3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, REPEALING AUBURN CITY CODE CHAPTER 13.04 ENTITLED
4 ~WATER SERVICE GENERAL REGULATIONS" AND ADOPTING A NEW
AUBURN CITY CODE CHAPTER 13.06 ENTITLED ~WATER UTILITY

GENERAL REGULATIONS".
7 WHEREAS, the City has adopted a revised Comprehensive
8
Water Plan which complies with the requirements of Washington
9
Administrative Code (WAC) 246-290-100, the Washington State
10
11 Department of Health provisions on water system planning and
12 was done in coordination with City Growth Management Planning;
13 and
14
WHEREAS, the City has completed a Cost of Service Study
15
for the purpose of establishing customer classes and
16
17 determining the cost to serve each customer class; and
]8 WHEREAS, the City has completed a Water Rate Study based
19 upon the revenues necessary to implement the Capital
20
Improvement Program and to operate and maintain the Water
21
Utility; and
22
23 WHEREAS, the City has determined that the method of water
24 rate computation should be revised based upon the Cost of
25

Service Study recommendations for providing equitable rates

for water service; and
4 W~EREAS, the City has determined that water rates should
5 reflect the conservation objectives of the Comprehensive Water
Plan; and

WHEREAS, ACC 13.04 entitled "Water Service General
8
Regulations" has been in need of being updated;
9
10 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
1! WASHINGTON, DO ORDAIN AS FOLLOWS:
12 ~ ~J~ The purpose of this ordinance is
as follows:

To repeal Auburn City Code Chapter 13.04 entitled
'~Water Service - General Regulations" and to adopt Auburn City
17 Code Chapter 13.06 entitled "Water Utility General
18 Regulations".

~ Auburn City Code Chapter 13.04 and all of

its sections, is hereby repealed in its entirety as set forth
22 in Exhibit "A" attached hereto and incorporated herein by this
23 reference.

its sections are hereby adopted in its entirety as set forth
4 in Exhibit ~B" attached hereto and incorporated herein by this
5 reference.
6 ~9_C=t~ Constltution~lity or Invalidity. If any
7 section, subsection, clause or phrase of this Ordinance is for
8
any reason held to be invalid or unconstitutional, such
9
invalidity or unconstitutionality of the remaining portions of
11 this Ordinance, as it being hereby expressly declared that
]2 this Ordinance and each section, subsection, sentence, clause
13 and phrase hereof would have been prepared, proposed, adopted
and approved and ratified irrespective of the fact that any
one or more section, subsection, sentence, clause or phrase be
17 declared invalid or unconstitutional.
18 ~ The Mayor is hereby authorized to
19 implement such administrative procedures as may be necessary

to carry out the direction of this legislation.

~ This Ordinance shall be published as
22
23 provided by law and shall become effective October 9, 1996.
