HomeMy WebLinkAbout4425 2I 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 4 2 5 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON WHICH AMENDS AUBURN CITY CODE CHAPTER 10.28 ENTITLED "STREET USE RESTRICTIONS" CONTAINED IN AUBURN CITY CODE TITLE 10 ENTITLED "VEHICLES AND TRAFFIC" IN ORDER TO RESTRICT ALL VEHICLES RATED IN EXCESS OF 30,000 POUNDS GROSS WEIGHT TO DESIGNATED TRUCK ROUTES EXCEPT FOR LOCAL DELIVERIES NUMBERING LESS THAN TEN PER DAY AND TO PROVIDE AUTHORITY TO THE CITY ENGINEER TO RESTRICT VEHICLES MAKING LOCAL DELIVERIES NUMBERING TEN OR MORE TRIPS PER DAY UNDER CERTAIN CIRCUMSTANCES TO DESIGNATED ROUTES. WHEREAS, the City of Auburn desires to amend Auburn City Code Chapter 10.28 entitled "Street Use Restriction" contained in Auburn City Code Title 10 entitled "Vehicles and Traffic" in order to restrict all vehicles rated in excess of 30,000 pounds gross weight as defined by RCW 46.16.111 to designated truck routes except for those vehicles making less than ten (10) local deliveries and to provide authority to the City Engineer to restrict vehicles making local deliveries numbering ten or more trips per day under certain circumstances to designated routes. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. PURPOSE. The purpose of this ordinance is to amend Auburn City Code Chapter 10.28 entitled "Street Use Restrictions" contained in Auburn City Code Title 10 entitled "Vehicles and Traffic" in order to restrict all vehicles rated in excess of 30,000 pounds gross weight as defined by RCW ------------------ Ordinance No. 4425 Page 1 May 2, 1990 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 i7 18 19 20 21 22 23 24 25 26 46.16.111 to designated truck routes except for those vehicles making less than ten (10) local deliveries and to provide authority to the city engineer to restrict vehicles making local deliveries numbering ten or more trips per day under certain circumstances to designated routes. Section 2. AMENDMENTS. Auburn City Code Chapter 10.28 entitled "Street Use Restrictions" contained in Auburn City Code Title 10 entitled "Vehicles and Traffic" is hereby amended as follows: Chapter 10.28 STREET USB RESTRICTION sections: 10.28.010 Imposition authorization--Limitations 10.28.020 Restrictions and signing 10.28.030 Violation--Penalty 10.28.010 Imposition authorization--Limitations. The city engineer, with respect to public highways, streets and thoroughfares under this city's jurisdiction, may prohibit the operation thereon of ((xtater)) trucks or other vehicles, except the operation of school buses, public transit and emergency vehicles, ((and-trttei~s transporting-perishables-er-neeessa~~*-een~med~t~es;)) or may impose limits as to weights, may determine haul routes for local trips, or any other restrictions as may be deemed necessary, whenever, in his ((eplr~len)) judgment as City Engineer, any public highway, street or thoroughfare will be seriously damaged or destroyed by reason of rain, snow, climatic or any other conditions including deficient structural integrity, ((unless-tl~e epe~atlen-ef-the-~aehleles-ls-p~el~lblted-er-~est~leteel-ems ------------------ Ordinance No. 4425 Page 2 May 2, 1990 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 the-perYniss~b~e-Weights-ewe-red~teed-pre~~ded;-heWe~er,- that))_ ((t)) The city engineer shall not, however, prohibit the use of any city street designated by the State Highway Commission as forming the part of the route of any primary state highway through the city, by vehicles or any class of vehicles, or impose any restrictions or reductions in permissible weights unless the restriction, limitation or prohibition, or reduction in permissible weight, is first approved in writing by the State Highway Commission. io.28.02o Restrictions and Signing Except on public highways, streets and thoroughfares specifically designated as truck routes herein,((T))the city engineer shall erect, or cause to be erected and maintained, signs designating the provisions of the weight limit ((andfer preh~b~t~en of t~se en the sheets)) in each end of the portion of any public highway, street or thoroughfare affected by such ((~est~~et~ens ems)) limitations, ((er preh~b~t~ens)) and no such limitations ((ems p~eh~b~t~ens)) shall be effective unless the signs are in place. The city engineer shall erect or cause to be erected and maintained, signs designating the followinq_public highways, streets and thoroughfares within the limits of the City of Auburn as truck routes for all vehicles rated in excess of 30,000 pounds gross weight (gw) as defined for the purposes of this chapter by RCW 46.16.111 which is adopted by this reference, including all future amendments or additions thereto and under the provisions of RCW 35.12.140, the ordinance amending Chapter 10.28 shall be published as required by law, but the aforementioned RCW Section 46.61.111 adopted by reference need not be published but shall be authenticated and recorded with the Auburn city clerk, and not less than one cogy of such statute in the form in which it was adopted shall forthwith be filed in the office of the Auburn city clerk for use and examination by the public. ------------------ Ordinance No. 4425 Page 3 May 2, 1990 State Route 167 (Valley Freeway) State Route 181 State Route 18 State Route 164 (Auburn Way South So. of SR 18Z Auburn - Black Diamond Road (E. of the Burlinctton Northern Crossing in Auburn) 41st Street S.E. "A" Street S.E. - 6th S.E. to south city limits 15th Street N.W. - West of SR 167 6th Street S.E. - West of SR 164 (AWS~ 17th Street S.E. - 'M' Street S.E. to "A" St. SE 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 All other streets within the limits of the City of Auburn shall be restricted to allow only vehicles rated under 30,000 pounds GW, except for local deliveries which shall be defined, for the purpose of this chapter, as all deliveries with destinations or origins within the limits of the City of Auburn unless otherwise posted. All such local deliveries to or from the same site Engineer as provided in Section 10.28.010 above. 10.28.030 VIOLATION--PENALTY Violations of this chapter shall be traffic infractions subject to the procedures and rectuirements of Auburn City Code Section 10.12.410, 10.12.430, 10.12.440, 10.12.450, 10.12.460, 10.12.470, 10.12.480. 10.12.490, 10.12.500 10.12 510 10 12 520 and 10.12.530 all contained in Chapter 10.12 entitled "Traffic Regulations." Bail moneys provided for by this section may be forfeited. Section 3. CONSTITOTIONALITY OR INVALIDITY. If any section, subsection, clause or phrase of the sections herein are for any reason held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of the chapter, it hereby expressly declared that the sections herein, and each subsection, sentence, clause and phrase hereof would have been prepared, proposed, adopted and approved and ratified irrespective of the fact that any one or more section, subsection, sentence, clause or phrase be declared invalid or unconstitutional. Section 4. This Ordinance shall take effect and be in .force five days from and after its passage, approval and publication as provided by law.
