AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A TWENTY
CAR PARKING LOT IN A R-2 (SINGLE-FAMILY) ZONE, LOCATED AT 201
"M" STREET N.E., WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0010-9l dated December 30,
1991, together with site plans therefore, has been submitted
to the city of Auburn, Washington, by the NEIGHBORHOOD CHAPEL
CHURCH OF GOD requesting a Conditional Use Permit to allow
construction of a twenty (20) car parking lot to be located at
201 "M" Street N.E. in a R-2 (Single-Family) zone within the
City of Auburn, Washington, hereinafter described in section 2
of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on March 17, 1992, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Permit to allow
construction of a twenty (20) car parking lot to be located at
201 "M" Street N.E. in a R-2 (Single-Family) zone based upon
the following Findings of Fact and Conclusions, to-wit:

The subject site is located at 201 "M" street N.E. in
Auburn. It is currently utilized for a single family
home which the church proposes to remove as part of the
parking lot development. Surrounding zoning and land
uses in the vicinity include the church located to the
north, and single family uses to the south, east and
west. It should be noted that the subject site together
with land in all directions is designated for office
and/or residential uses by the Comprehensive Plan.

The proposed parking lot would be bordered on the south
side by a six foot fence together with a five foot width
of landscaping on the south and west property lines.

Currently, there are 210 seats in the existing Chapel and
there are 22 existing parking spaces. The Zoning Code
requires one parking space for each 5 seats and
accordingly the chapel would require 42 parking spaces.
With the addition of the 20 space parking lot, the Chapel
would be brought up to the required parking standards and
the need for on-street parking would be reduced.
At the time of the public hearing, several neighboring
residents expressed concern with regard to the effects of
the development on the neighborhood and the destruction
of affordable housing such as the house currently located
on the lot. However, in response to citizens concerns,
the person who has been contracted with to move the
house, indicated that the house would be moved and not
destroyed.
The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
set forth in full.

CONCLUSIONS OF LAW
1. The Zoning Ordinance sets forth a series of criteria
which must be established by the evidence before a
conditional use permit can be granted. The first of
these criteria is that the use will have no more adverse
effect on the health, safety, or comfort of persons
living or working in the area than would a use generally
permitted outright.
The evidence establishes that the proposal will not have
an adverse impact or effect on the area in that
additional off-street parking will lessen the impact on
the neighborhood by reducing the need for on-street
parking. Also, the fencing and landscaping as proposed,
will help to minimize the effects of the parking lot on
the adjoining neighborhood.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1.
The above cited modified Hearing Examiner's
Findings of Fact and Conclusions, are herewith incorporated in
this Ordinance.
Section 2. A Conditional Use Permit is hereby approved
to allow construction of a twenty (20) car parking lot to be
located at 201 "M" street N.E. in a R-2 (Single-Family) zone,
situate in the City of Auburn, County of King, state of
Washington, and is legally described as follows:
Lot 9, Block 5, David A. Botting Second
Addition to Auburn, according to Plat
recorded in Vol. 41 of Plats, page 26,
records of King County, WA.
Section 3. The six foot high fence on the south property
line shall be a 100% sight obscuring fence as defined by
Section l8.48.020(C) (2) of the Zoning Ordinance.
The fence
shall also meet the appropriate height and setbacks for the
front yard on "M" Street.
Section 4. The landscaping illustrated on the site plan
shall be a Type II.
Section 5. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.

Section 6. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 7.
This Ordinance shall take effect and be in
force five days from and after its passage, approval and
pUblication as provided by law.
