AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AMENDING ORDINANCE NO. 821 AND AUBURN MUNICIPAL
CODE CHAPTER 2.45 TO PROVIDE FOR THE ADOPTION OF THE PLANNING
COMMISSION UNDER CHAPTER 35A.63 RCW.
WHEREAS, Ordinance No. 821, approved May 3, 1939 and
codified under Chapter 2.45 was done pursuant to the 1935
Planning Enabling Act which passed on March 11, 1935; and
WHEREAS, the City ultimately became a Code City under
Title 35A RCW; and
WHEREAS, the provisions setting forth planning in a Code
City are controlled by RCW Chapter 35A.63; and
WHEREAS, enacting the provisions of Chapter 35A.63 RCW
provide additional flexibility for joint meetings and
cooperative action and regional planning; and
WHEREAS, a public hearing was held before the Planning
Commission and the Planning Commission recommended approval;
and
WHEREAS, this Ordinance was reviewed by the Planning and
Community Development Committee of the City Council; and
WHEREAS, this Ordinance is in harmony with the
Comprehensive Plan; and
WHEREAS, this Ordinance does not have any adverse
environmental effect;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section ~. Ordinance No. 821, Section 2 and Chapter
2.45, Auburn Municipal Code, are hereby amended to read as
follows:

Section 2. If any provisions of this Ordinance, Chapter
35A.63 RCW, Ordinance No. 821 are determined to be invalid or
unenforceable for any reason, the remaiging provisions of this
Ordinance and Ordinance No. 821 shall remain in force and
effect.
Seotion 3. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directions of this legislation.
Section 4. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval, and
publication, as provided by law.
