AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, APPROVING THE VACATION OF A PORTION OF 29TH STREET
N.W., WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, Petition No. V-01-94 has been filed by the
owners of two-thirds or more of the property abutting the
portion of right of way requested to be vacated; and
WHEREAS, the statute requires that the City Council
schedule a public hearing when a valid petition is filed with
the City; and
WHEREAS, the public hearing was held on June 20, 1994
before the City Council;
NOW, THEREFORE, CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
Section 1. The street right of way to be vacated is
located on that portion of 29th Street N.W., legally described
as follows:
THAT PORTION OF 29th STREET NORTHWEST IN THE
SOUTHEAST QUARTER OF SECTION 1, TOWNSHIP 21 NORTH,
RANGE 4 EAST, W.M., LYING EAST OF THE EAST ]LINE AND
THE SOUTHERLY PROJECTION THEREOF OF THE CERTAIN
PARCEL OF LAND CONVEYED TO STEWART MESHER ~D ALDER
KAHN BY RECORDING NO. 7311120475, RECORDS OF KING
COUNTY, WASHINGTON AND LYING WEST OF A LINE 117.98
FEET WEST OF THE EAST LINE OF GOVERNMENT LOT 7 IN
SAID SECTION 1.

be and the same is hereby vacated, and the property lying in
said portion of a certain street right of 'way described
hereinabove, shall be returned and belong to those persons
entitled to receive the property in accordance with the law.
~ection 2~ Emergency access and egress through the
vacated 29th Street right-of-way and the race track security
personnel shall be provided to properties located on 29th
Street N.W., between the Burlington Northern Railroad line and
the Union Pacific Railroad Line (O.W.RR. & NAV.C.).
Section 3. Emergency access as approved by the Fire
Chief shall be provided through the vacated 29th Street right-
of-way.
Section 4. Cul-de-sacs shall be provided at. the east and
west ends of vacated portion of 29th Street N.W., as directed
by the City Engineer.
Section $. The Vacation of 29th Street N.W. shall be
contingent on the execution of a contingent dedication
agreement for the north/south arterial (Condition #13D) as
approved by the Hearings Examiner on June 10, 1994 and the
issuance of an occupancy permit by the City for a thoroughbred
horse racing facility (CUP0001-93). Consistent with this
condition the City will issue a Right-of-way
construction of project related improvements
of right-of-way proposed to be vacated.

Seotion 6. The City shall obtain a utility easement for
the construction, repair and maintenance of all utilities
over, across, upon and underneath the property described in
Section 1 of this Ordinance.
8eotion 7. Upon the passage, approval and publication
of this Ordinance, the City Clerk for the City of Auburn shall
cause this Ordinance to be recorded in the office of the King
County Auditor.
Section 8. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.
