AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING
ORDINANCE NO. 4725, SECTION 4, TO CLARIFY CONDITIONS FOR THE
TYPE OF BARRICADING DURING CONSTRUCTION AND AFTER COMPLETION
OF CONSTRUCTION FOR A SURFACE MINING PERMIT TO ALLOW THE
EXCAVATION OF APPROXIMATELY 220,000 CUBIC YARDS OF MATERIAL TO
ACCOMMODATE CONSTRUCTION OF A 176 LOT S:[NGLE FAMILY
RESIDENTIAL SUBDIVISION WITHIN THE CITY OF AUBURN, WASHINGTON,
BY CENTEX REAL ESTATE CORPORATION.
WHEREAS, Ordinance No. 4725 allowed excavation materials
to accommodate a single-family residential subdivision being
developed by CENTEX REAL ESTATE CORPORATION located south of
Howard Road, North of Game Farm Park more fully described in
Exhibit A of Ordinance No. 4725 known as "Riverwalk"; and
WHEREAS, questions have arisen concerning the
interpretation of Section 4 of Ordinance No. 4725; and
WHEREAS, to clarify Section 4 of Ordinance No. 4725
language is needed to set forth requirements both during
construction and subsequent to construction; and
WHEREAS, modification to Ordinance No. 4725 is consistent
with the comprehensive plan and is consistent with the
findings of the Hearing Examiner and the City Council and only
adds language to clarify the provisions Section 4; and
WHEREAS, Resolution No. 2665 will amend Resolution No.
2587 to provide the same consistency in language.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. Section 4 of Ordinance No. 4725 is hereby
amended to read as follows:
The two stub streets, that abut the plat on the east
boundary, shall be barricaded during constr'action of the
subdivision. No construction traffic shall be allowed
onto these streets, except for emergency vehicles.
Subsequent to construction, the access to the two stub
streets shall remain locked and barricaded and shall be
for emergency vehicles only. The applicant shall
construct that form of access for emergencies as approved
by the city. Construction entrances shall [be limited to
either Howard Road or 29th Street and shall be signed as
being construction entrances for the project.
Section 2.
Ail the remaining provisions of Ordinance
No. 4725, except as specifically amended above, shall remain
in force and effect.
Section 3. If any provision of this Ordinance, or
Ordinance No. 4725 is determined to be invalid or
unenforceable for any reason, remaining provisions of this
Ordinance and Ordinance No. 4725 shall remain in force and
effect.
Section 4. Upon the passage, approval and publication of
this Ordinance as provided by law, the City Clerk of the City
of Auburn shall cause this Ordinance to be recorded in the
office of the King County Auditor.
Section 5. The Mayor is hereby authorized to implement
such administrative procedures as may be necessary to carry
out the directives of this legislation.

Section 6. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and
publication, as provided by law.
