HomeMy WebLinkAbout4630 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 6 3 0 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING AUBURN CITY CODE CHAPTER 8.24 ENTITLED "FIREWORKS" TO LIMIT THE DISCHARGE OF COMMON FIREWORKS WITHIN THE CITY LIMITS OF THE CITY OF AUBURN TO THE HOURS OF 9:00 A.M. TO 11:00 P.M. ON JULY 4 ONLY, AND TO RESTRICT THE SALE OF COMMON FIREWORKS TO PERSONS SIXTEEN YEARS OF AGE AND OLDER. WHEREAS, to the regulation Washington; and WHEREAS, local jurisdictions may enact regulations relating to the sale, use and discharge of fireworks that are more restrictive than state law so long as the local regulations do not directly conflict with state law; and WHEREAS, the City Council of the City of Auburn has determined that it is in best interests of the public health, safety and welfare of the citizens of the City of Auburn to reduce the dates and times that common fireworks may be discharged within the city limits and to restrict the sale of common fireworks to persons who are sixteen (16) years of age or older. NOW, THEREFORE, THE CITY COUNCIL OF THE WASHINGTON, DO ORDAIN AS FOLLOWS: RCW 70.77 entitled "State Fireworks Law" relates of fireworks throughout the State of CITY OF AUBURN, Section 1. PURPOSE. Section 8.24.060(C) of the Auburn City is hereby amended to read as follows: Only fireworks defined as common fireworks in this chapter may be sold at retail stands. CommQD__fireworks shall only be offered for sale, and shall only be sold, to persons who are 16 years of age or older. The provisions of this ordinance are declared separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion of this ordinance or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of the ordinance, nor the validity of its application to other persons or circumstances. Section 6. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation. Section 7. This ordinance shall take effect and be in force no sooner than five (5) days from and after its passage, approval and publication, as provided by law.
