HomeMy WebLinkAbout4458 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 CITY CLERK'S OFFICE CITY OF AUBURN 25 Welt Main Auburn, WA BBO01 ORDINANCE NO. 4 AN ORDINANCE OF THE CITY COUNCIL WASHINGTON, APPROVING THE VACATION KNOWN AS SECOND STREET NORTHEAST DIVISION STREET, WITHIN THE CITY OF AUBURN, RETAINING A UTILITY EASEMENT FOR THE CITY. 458 OF THE CITY OF AUBURN OF A STREET RIGHT OF WAY BETWEEN "A''~ STREET AND WA'~HINGTON, AND WHEREAS, Petition No. V-03-90 has been filed by the owners of two-thirds or more of the property abutting the portion of right of ~ay requested to be vacated; .and WHEREAS, the statute requires that the City Council .schedule a public hearing when a valid petition is filed with the City; and WHEREAS, the public hearing was held on August 20, 199 before the City Council; NOW, THEREFORE, CITY COUNCIL OF THE CITY OF ;~BURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Seotion 1. The street right of way to be vacated is located on that portion of land known as Second Street Northeast between "A" Street and Division Street, within the City of Auburn, Washington, legally described as follows: A parcel of land lying within the northeast quarter of Section 13, Township 21 North, Range 4 East described as follows: Beginning at the southwest corner of Lot 11, Block 1, Supplemental Plat of Ballards Park Addition to Slaughter, according to the Plat Ordinance No. 4458 Augua 23,1990 Page1 90/10/05 ~1318 RECFEE 2.00 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 21 22 23 24 25 26 recorded in Volume 8 of Plats, page 85, in King County, Washington; said corner being the intersection of the east margin of Division Street and the north margin of 2nd Street thence easterly along the north margin of 2nd Street Northeast, north 89°59,57" east, 256' (per plat) 255.95 (meas) to the westerly margin of "A" Street Northeast; thence southerly along the southerly project of the said westerly margin south 00'04'24" west, 60.0 feet to the south margin of 2nd Street Northeast; thence westerly along said south margin south 89°59'57'' west 256.0 feet more or less to the easterly margin of Division Street; thence northerly along the northerly projection of said easterly margin north 00°08'06,, east 30.0 feet to the centerline of 2nd Street Northeast; thence continuing along the southerly projection of the easterly margin of Division Street north 00°01'28'' west 30.0 feet to the point of beginning. be and the same is hereby vacated, and the property lying in said portion of a certain street right of way described hereinabove, shall be returned and belong to those persons entitled to receive the property in accordance with the law. Section Z. The City hereby retains an easement for the construction, repair and maintenance of utilities over, across, upon and underneath the property described in Section i of this Ordinance. Section 3. Upon the passage, approval and publication of this Ordinance, the City Clerk for the City of Auburn shall cause this Ordinance to be recorded in the office of the King County Auditor. The Mayor is hereby authorized to implement 3 such administrative procedures as may be necessary to carry out the directives of this legislation.
