HomeMy WebLinkAbout4449 1 0RDIN~'CE NO, 4 4 4 9 2 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ANNEXING TO THE CITY CERTAIN LAND CONTIGUOUS THERETO, A 1.66 ACRE PARCEL 3 OF LAND LOCATED AT 3214 "A" STREET S.E. (THE "BALMER" 4 ANNEXATION). 5 WHEREAS, in accordance with Chapter 35A.14 RCW, the 6 owners of not less than 75 percent of value according to the assessed valuation for general taxation of certain lands in ? 8King County, Washington, and more particularly described in 9 Section 1 of this Ordinance, filed their petition with the ]0 City Council of the City of Auburn, Washington, petitioning to 1! have annexed to the City of Auburn the said described land; and 12 WHEREAS, in accordance with Chapter 35A.14 RCW various proceedings were had; and 14 15 WHEREAS, notice of intention to annex was filed with the King County Boundary Review Board; and 17 WHEREAS, the King County Boundary Review Board has waived 18 review and, no request for jurisdiction having been filed, the ]9 proposed annexation is deemed approved as a matter of law; and 20 WHEREAS, it appears to the City of Auburn, that said 21 annexation meets the requirements specified by law; the 22 procedure for the filing with the City of Auburn by the 25 requisite number of property owners of their notice of 24 25 Ordinance No. JuN 20. 19~0 Page 1 ! 2 intention to commence annexation proceedings, to and including the consideration of the passage of this Ordinance also meets 4 the requirements, specified by law; and the lands proposed to be annexed are contiguous to the City of Auburn and have not 5 heretofore been incorporated in as a City or Town; 7 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: 8 9 Section 1. That there shall be annexed to the City of 10 Auburn, Washington, the property situated in the County of King, State of Washington, which legal description is described as follows: 12 Baap on the Auburn City limits established 13 by Ordinance No. 3490, said point being the intersection of the South line of the NW¼ of Section 30, Twp 21 N, R 5 EWM with the East ROW line of "A" Street S.E. (AKA 15 84th Avenue South) thence North along the east ROW line of "A" Street S.E. 256 feet to the South ROW line of South 359th Street; thence East 270 feet along the South ROW line of South 359th to its 18 intersection with the Auburn city limits as established by Ordinance No. 3839, thence South along said City limits 226 19 feet; thence East along said City limits 100 feet; thence South along said City 20 limits 30 feet to its intersection with the City limits as established by Ordinance No. 1225; thence West 370 feet along said City limits to TPOB. Situated 22 in the SW% of the NW% of Section 30 TWP, 21 N, Range 5 EWM. 24 25 26 Ordinance No. July 20, 1990 Page 2 1 Section 2. That the property hereby annexed shall be assessed and taxed at the same rate and on the same basis as 4 other property within the City of Auburn is assessed and taxed 5 to pay for any outstanding general indebtedness of the City to 6 which the area was annexed. 7 Section 3. That the annexation of the property will become effective on the effective date of this Ordinance and 9 the property shall become part of the City of Auburn, subject ]0 to all of the laws and ordinances of the City then otherwise 1] provided by law. 12 Section 4. Within ten (10) days after the effective date of the annexation referred to in this ordinance, the City Clerk of the City of Auburn shall send to the Office of the 15 Clerk of the County Council one (1) certified copies of this 16 Ordinance together with a copy of a letter from the Executive 17 Secretary of the King County Boundary Review Board, which 18 letter contains a copy of the decision of the Boundary Review 19 Board relating to this annexation. 20 Section 5. The City Clerk of the City of Auburn shall 21 file a certified copy of this Ordinance with the King County 22 Department of Assessments, Accounting Division. 23 25 26 Ordinance No. 4449 July 20, 1990 Page3 I11 I I - 1 2 Section 6. The Mayor is hereby authorized to implement 3 such administrative procedures as may be necessary to carry 4 out the directions of this legislation. 5 Section 7.
