AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
A CONDITIONAL USE PERMIT TO ALLOW THE CONSTRUCTION OF A 137.5
SQUARE FOOT INCREASE OF ADMINISTRATIVE OFFICE AREA ON PROPERTY
ZONED R-2 (SINGLE FAMILY RESIDENTIAL), LOCATED AT 816 "F"
STREET S.E., WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Application No. CUP0002-93 dated April 13,
together with site plans therefore,
City of Auburn, Washington, by
requesting a Conditional Use Permit
of a 137.5 square foot increase of
1993,
has been submitted to the
AUBURN YOUTH RESOURCES
to allow the construction
administrative office area
on property zoned R-2 (Single Family Residential) within the
City of Auburn, Washington, hereinafter described in Section 2
of the Ordinance; and
WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn city Hall, on May 18, 1993, at the
conclusion of which the Hearing Examiner recommended the
approval of the issuance of a Conditional Use Permit to allow
the construction of a 137.5 square foot increase of
administrative office area located at 816 "F" Street S.E., in
a R-2 (Single Family Residential) zone based upon the
following Findings of Fact and Conclusions, to-wit:

FINDINGS OF F~CT
The applicant, Auburn Youth Resources, through its agent,
Dick Brugger, seeks a Conditional Use Permit to allow the
construction of a 137.5 square foot increase of
administrative office area.
The subject property is located at 816 "F" Street S.E.
and is currently zoned R-2, Single Family Residential. A
conditional use permit was previously granted which
authorized an office use.
Surrounding zoning and land uses in the vicinity include
R-2, Single Family Residential, to the north; C-3, Heavy
Commercial, to the south; R-2, Single Family Residential,
to the east; and C-3, Heavy Commercial, to the west.
Auburn Youth Resources proposes to expand to allow a
centrally located area for the office fax machine, copy
machine, postage meter, computer and printer. This area
is proposed to be a centrally located work area to be
used by existing staff.
The applicant indicates that the expansion is not for the
purpose of providing additional staff, but only to make
the existing office space more efficient and practical.
There are ten parking spaces provided on-site for the
existing office, which is located in approximately 2700
feet of floor space.
The proposed addition would require one additional
parking space. However, the Zoning Ordinance at Section
18.52.010(b) (3) does allow additions to not provide
parking if the parking need is five spaces or less.
The proposed addition will eliminate one of the existing
ten parking spaces and the Zoning Ordinance does not
allow the reduction of the required parking spaces.
The applicant is able to redesign the existing parking
lot and provide the ten parking spaces. In order to do
this, one half of the number of parking spaces must be
compact. Therefore, since the Zoning Ordinance limits
the percentage of parking spaces which are compact spaces

to 30 percent of the total, the applicant has applied for
a variance to increase the percentage of compact parking
spaces·
At the time of the public hearing, there was some
testimony from neighbors in the vicinity which expressed
concern regarding lack of parking for the site as it
currently exists.
In addition, concern was expressed regarding lack of
parking space particularly on Wednesdays when Auburn
Youth Resources evidently holds a staff meeting and staff
come from different locations and are required to park on
and around the existing site.
The staff report, with its recommendation of conditional
approval, is incorporated herein by reference as though
set forth in full.
CONCLUSIONS OF LAW
The Zoning Ordinance sets forth a series of criteria
which must be established before a Conditional Use Permit
may be granted.
The first of these criteria that the use has proposed
will not have an adverse effect on the health, safety, or
comfort of persons working or living in the area. The
proposed addition is relatively small since the actual
increase above the existing floor area will only 4.8
percent. It is also important that the addition does not
propose to increase the number of employees.
The proposal is in accordance with the goals, policies,
and objectives of the Comprehensive Plan.
The proposal complies with the Zoning Ordinance with the
exception of the compact parking provision. However,
simultaneously the applicant is requesting a variance
concerning the parking.
The proposal can be constructed and maintained so as to
be harmonious and appropriate in design, character, and
appearance with the existing or intended character of the
general vicinity. The addition is small, one story, and

will be similar in character. However, it is important
to ensure that the construction does not inappropriately
impact the residential uses in the neighborhood.
6. The proposal will not adversely affect the public
infrastructure.
For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this Conditional Use Permit to allow the
construction of a 137.5 square foot increase of administrative
office area located at 816 "F" Street S.E., is approved.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The above cited Hearing Examiner's Findings
of Fact and Conclusions, are herewith incorporated in this
Ordinance.
Section 2. A Conditional Use Permit is hereby approved
to allow the construction of a 137.5 square foot increase of
administrative office area located 816 "F" Street S.E., in a
R-2 (Single Family Residential) zone, situate in the City of
Auburn, County of King, State of Washington, and is legally
described as follows:
Lots 28 through 30, Blk 2, Walnut Lawn
Addition to Auburn.
Section 3. Ten parking spaces must be provided.

Section 4. Construction activities will only occur on
Monday through Saturday from 7:00 a.m. to 5:00 p.m.
Section 5. If Auburn Youth Resources continues to hold a
staff meeting on Wednesday, then there will be no construction
activity at this site on Wednesdays, since there would be
inadequate parking for the construction vehicle or vehicles
and the staff who would be attending the staff meeting.
Bection 6. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 7. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 8. This Ordinance shall take effect and be in
force five days from and after its passage, approval and
publication as provided by law.
