AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR
4 THE REZONING OF PROPERTY LOCATED AT 822 UA" STREET SE, WITHIN
5 THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING
CLASSIFICATION THEREOF FROM R-3 (DUPLEX) TO C-3 (HEAVY
6 COMMERCIAL).

WHEREAS, Application No. REZ0001-96 has been submitted to
8
the Council of the City of Auburn, Washington, by JAMES M.
9
HALVERSON, requesting the rezoning of the real property
10
ll hereinafter described in Section 2 of the Ordinance; and
12 WHEREAS, said request above referred to, was referred to
13 the Hearing Examiner for study and public hearing thereon; and
14
WHEREAS, the Hearing Examiner, based upon staff review,
15
held a public hearing to consider said petition in the Council
16
]7 Chambers of the Auburn City Hall, on April 16, 1996, at the
18 conclusion of which the Hearing Examiner recommended the
of the rezoning of said property; and
W~EREAS, the City Council, on May 6, 1996, considered
request and affirmed the Hearing Examiner's

Fact and Conclusions, to-wit:

FINDINGS OF FACT
o
The applicant, James M. Halverson, has requested that
property located at 822 "A" Street SE be rezoned from R-
3, Duplex, to C-3, Heavy Commercial.
The subject property is 7,844 square feet in area. It
consists of two platted lots, which contain a single
family home.
Although the property is currently zoned R-3, the
Comprehensive Plan illustrates this parcel, together with
most of the property on the east side of ~A." Street SE,
to be appropriate for heavy commercial uses. "A" Street
SE is a fully constructed five lane arterial.
The property owner has yet to determine what the ultimate
use of the property will be. However, the house will be
removed and replaced with a commercial use.
Surrounding zoning and land uses in the vicinity include
C-3, vacant, to the north; C-3, office building, to the
south; R-3, residential, to the east; and M-l, railyard,
to the west.
CONCLUSIONS OF LAW

The rezone should be approved.
The rezone is consistent with the Comprehensive Plan map
designation, zoning, and existing uses in the area.
The subject property's location abutting on a five lane
arterial is conducive to commercial use.

For each of the above referenced reasons, the
recommendation of the Hearin9 Examiner to the Auburn City
Council on this rezone from R-3 (Duplex) to C-3 (Heavy
Commercial) is approved and affirmed.
