Halverson, has requested that property located at 822 "A" Street SE be rezoned from R- 3, Duplex, to C-3, Heavy Commercial. The subject property is 7,844 square feet in area. It consists of two platted lots, which contain a single family home. Although the property is currently zoned R-3, the Comprehensive Plan illustrates this parcel, together with most of the property on the east side of ~A." Street SE, to be appropriate for heavy commercial uses. "A" Street SE is a fully constructed five lane arterial. The property owner has yet to determine what the ultimate use of the property will be. However, the house will be removed and replaced with a commercial use. Surrounding zoning and land uses in the vicinity include C-3, vacant, to the north; C-3, office building, to the south; R-3, residential, to the east; and M-l, railyard, to the west. CONCLUSIONS OF LAW 3 o The rezone should be approved. The rezone is consistent with the Comprehensive Plan map designation, zoning, and existing uses in the area. The subject property's location abutting on a five lane arterial is conducive to commercial use.
