HomeMy WebLinkAbout4570 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 ORDINANCB NO. .. 5 7 0 AN ORDINANCE ADDING A NEW AUBURN CITY CODE CHAPTER 8.50 3 ENTITLED "ENHANCED 911 (E-911) TELEPHONE SYSTEM" to TITLE 8 ENTITLED "HEALTH AND SAFETY" ESTABLISHING A TELEPHONE SYSTEM 4 FOR AUTOMATIC NUMBER AND LOCATION INFORMATION. 5 6 7 8 WHEREAS, the Enhanced 911 Telephone System, hereinafter referred to as "E-911", has proven its lifesaving benefits to 9 the citizens of Auburn because it allows the operator answering an emergency call (the Public Safety Answering Point) to automatically locate the caller; and WHEREAS, in some cases these callers cannot be automatically located because their calls are made from telephones attached to private branch exchanges (PBX systems), Centron/Centrex Exchanges (CTX systems) or similar equipment systems; and WHEREAS, the proliferation of such PBX/CTX systems is increasing, (one estimate provided to the City is that in 1988, King County had only 300 units served by PBX's, but in December 1989 there were over 3,000) and the reason for this is the significant economic advantages for developers; and WHEREAS, the effectiveness of the E-91.1 system is compromised by the use of PBXs and CTXs because a PBX/CTX user calling 911 will only have displayed the location and phone number identification of the PBX/CTX system to the Public Safety Answering Point, and not that of the caller; and --..-------------------------- Ordinance No. 4570 May 14, 1992 Page 1 - .----.-------..------- ___om. _____,..________~_._ - .___~___ _____ __,__,___ 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 WHEREAS, the effectiveness of the E-911 system is compromised by the use of PBXs and CTXs; and 3 4 5 6 WHEREAS, this problem can be life-threatening when the caller is unable to identify his or her exact location and the emergency operator cannot automatically locate the caller 7 because the PBX/CTX system is not at the same location as the 8 caller; and WHEREAS, an additional problem exists in that some phone systems are sold without selective routing which may mean that a call placed to 911 within the city of Auburn would not be routed to the appropriate Public Safety Answering Point; and 9 WHEREAS, the proliferation of these PBX/CTX systems is continually increasing and thereby jeopardizing the health and safety of an increasing number of citizens; and WHEREAS, City of Auburn citizens who are serviced by PBX/CTX telephone systems may be denied the most important benefit of the E-911 telephone system, which is the automatic number and location information, and may have the erroneous belief that this service is provided to them; and WHEREAS, telephone products have been developed which can be attached to PBX/CTX telephone systems and whi.ch will allow a PBX/CTX system to properly interface with the E-911 system (meaning that the installation of these interface products make the automatic number and location information feature ----.---------.--------------- Ordinance No. 4570 May 14, 1992 Page 2 -_...,-~~.~.__.,_._--~--_._..._._---_._-- 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 available); and further, services are presently available to customers that will provide selective routing of calls to the appropriate Public Safety Answering Point; and 3 4 5 WHEREAS, it is critical to the health, safety and welfare 6 7 8 of the citizens of Auburn that all citizens have a telephone system which allows their PBX/CTX systems to properly 9 interface with the E-911 system and that these systems provide both automatic caller identification and selective routing to the appropriate Public Safety Answering Point; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: section 1. PURPOSB. It is declared to be the policy of the City of Auburn, in the exercise of its pOlice powers for the protection of the public health, safety and general welfare, that all of the citizens of Auburn have a telephone system which allows their PBX/CTX system to properly interface with the E-911 system and that these systems provide both automatic caller identification and selective routing to the appropriate Public Safety Answering Point. It is the intent of the city of Auburn, in the implementation of this ordinance, that all telephone systems provide service that will interface with the E-911 system to provide these benefits to all citizens. -----.------------------------ Ordinance No. 4570 May 14, 1992 Page 3 ---------..----- --------.-----.- 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 It is further declared that the availability and 3 4 installation of such products or services is not: only critical to the health, safety and welfare of the general public, but 5 6 also necessary to provide an effective means for the City of Auburn fire, medical and police units to efficiently locate 7 and promptly respond to any emergency. 8 9 It is further the express purpose of this ordinance to provide for and promote the health, safety and 'welfare of the general pUblic, and not to protect individuals or create or otherwise establish or designate any particular class or group of people who will or should be especially protected or benefitted by the terms of this ordinance. The obligation of complying with the requirements of this ordinance and the liability for failing to do so is hereby placed upon the owners and/or occupants or persons responsible for the conditions of the buildings or premises. Section 2. NEW CHAPTER 8.50. There is added a new Chapter 8.50 entitled "Enhanced 911 (E-911) Telephone System" to Title 8 entitled "Health and Safety" as set forth in Exhibit nAil attached hereto and incorporated herein which provides for an emergency caller's number and location being automatically routed to the appropriate Public Safety Answering Point. ----.-----------.------------- Ordinance No. 4570 May 14, 1992 Page 4 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 Section 3. Nothing contained in this LIABILITY. 