HomeMy WebLinkAbout4846 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 1 2 3 4 5 6 ORDINANCE NO. 4 8 4 6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN WASHINGTON, AMENDING SECTION 8.08.230 OF THE AUBURN CITY CODE ENTITLED 'COLLECTION CHARGES-RESIDENTIAL AND COMMERCIAL COLLECTIONS" SPECIFICALLY SUBSECTIONS 8.08.230 (A) (E) AND (F) WHICH IS CONTAINED IN CHAPTER 8.08 OF THE AUBURN CITY CODE ENTITLED 'SOLID WASTE" TO ESTABLISH A NEW SOLID WASTE RATE STRUCTURE FOR COMMERCIAL RECYCLING AND TO ADJUST THE RATE FOR SIX CUBIC YARD GARBAGE DUMPSTER SERVICE. WHEREAS, pursuant to Ordinance No. 4537 approved on December 17, 1991, as amended pursuant to Ordinance No. 4588 approved on October 19, 1992, the City Council enacted Chapter 8.08 of the Auburn City Code entitled "Solid Waste" which implemented a new solid waste rate structure formulated to provide incentives for voluntary conservation and recycling of solid waste within the City of Auburn; and WHEREAS, 8.08 provided the practice of the recyclables to encourage recycling, Auburn City Code Chapter for "Co-Mingled Recycling" which is defined as setting out materials for collection such that are separated from non-recyclables but are not segregated into types of recyclable material; and WHEREAS, larger businesses within the City are benefited by participation in the co-mingled recycling program due to Ordinance No. 4846 March 11, 1996 Page I 1 2 3 4 5 6 ? 8 9 10 11 12 13 14 15 16 17 18 19 20 21 ')2 23 24 25 26 the high volume of recyclable materials generated, the City has determined that smaller businesses do not generate the volume of recyclable material necessary to make the smallest size co-mingled recycling container, which currently is a 90 gallon tote, economically feasible to utilize; and WHEREAS, to accommodate the recycling needs of the smaller businesses and multi-family unit customers located within the City of Auburn, the City herein proposes an amendment to ACC 8.08.230(A) to establish a rate for the "Standard 30 Gallon Can Commercial Co-mingle Recycling Service" and the "60 Gallon Tote Commercial Co-mingle Recycling Service". The 30 gallon standard can to be supplied by the user and the 60 gallon tote hauler RST Disposal Co., Inc.; and WHEREAS, to accommodate the to be supplied by the special recycling needs of businesses that produce sawdust waste and/or commercial yard waste (excluding commercial multi-family units) located within the City of Auburn, the City herein proposes an amendment to ACC 8.08.230(E) to establish a rate for the "90 Gallon Tote Commercial Sawdust Recycling Service" (52 pick-ups per year), Ordinance No. 4846 March 1 l, 1996 Page 2 1 2 3 4 5 6 7 8 9 10 I1 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 and the "90 Gallon Tote Commercial Yard Waste Recycling Service" (excluding commercial multi-family units customers) 52 pick-ups per year. The 90 gallon totes for these services are to be supplied by the hauler, RST Disposal Co., Inc.; and WHEREAS, to accommodate the needs o~ residential and commercial yard waste customers signed up for curbside yard waste service who require the collection of extra yard waste in excess of that included in the current "Annual" or "Monthly" yard waste collection schedule (as listed on the accou.nt) who require the limbs, branches, the City herein proposes an establish a rate for "Extra and other solid waste customers collection of yard waste storm debris such as etc., within the City of Auburn, amendment to ACC 8.08.230(E) to Yard Waste Bulk"; and WHEREAS, to be compatible with existing Dumpster Rates and to provide a financial businesses to recycle and implement City of Auburn herein proposes an amendment (F) to adjust the rate for six cubic yard service; and Service incentive for Auburn recycling programs, the to ACC 8.08.230 garbage dumpster Ordinance No. 4846 March 11, 1996 Page 3 1 2 3 4 5 6 7 8 9 10 II 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 WHEREAS, the Council Municipal Services Committee on March 18, 1996, reviewed the proposed amendments to Auburn City Code Chapter 8.08 and recommended approval thereof. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ~_~ Section 8.08.230 of the Auburn City Code, entitled "Collection charges-Residential and commercial collections", is hereby amended as delineated in Exhibit "A" which is attached hereto and incorporated herein. ~ Incentive rates between garbage and co- mingled recyclables in Section 8.08.230 shall become effective on the first billing period which occurs 60 days after passage of this ordinance. ~ The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, paragraph, subdivision, section or portion of this or the invalidity of the application thereof to any sentence, ordinance, person or remainder circumstance shall not affect the validity of the of this ordinance, or the validity of its application to other persons or circumstances. A. Services and charges herein shall become effective for each account on the first day of the billing period following January 1, 1992. Upon this date, services shall be provided at the one can rate unless the finance department is notified otherwise by the tenant or property owner. Likewise, unless the finance department is otherwise notified, services will automatically revert to the one can rate upon a change in property tenancy or ownership. Senior citizens must proof of qualification for this special rate. C. Multi-unit type of service for each occupied multi-unit residential accounts for at the same rate charged account per occupied unit. D. For drop box services, tippin9 fees charged by the Kin9 County Division of Solid Waste shall be added to the total service charges. Minimum charges for drop box services include 2 pickups per month, plus the applicable container rental rate. When drop boxes are provided for temporary service (i.e. demolition material), the customer shall pay an initial delivery charge of $18.05. L. The customer shall also pay a minimum service charge per day for each day or fraction thereof the container is in service. This minimum charge shall be $2.89. M. The customer shall pay the tipping fee for each dump whether disposed of by weight or by the cubic yard. The haul charge shall be as follows: 20 cu. yd. container 30 cu. yd. container $54.45 per haul $63.90 per haul N. Hourly Charge. Where the contractor provides the service of cleanup, the hourly charge for a truck and driver shall be $50.00 (with 1/2 hour minimum). The hourly charge for each extra man shall be $20.43. Where hourly charges are made, the customer shall pay the tipping fee. O. A deposit for all temporary containers 20 cubic yards or larger is required prior to delivery. The charges for these are as follows: 20 cubic yard container $250.00 deposit 30 cubic yard container $400.00 deposit As other temporary containers become available, deposits shall be required for their use based on size.
