HomeMy WebLinkAbout4393 ORDINANCE NO. 4 3 9 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING CHAPTER 3.41 ENTITLED "GARBAGE FUND UTILITY TAX" TO REDUCE THE GARBAGE FUND UTILITY TAX FROM FOUR AND ONE-HALF PERCENT OF GROSS RECEIPTS TO TWO PERCENT. 4 5 WHEREAS, Chapter 3.41 of the Auburn City Code entitled Garbage Fund Utility Tax provides for a utility tax in the 7 amount of four and one-half percent of the gross receipts on the annual revenues of the garbage fund; and 8 9 WHEREAS, it is in the public interest that this utility tax be reduced to two percent. 10 1! NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: 13 Section 1. PURPOSE. The purpose of this amending 14 ordinance is to reduce the amount of Garbage Fund Utility Tax 15 as provided in Chapter 3.41 of the Auburn City Code from four and one-half percent of the gross receipts against the annual 17 revenues of the garbage fund, to two percent. 18 Section 2. AMENDMENT. Chapter 3.41 of the Auburn City 19 Code entitled Garbage Fund Utilities Tax is hereby amended in 20 Section 3.41.010 and Section 3.41.020 as follows: 21 22 25 24 25 26 Ordinance No. 4393 December 13, 1989 Page 1 ! 3.41.010 Tax created. 2 There is created a utility tax in the amount of ((~e~-am~-eme-ha}~)) two percent of the gross receipts against and upon the total annual revenues of the garbage fund. 4 3.41.020 Levy and collection of tax. 5 There is levied a tax of ((~e~-a~-~me-h~)) two percent on the gross receipts, excluding dump fees on drop boxes, upon the total annual revenue of the garbage fund, which tax shall be collected from and levied upon 7 the total receipts of the garbage fund, excluding dump fees on drop boxes, for the benefit of the general 8 expense fund of the city. The finance director is directed to collect the tax of ((~-am~-eme-ha~{)) two 9 percent out of the total revenues received and directed to pay over the funds so collected into the general 10 expense fund of the city. 11 Section 3. SEVERABILITY. If any provision of this 12 amending ordinance or its application to any person or 13 circumstance is held invalid, the remainder of the ordinance 14 or application of the provisions to other person or 15 circumstances, shall be unaffected. Section 4. The Mayor is hereby authorized to implement 17 such administrative procedures as may be necessary to carry 18 out the directions of this legislation. 19 20 2! 22 25 24 25 Ordinance No. 4393 December 13, 1989 Page 2 2 Section 5.