3 ordinance is intended to be nor shall be construed to create 4 or form the basis for any liability on the part of the city of Auburn, or its officers, employees or agents, for any injury or damage resulting from the failure of an owner or occupant of property or land or person responsible for property or land to comply with the provisions of this ordinance, or by reason 5 6 7 8 9 in or of inspection, consequence notice, any order, certificate, permission or approval authorized or issued or completed in connection with the implementation or enforcement of this ordinance, or by reason of any action or inaction on the part of the city of Auburn related in any manner to the enforcement of this ordinance by its officers, employees or agents. Section c. SEVBRABILITY. Should any section, subsection, paragraph, sentence, clause or phrase of this ordinance be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. Section 5. Scope. Specific Location and Phone Humber Information Required. Enforc..ent-vio1ation-Penalty. Appeal. Fees. 8 9 8.50.040 8.50.050 8.50.060 8.50.010. Definitions. For the purposes of this chapter, certain words, terms, phrases and their derivations shall be construed as defined as follows: A. "ALI" means Automatic Location Identification, including but not limited to the caller's telephone number, the class of phone service (residence, business, coin, PBX, etc.), the date and time of the call, the caller's name, address and city, the routing code of the call, the pilot number, and the port or trunk on which the call is received. It also includes the name of the Public Safety Answering Point (PSAP) and the agencies that are responsible for police, fire or medical response to that address. B. "ANI" means the unique number identified with the calling C. party's phone. "E-911 telephone system" (E-911) means a telephone system consisting of a network, data base, and on-premises equipment that is accessed by dialing 911 and that enables the reporting of police, fire, medical, or other emergency situations to a pUblic safety answering point. The system includes the capability to selectively route incoming 911 calls to the appropriate public safety answering point which operates in a defined 911 service area and the capability to provide certain caller information ("ANI" and "ALl") to the appropriate public safety answering point. D. "Private branch exchange system" (PBX) means a private telephone switching system located on a customer's premises and connected to a common group of incoming lines, that provides service to a number of individual telephone sets. "Public Safety Answering Point" (PSAP) means Valley Communication Center located at 23807 98th Avenue, South, Kent, WA 98031. G. "Selective Routing" means the function of telephone service which directs the call to the proper PSAP, based upon the calling party's address. "Fire Chief" means the City of Auburn Fire Chief. H. I. "Person" includes any natural person, his heirs, executors, administrators or assigns, and also includes a firm, partnership, association or corporation, its or their successors or assigns, or the agent of any of the aforesaid. section 8.50.020. SCOPE. A. This chapter shall apply to all buildings, appurtenant structures and premises located within the City of Auburn including: (1) those structures within which PBX/CTX systems are presently installed; (2) those structures hereinafter constructed in which telephone systems will be installed; (3) any buildings, structures or premises in which telephone systems are and/or will be installed where a new certificate of occupancy is required because of a change in use; and (4) any buildings, structures or premises in which a telephone system is installed on or after the effective date of this ordinance. -----...------------------------------------ Ordinance No. 4570 Exhibit A May 14, 1992 Page 9 -------_._._.~~----"..,---_._._-~-_._....- 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 3 B. The owner(s) and/or occupant(s) or person(s) responsible for the conditions of any existing buildings, appurtenant 4 5 structures and premises in which PBX/CTX systems are presently installed shall be in compliance with the 6 requirements of this ordinance on July 1, 1995 7 Section 8.50.030. Specific locaton and phone nUllber 8 9 information required. A. Every building, appurtenant structure or premise within the city shall, where a telephone system is installed, also have telephone services or products installed which will properly interface with the E-911 system by making the following ALI-ANI information available to the PSAP's receiving screen when any party within the system calls 9-1-1: 1. Name. 2. Address which is to include building number and unit number, if applicable. 3. Telephone Number. 4. City. 5. Appropriate police and fire response. Class of service (PBX, coin phone, residence). 6. B. All building permits issued after the effective date 6 of this ordinance shall require certification that the telephone system is capable of providing line-specific 7 telephone number and location information. This 8 9 requirement must be demonstrated before a certificate of occupancy is granted. D. The owner ( s) and/or occupant(s) or person ( s) responsible for the conditions of any existing building, appurtenant structure or premise with PBX/CTX systems presently installed shall provide certification to the Fire Chief by July 1, 1995 that the telephone system is capable of providing the required ALI-ANI information. E. Owners and operators of PBX/CTX systems shall provide to the Fire Chief a record of timely updates to the E-911 data base. Section 8.50.040. Bnrorc..ent-vio1aton-penalty. A. No building permit for new construction in which B. telephone systems will be installed shall issue which does not conform to the requirements of this ordinance. C. The provisions of this chapter and any policies promulgated thereunder shall be enforced by the Fire Chief or his designee, except that the Fire Chief or his designee may call upon any City department to aid in the 7 8 implementation and enforcement of this chapter. Any 9 violation of the provisions of this chapter is deemed a fire code violation and shall constitute a misdemeanor. Any person who violates any provision of this chapter shall be subject to a fine not to exceed $1,000.00 nor more than ninety days in jailor by both such fine and imprisonment. D. The Fire Chief is authorized to adopt policies that are necessary to implement the requirements of this ordinance and to carry out the duties hereunder. Section 8.50.050. Appeals. Pee.. A. No fees shall be charged for inspection of buildings, 4 5 appurtenant structures or premises for compliance with this chapter if such inspection is carried out in 6 conjunction with any required inspection under the uniform building and fire codes as adopted in Auburn City Code Title 15, "Buildings and Construction".
