WHEREAS, Application No. CUP0004-94 dated August 8, 1994, together with site plans therefore, has been submitted to the City of Auburn, Washington, by STEVENS TIRE, requesting a Conditional Use Permit to allow for an outdoor storage yard in a M-1 (Light Industrial) zone located at 899 West Main, within the City of Auburn, Washington, hereinafter described in Section 2 of the Ordinance; and WHEREAS, said request above referred to, was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petition in the Council Chambers of the Auburn City Hall, on June 18, 1996, at the conclusion of which the Hearing Examiner recommended the approval of the issuance of a Conditional Use Permit to allow for an outdoor storage yard in a M-1 (Light Industrial) zone; and Ordinance No. 4888 July 5, '1996 Page 1 1 2 3 4 5 6 7 8 9 10 ll 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 W/qEREAS, the City Council, on July 1, 1996, considered said request and affirmed the Hearing Examiner's decision for the issuance of a Conditional Use Permit to allow for an outdoor storage yard in a M-1 (Light Industrial) zone, located on property situated at 3224 Auburn Way South, within the City of Auburn, Washington, based upon the following Findings of Fact and Conclusions, to-wit: The applicant, Stevens Tire, requests a conditional use permit. The proposal is to allow for an outdoor storage yard on property located at 899 West Main. The property is zoned M-I, Light Industrial. The existing land use is that of a tire retread business and the Comprehensive Plan designates the site for light industrial uses. Existing zonin9 in all directions in all directions is M-i, and existing land uses in all directions except north is industrial. The land to the north is vacant and the Comprehensive Plan designates the land in all directions for light industrial uses. The M-1 zone is restrictive concerning outdoor storage and limits outdoor storage to circumstances when the storage is associated with an indoor use and the percentage of the floor area is up to a maximum of 50% with a conditional use permit. The applicant desires to have the outdoor storage yard be 50% of the associated building. The existing outdoor storage which has been occurring is not in compliance with the Zoning Code, but will be once the conditional use permit is approved. There are currently 10,880 square feet of floor area and the maximum storage yard permitted would be 5,440 square feet. The site plan appears to have included the required landscape areas in the growth area of the storage yard. The outdoor storage location on the north side of the building is the most removed from public view. The Uniform Fire Code Regulations concerning the outdoor storage of tires will require compliance with same. The required landscaping must be accomplished within a reasonable time frame since the outdoor storage is currently existing. The staff report, with its recommendation of conditional approval, is incorporated herein by reference. Accordingly, the use will be no more of an adverse effect on the area than would a use generally permitted in the district. The proposal is in accordance with the goals, policies, and objectives of the Compressive Plan. The proposal can be constructed and maintained so as to be harmonious and appropriate in design, character, and appearance with the existing or intended character of the general vicinity. The proposal will not adversely affect the public infrastructure. For each of the above referenced reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this Conditional Use Permit to allow for an outdoor storage yard in a M-1 (Light Industrial) zone, located on property situated at 899 West Main, is approved. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, KING COUNTY, WASHINGTON, DO ORDAIN AS FOLLOWS: ~ The above cited Hearing Examiner's Findings of Fact and Conclusions, are herewith incorporated in this Ordinance. ~ A Conditional Use Permit is hereby approved to allow for an outdoor storage yard in a M-1 (Light Commercial) zone, located on property situated at 899 West Ordinance No. 4888 July 5, 1996 Page 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 Main, within the City of Auburn, County of King, Washington, legally described as follows: Lot 9, Block C, Lunns Garden Tracts to State of Auburn, Volume 10, Page 33, Records of King County, WA. The landscaping Ordinance shall be installed within required by the 90 days of Zoning the effective date of this permit or the storage shall be removed.
