REQUIRED".
WHEREAS, ACC Chapter 13.04 entitled ~Water Service -
General Regulations" is being repealed; and
WHEREAS, ACC Chapter 13.06 entitled "Water Utility -
General Regulations" is being adopted; and
WHEREAS, the method of computation for water rates is
being revised; and
WHEREAS, the City has determined that it desires to
provide a rate exemption for residential customers who use
kidney dialysis machines in their home which require the use
of quantities of water in addition to average residential
monthly quantity; and

WHEREAS, ACC 13.24 entitled ~Utility Rate Exemptions" has
been in need of being updated;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
~ Auburn City Code Title 13, Water, Sewers &
Public Utilities, Chapter 13.24 Utility Rate Exemptions, is
hereby amended as set forth on Exhibit "A" and made a part
hereof as though set forth in full herein.

section, subsection, clause or phrase of this Ordinance is for
any reason held to be invalid or unconstitutional, such
invalidity or unconstitutionality of the remaining portions of
this Ordinance, as it being hereby expressly declared that

10 From and after the effective date of the ordinance codified in
1! this chapter an eligible head of household, whether that
individual lives within or without the city limits, may apply
12 for a senior citizen((~)) or disabled citizen((.,s)) rate
exemption for water, sewer, ((garbage)) ~ and storm
13 drainage, as applicable((~)) Individuals with a kidney
14 dialysis patient residing in their household may apply for
rate exemption which applies to water rates only. All ra~

A. That only one such exemption for each utility service
16 is granted per dwelling unit;
17 B. That the applicant certified under the penalties of

exemption, or that a kidney dialysis patient resides in thn
household and uses e_quipment in the household which require~
hiqh volumes of water for such kidney dialysis, and that the
applicant(s) for the previous calendar year had a total income
from all sources of less than the maximum allowed for very low
income as allowed by the Department of Housing and Urban
Development for that previous year.
13.24.020 Conditions.
The exemption set out in ACC 13.24.010 shall be allowed for
residential water users and/or for those whose dwellings are
connected to the sanitary sewer and/or for those who use the
((~arbage)) ~ or storm drainage service. The utility
services referred to in ACC 13.24.010(A) shall serve a
location utilized solely for residential purposes and shall
not serve a location utilized for other purposes such as a
commercial or industrial establishment.
13.24.030 Minimum water rate.
The monthly water discount for those qualified ((scnior

13_24.047 Solid waste rates,
The monthly solid waste discount for those qualified cit~ze~
who apply for an exemption under the provisions of th~:

Chapter 8.08 ACC. for two cans of solid waste or less. once
~eek pickup, including spring and fall cleanup,

apply for an exemption under the provisions of this chapter
shall be 50 percent of the prevailing single-family flat rate
monthly charge.
13.24.060 Annual application required.
Ail exemptions from the minimum monthly charges for the
specified utilities will be required to be renewed ~
for annually during the month of May. Exemptions for
individuals with their own accounts will start with the next
billing after May, exemptions for individuals without their
own account will be in the form of a rebate for the previous
12 months or any eligible portion thereof for which the
applicant can show proof of residency in the household for
which the exemption applies in the form of rent receipts.
