I ORDINANCE NO. 4 3 4 7 55
2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ANNEXING TO
THE CITY CERTAIN LAND CONTIGUOUS THERETO, A 13.09 ACRE
3 PARCEL OF LAND LOCATED ON "B" STREET NORTHWEST, AND MORE
PARTICULARLY DESCRIBED IN ATTACHED EXHIBIT "A" (THE
4 "MIYAGISHIMA" ANNEXATION).
5 WHEREAS, in accordance with Chapter 35A.14 RCW, the
6 owners of not less than 75 percent of value according to the
7 assessed valuation for general taxation of certain lands in
8 King County, Washington, and more particularly described in
9 Section 1 of this Ordinance filed their petition with the

10 City Council of the City of Auburn, Washington, petitioning
11
to have annexed to the City of Auburn the said described
12 land; and
13 WHEREAS, in accordance with Chapter 35A.14 RCW various
14 proceedings were had; and
15 WHEREAS, notice of intention to annex was filed with
]6 the King County Boundary Review Board; and
17 WHEREAS, the King County Boundary Review Board has
18 waived review and, no request for jurisdiction having been
19 filed, the proposed annexation is deemed approved as a
20 matter of law; and
21 WHEREAS, it appears to the City of Auburn, that said
22 annexation meets the requirements specified by law; the
23
procedure for the filing with the City of Auburn by the

1 requisite number of property owners of their notice of
2 intention to commence annexation proceedings, to and
3 including the consideration of the passage of this ordinance
4 also meets the requirements, specified by law; and the lands
5 proposed to be annexed are contiguous to the City of Auburn
6 and have not heretofore been incorporated in as a City or
7
Town;
8 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
9 WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. That there shall be annexed to the City of
10
11 Auburn, Washington, the property situated in the County of
King, State of Washington, which legal description is
described as follows:
Tracts 21, 22, and 23, Less the West 361 feet 4 inches
of Tract 23 of White River Valley Home Tracts, per plat
15 thereof, recorded in Vol 13 of Plats, page 17, records
of King County, WA. together with that portion of 80th
Avenue South, abutting the west line of Lots 21 and 22.
17 Section 2. That the property hereby annexed shall be
18
assessed and taxed at the same rate and on the same basis as
19
other property within the City of Auburn is assessed and
20
taxed to pay for any outstanding general indebtedness of the
21
City to which the area was annexed.

1 Section 3. That the annexation of the property will
2 become effective on the effective date of this Ordinance and
3 the property shall become part of the City of Auburn,
4 subject to all of the laws and ordinances of the City then
5 otherwise provided by law.
6 Section 4. Within ten (10) days after the effective
7 date of the annexation referred to in this ordinance, the
8 City Clerk of the City of Auburn shall send to the Office of
9 the City Clerk of the County Council seven (7) certified
10 copies of this Ordinance together with a copy of a letter
11 from the Executive Secretary of the King County Boundary
Review Board, which letter contains a copy of the decision
13 of the Boundary Review Board relating to this annexation.
14 Section 5. The city Clerk of the City of Auburn shall
15 file a certified copy of this Ordinance with the King County
16 Department of Assessments, Accounting Division.
]7 Section 6. The Mayor is hereby authorized to implement
18 such administrative procedures as may be necessary to carry
19 out the directions of this legislation.
20 Section 7. This Ordinance shall take effect and be in
21 force five days from and after its passage, approval and
22 publication as provided by law.
