ROUSH, EXECUTRIX FOR THE ESTATE OF KENNETH E. NEELY, NECESSARY FOR THE PURCHASE OF TAX PARCEL NO. 142104-9036, LOCATED AT 1508 WEST MAIN STREET, AUBURN, WASHINGTON. WHEREAS, the area in and around the vicinity of Auburn including Tax Parcel No. 142104-9036 was recently declared by the President of the United States a national disaster area (FEMA-1079-DR-WA) due to severe flooding; and WHEREAS, the City of Auburn has application approval for Hazard Mitigation Grant funds under RESOLUTION No. 2720, a copy of which is attached hereto and incorporated by reference in this Ordinance as Exhibit "A"; and WHEREAS, the Washington State Military Department, Federal Emergency Management Agency (F.E.M.A.) and. the City of Auburn are contributors under the Hazard Mitigation Grant for the purpose of providing long-term flood relief which prevents a hazard to the life and safety of the residents at the above described property; and Ordinance No. 4902 August 13, 1996 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 16 17 18 19 20 21 22 23 24 25 26 WHEREAS the City expects to receive Hazard Mitigation Grant funding from the Washington State Military Department and F.E.M.A. in the amount of $93,735.00; and WHEREAS, the City of Auburn Storm Drainage Utility is desirous of acquiring Tax Parcel No. 142104-9036 for the purpose of floodwater storage and potential conversion to wetland; and WHEREAS, the City's offer to purchase amount of $101,700.00 plus normal closing costs has been accepted by the executrix of the owner of Tax Parcel No. 142104-9036, legally described as follows: Commencin9 at the northeast corner of the northeast quarter of the southeast quarter of Section 14, Township 21 North, Range 4 East, W.M., in King County, Washington; thence south along the east boundary line of said Section 14 at a distance of 230 feet; thence west 236 feet, more or less, to the east bank of Mill Creek; thence northerly along the east bank of Mill Creek to the north line of the northeast quarter of the southeast quarter of the said Section 14; thence east along the north line of said northeast quarter of the southeast quarter, 140 feet, more or less, to the point of beginning; Ordinance No. 4902 August 13, 1996 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 EXCEPT that portion as condemned by the State of Washington under Superior Cause Number 721182; AND EXCEPT any portion thereof lyin9 within south 328th Street also known as West Main Street. See the attached Purchase and Sale Agreement dated July 26, 1996 incorporated herein as Exhibit "B"; and WHEREAS, the City's contract appraiser, Clendaniel, Lema & Watts Inc., has completed their valuation for the subject which concludes a fair market property, as of June 27, 1996, value of $81,700; and WHEREAS, the City's offer to purchase amount reflects an attributable estimated replacement and depreciation cost of $16,000.00 and relocation costs of $4,000.00; and a vicinity map of said property is attached WHEREAS, approval of this ordinance satisfies Item 4 of said Purchase and Sale Agreement between the City and the owner, and the owner's estate legal representative dated July 26, 1996; and WHEREAS, hereto as Exhibit 'C". Project Description: The City of Aubum requests an$80,345 Hazard Mitigation Grant. It proposes to provide a$26,791 match to create a total project budget of$107,126. It will use thbse fiinds to acquire the Neely pmperty The Neely property is an original Aubum homestead. The original homestead was settled'm 1850 by Aaroon Neely and has remained in the Neely family ever since. Currently the pmperty has an area of 3/4 of one acre and has a single story,xambler styled home located oa it. It is located at 1508 West Main Stceet and is cumndy zoned for light mdustrial development. The City of Aubum owns all of the property adjacent to the Neely homestead. It acquired the adjaccnt property ihrough the aonpayment of a sewer improvement district assessment. The City plans to use portion ofthe adjacent land for stomi dxainage managemeat For several months out the year, for the past twenty plus yeazs,the property becomes flooded. Accotding to Mrs.Neely, she remains in the property until the flood water invades her hearing ducts. At thai time she is forced to relocate. During the recent Thaaksgiving flood she was forced tn vacate her home. During her absence,Mis:Neely's properry was looted twice. 'Ibis constant flooding makes the pmperty fimctionally obsolete,it endangeis life�d praperty The Plight of the Neely family occasionally appeazs in local newspapecs. Reduction of Risk,Hardship,Loss,and Suffering: Conditions on the Neely property satisfy the definition of a"blighted azea"established by RCW 35.81.010(2). This statute defiaes a blighted azea as the existence of coadifioas that endanger life or property by reasons of fize or other causes. It is property ihat zetaids the provisioa of housing accommodations or constitutes a social liab�lity and threat to public hrelth,safety and welfaze. The coafinually flooded coaditions of the Neely property endanger life. The mmmbei of iastances when the Fire Department had w rescue the occupants ofihe property indicates a social liability and a menace to public health, safety and welfaze. The pmperry has been vandalized and looted on occasian. All ofthese factors attest to its blighted condition. The acquisition of the Neely property is recognized m dtafts of the l�f'ill Creek Basin F1ood Control Plan as a flood bazard reduction measwe. The propose grant would enable the City to purchase the property and remove the blighted conditions. Proceeds from the acquisition will enable the curcent occupants of the pmperty to relocate imo decent,dry aad affordable housing. Pnoceeds from the sell of development rigl�,imdeiwritten by pmpecty in this mitigation bank,will buy,restore aad impmve wetlands. Assuming the price of development rights is equivalent to the valne of dry indushial pmperty,the value of the developmeat rights genecated by the Naly property should be appm�mately four times geater than its existent value as chroniplly flooded land. Finally, smce the City would use Commimity Development Block Cnaat fimds to match the Hazard Mitigation Graat,the eventual use of the Neely pmperry must bonefit low income n�sidmtg. A suggested alumative to the cash pumhase of developmeat rights is the acquisition of such rights thmugh the generaRon of jobs for low mcome iesideats. 4.
