AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, AMENDING CHAPTER 2.64 ENTITLED "DEFERRED
COMPENSATION PLAN" BY AMENDING SECTION 2.64.010 ENTITLED
"RECOGNITION AND APPROVAL." CONTAINED IN AUBURN CITY CODE
TITLE 2 ENTITLED "ADMINISTRATION AND PERSONNEL" TO ALLOW
MULTIPLE DEFERRED COMPENSATION PLANS TO MEET EMPLOYEES
DIFFERING NEEDS AND ALLOW AN OPEN MARKET APPROACH TO THE
SELECTION OF DEFERRED COMPENSATION PLANS, AND NAME THE
PERSONNEL DIRECTOR AS THE PLAN ADMINISTRATOR, WHO IN TURN
WOULD OVER SEE THE DEFERRED COMPENSATION COMMITTEE.
WHEREAS, the City of Auburn had an existing deferred
compensation ordinance since 1980 that refers only to Great
West Company; and
WHEREAS, that the City of Auburn has allowed other
deferred compensation plans by resolution outside of the
ordinance; and
WHEREAS, that it is appropriate to amend Chapter 2.64
entitled Deferred Compensation Plan, to reflect the City's
intent to allow multiple deferred compensation plans to meet
the employees differing needs; and
WHEREAS, to allow an open market approach to the
selection of deferred compensation plans; and
WHEREAS, to name the Personnel Director as Plan
Administrator, who will over see the Deferred Compensation
Committee.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
section 1. PURPOSE. The purpose of this Ordinance is as
follows:
To amend Chapter 2.64 entitled "DEFERRED COMPENSATION
PLAN" by amending section 2.64.010 entitled "RECOGNITION AND
APPROVAL." contained in Auburn City Code Title 2 entitled
"ADMINISTRATION AND PERSONNEL".
Section 2. Section 2.64.010 is adopted as set forth in
Exhibit "A" attached hereto and incorporated herein by this
reference.
Section 3. Constitutionality or Invalidity. If any
section, subsection, clause or phrase of this Ordinance is for
any reason held to be invalid or unconstitutional, such
invalidity or unconstitutionality shall not affect the
validity or constitutionality of the remaining portions of
this Ordinance, as it being hereby expressly declared that
this Ordinance and each section, subsection, sentence, clause
and phrase hereof would have been prepared, proposed, adopted
and approved and ratified irrespective of the fact that any
one or more section, subsection, sentence, clause or phrase be
declared invalid or unconstitutional.

implementation.
The mayor, the personnel director, and city clerk are
authorized and directed to execute the necessary documents for
the establishment and implementation of such deferred
compensation ((p~a~)) plans.
2.64.030 Availability.
Upon such execution of such

subject to removal and replacement as the mayor shall
determine from time to time.
The committee shall administer the deferred compensation
