HomeMy WebLinkAbout4688 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 6 8 8 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, REPEALING PARAGRAPHS A AND B OF SECTION 18.52.080, AUBURN MUNICIPAL CODE, WHICH HAD REQUIRED THE PAYMENT OF A FEE FOR EACH PARKING SPACE REQUIRED AND ADDING A PROVISION TO PROVIDE FOR EXECUTION OF A NON-REMONSTRANCE AGREEMENT IN LIEU OF PARKING. WHEREAS, Section 18.25.080, Auburn Municipal Code, requires a payment in lieu of parking prior to the issuance of a building permit in the sum of TWO THOUSAND FIVE HUNDRED DOLLARS ($2,500.00) for each parking space required; and WHEREAS, presentations to the City have stressed the difficulty in new businesses locating in the downtown area complying with the standards for parking which may have discouraged businesses from locating in the area; and WHEREAS, representatives of the Auburn Downtown Association and the Chamber of Commerce have met with City staff to discuss the problems and alternatives; a:nd WHEREAS, the amount set forth in the Ordinance would not cover the cost to acquire the land and to build a parking space; and WHEREAS, intended to the provisions set forth in this Ordinance are be temporary in nature anticipating a more comprehensive review of current and potential parking needs in the adoption of new parking standards specific to the unique demands generated by downtown; and Ordinance No. 4688 June 14, 1994 Page 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, it is in the public interest to encourage businesses to locate in the downtown area; and WHEREAS, the execution of a non-remonstrance agreement which may result in the establishment of a Local Improvement District would establish a monetary amount for parking that would accurately reflect the actual cost for the acquisition and construction of parking spaces. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1.. Section 18.52.080, Auburn Municipal Code, paragraphs A and B are hereby repealed. Substitution of paragraphs A and B of Section 18.52.080 and the provisions in Section 2 below are enacted. Section 2. Payment in lieu of parking. Within the Central Business District as identified in the Comprehensive Plan, the parking spaces required in this chapter for commercial uses, may be satisfied through the signing of a binding, non-remonstrance agreement with the City. The agreement will ultimately be utilized by the City to support public parking facilities that are the parking demand within the Central the construction of new required to meet Business District. Section 4. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. 8eotion 5 This Ordinance shall take effect and be in force immediately upon its passage and approval and then shall be published as provided by law.
