the following subsections: "FF. On-site day-care serving a specified permitted use. GG. On-site recreational facilities serving a specified permitted use." 14 24. Section 18.34.030(H): Add the following: " ... and sales." 25. Secti on 18.34.030(0): Amend to read as follows: 15 16 17 18 19 "0. Retail sales of the following and similar related prclducts." 20 26. Section 18.34.030(R): Add the following subsection: 21 22 "R. Day-care, including mini day-care center, day-care ce!nters, preschools or nursery schools." 23 24 27. Section 18.44.020(L): Amend to read as foll ows: "L. One detached single family dwelling not to exceed OnE! single family dwelling per lot." 30. Sections 18.44.020(M) and (N): Add the following subsections: "M. Accessory uses to residential uses to include residential garages, guest cottage, recreation room, tool shed, non-commer'cial greenhouse and swimming pool. N. Keeping of not more than four (4) household pets. This limit shall not include birds, fish, or suckling young of pets." 12 31. Section 18.48.020(A)(1 and 2): 13 Delete RR from Subsection 1 and add RR to Subsection 2. 14 32. Section 18.48.070(A)(2): 15 In third sentence after front yard add "and rear yard". 16 33. Section 18.50.020(B): 17 In second sentence after structure add "or a residential use is converted to a nonresidential use." 18 19 20 21 22 23 24 25 26 27 28 29 34. Section 18.50.040(B): In third sentence replace the thirty (30%) percent with "fifty (50%) percent". 35. Section 18.50.040(C): In fourth sentence repl ace fifty (50) percent with "seventy- fi ve (75%) percent". 36. Section 18.50.050(0)(3): After RO-H add "RMHP". 37. Section 18.50.050(E)(3): After RO-H add "RMHP". 1 38. Section 18.50.050(F)(5): 2 Replace "front" with "have frontage". 3 39. 18.50.050(G)(5): 4 Replace "front" with "have frontage". 5 40. Section 18.52.020(A)(7): 6 After "units" add "...a minimum of four (4) spaces shall be provided". 7 41. Section 18.52.020(B)(10): 8 After "area" add "... a minimum of three (3) spaces shall be provided." 9 42. Section 18.52.070(F): 10 Amend to read as follows: 11 12 "F. The Planning Director may authorize parking for a use to be located in a different zone (except as provided for in Section 18.52.070(E)) if the Director makes the same findings as listed in Section 18.52.070(E)." 13 43. Section 18.54.060(I): 14 Add the following subsection: 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 "I. When a building or structure is moved to another location it must then be made to conform to the requirements of the district to which it is moved, unless specifically allowed elsewhere by this Title." 44. Section 18.60.040(A): In third sentence after 18.60.020 add".. .but in no case shall any home occupation meet less than 9 of the 11 requirements." 45. Section 18.64.020(B)(I): In last sentence after permit add the following: "...or if necessary request additional information. Upon receipt of the additional information the Director shall within ten (10) I~orking days make a decision on the application." 46. Sections 18.68.020(A)(2) and (B)(I): After Council add "or Planning and Community Development C,)mmittee of the City Council." 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 2 23 24 25 26 27 28 29 1 Section 2. The Mayor is hereby authorized to implement slJch administra- 2 tive procedures as may be necessary to carry out the directions of this 3 legislation. 4 Section 3. This Ordinance shall take effect and be in for'ce five (5) days 5 from and after its passage, approval and publication, as provided by law.
