HomeMy WebLinkAbout4424 1 \ ORDINANCE NO. 4 4 2 4 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON AMENDING SECTION 2.75.030 ENTITLED "EMERGENCY SERVICES ADVISORY COMMISSION--MEMBERSHIP" AND SECTION 2.75.040 ENTITLED "EMERGENCY SERVICES ADVISORY COMMISSION--POWERS AND DUTIES" CONTAINED IN CHAPTER 2.75 ENTITLED "EMERGENCY SERVICES" TO COMPLY WITH TITLE III REQUIREMENTS OF THE FEDERAL SUPERFUND AMENDMENTS AND REAUTHORIZATION ACT (SARA). 3 4 5 6 WHEREAS, the City of Auburn desires to amend Auburn city Code Section 2.75.030 entitled "Emergency Services 7 8 Advisory Commission--Membership" and Auburn City Code 9 Section 2.75.040 entitled "Emergency Services Advisory 10 commission--powers and Duties" contained in Auburn City Code 11 Chapter 2.75 entitled "Emergency Services" to comply with 12 Title III requirements of the federal Superfund Amendments 13 and Reauthorization Act (SARA). 14 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 15 WASHINGTON, DO ORDAIN AS FOLLOWS: 16 Section 1. PURPOSE. The purpose of this ordinance is 17 to amend Auburn City Code Section 2.75.030 entitled 18 "Emergency Services Advisory Commission--Membership" and 19 Auburn City Code Section 2.75.040 entitled "Emergency 20 Services Advisory Commission--powers and Duties" contained 21 in Auburn City Code Chapter 2.75 entitled "Emergency 22 Services" to add certain duties and requirements in order to 23 24 25 26 Ordinance No. 4424 Page 1 April 4, 1990 1 2 comply with Title III requirements of the federal Superfund 3 Amendments and Reauthorization Act (SARA). section 2. AMENDMENTS. Auburn City Code section 4 5 2.75.030 entitled "Emergency Services Advisory Commission-- 6 Membership" contained in Auburn city Code Chapter 2.75 7 entitled "Emergency Services" is hereby amended as follows: 8 2.75.030 LOCAL EMERGENCY SERVICES PLANNING AND ADVISORY ((eeMMrSSreN)) COMMITTEE-- MEMBERSHIP. 9 10 The local emergency services planninq and advisory 11 ((eemm~ss~eft)) committee [LESPAC] is hereby created and 12 shall consist of the following: 13 A. The mayor, who shall be chairman; B. The coordinator of emergency services, who shall be vice chairman; C. Fire chief, chief of police, public works director, finance director, planning director, parks director, personnel director, and the city attorney. The terms of the members are to last so long as they hold the municipal position which qualifies them for membership under the ordinance codified in this chapter, and thereafter their successor shall automatically become a member; D. One member of the city council municipal services committee appointed by the chairperson; E. Such representatives of civic, business, labor, veterans, professional or other organization having an official group or organization civil emergency responsibility or other citizens of the community as may be appointed by the mayor with the advice and consent of the city council. 14 15 16 17 18 19 20 21 22 23 24 25 26 Ordinance No. 4424 Page 2 April 4, 1990 1 2 section 3. AMENDMENTS. Auburn City Code Section 3 2.75.040 entitled "Emergency Services Advisory Commission-- 4 Powers and Duties" contained in Auburn city Code Chapter 5 6 2.75 entitled "Emergency Services" is hereby amended as follows: 7 2.75.040 LOCAL EMERGENCY SERVICES PLANNING AND ADVISORY ((eeMMrSSreN)) COMMITTEE--POWERS AND DUTIES 8 9 It shall be the duty of the Auburn local emergency 10 services planninq and advisory ((eemm~ss~eft)) committee 11 [LESPAC], and it is hereby empowered, to review and 12 recommend for adoption, emergency services and mutual aid 13 plans and agreements and such resolutions, rules and 14 regulations as are necessary to implement such plans and 15 agreements. The local emergency services planninq and 16 advisory ((eemm~ss~eft)) committee shall meet at least 17 quarter-annually or upon the call of the ((efta~rmaft)) 18 chairperson or in ((ft~s)) the chairperson's absence from the 19 city or inability to call such meeting, upon the call of the 20 vice (( efta~rmaft)) chairperson. Members of the 21 ((eemm~ss~eft)) LESPAC, and the news media who have requested 22 notification, shall be notified of each meeting by the 23 forwarding of written notice to each at least three business 24 25 26 Ordinance No. 4424 Page 3 April 4, 1990 1 2 days in advance of the meeting. The ((eemm~ss~eft)) LESPAC 3 shall: 4 A. Advise the mayor on all matters pertaining to disaster readiness and response capabilities within the city; B. Periodically review and make recommendations for the revision and/or maintenance of up-to-date disaster response plans for the city consistent with RCW Chapter 38.52 and including: 1. Preparations for and the carrying out of executive emergency powers, 2. The delegation and sub-delegation of administrative authority by the mayor, 3. The completion of comprehensive response plans for facilities within the community subiect to SARA Title III provisions. 4. Identification of likelY transportation routes for listed extremely hazardous substances. 5. Identification of facilities contributinq to or subiect to additional risk (hospitals. natural gas facilities. etc.) 6. The desiqnation of a community emerqency coordinator and facility coordinators for those facilities subject to the SARA Title III procedures. 7. Procedures for public notification and release of public riqht-to-know information. 8. The description of emergency equipment and facilities in the community and a listinq of persons responsible for the eauipment and facilities. 9. Evacuation plans for the community. ((3~))10. The performance of emergency functions including fire-fighting, police, medical and health, welfare, rescue, engineering, transportation, communications, and warning services, evacuation of persons from stricken areas, plant protection, restoration of utility services, and other functions relating to civilian protection together with all activities necessary or incidental to the 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Ordinance No. 4424 Page 4 April 4, 1990 1 preparation for and carrying out of such functions, ((4~))11. Requirements for department operation including management succession, procedures for providing twenty-four-hour capability, mobilization procedures, special disaster response procedures, plans for records protection, personnel procedures, finance plans, and training procedures for disaster response; C. Provide cooperation and coordination with the disaster response plans of other local organizations and agencies; D. Prepare and recommend to the mayor plans for mutual aid operations with the state and political subdivisions thereof; E. Recommend expenditures for disaster preparations and training. 2 3 4 5 6 7 8 9 10 11 A majority of ((~fte eemm~ss~eft)) LESPAC shall 12 constitute a quorum for the transaction of business. Any 13 action taken by a majority of those present at any meeting 14 shall be deemed the action of ((~fte-eemm~ss~eft)) LESPAC. section 4. CONSTITUTIONALITY OR INVALIDITY. If any 15 16 section, subsection, clause or phrase of the sections herein 17 are for any reason held to be invalid or unconstitutional, 18 such invalidity or unconstitutionality shall not affect the 19 validity or constitutionality of the Chapter, it being hereby expressly declared that the sections herein and each 20 21 subsection, sentence, clause and phrase hereof would have 22 been prepared, proposed, adopted and approved and ratified 23 irrespective of the fact that anyone or more section, 24 25 26 Ordinance No. 4424 Page 5 April 4, 1990 1 2 subsection, sentence, clause or phrase be declared invalid 3 or unconstitutional. 4 section 5. The Mayor is hereby authorized to implement 5 such administrative procedures as may be necessary to carry 6 out the directions of this legislation. section 6. This Ordinance shall take effect and be in 7 8 9 force five days from and after its passage, approval and publication as provided by law. 10 i).
