ORDINANCE NO.
AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, ACCEPTING THE
DONATION OF APPROXIMATELY TWENTY ACRES OF LAND WITHIN THE CITY
OF AUBURN, WASHINGTON, AND AUTHORIZES THE EXECUTION OF AN
AGREEMENT FOR APPROVAL OF PERMITS TO PERMIT THE FILLING OF THE
FORMER CITY SEWAGE LAGOON BY THE D. A. GARRETT COMPANY.
WHEREAS, the D. A. GARRETT COMPANY is proposing to fill
approximately 80 acres of land occupied by the City's former
sewer lagoons which is supported by the Army Corps and
Engineers, past City actions and by City staff; and
WHEREAS, attendant with filling the lagoons the owner is
obligated to replace wildlife habitat values, consistent with
City Polices, which would otherwise be lost; and
WHEREAS, the D. A. GARRETT COMPANY has proposed an
acceptable mitigation on approximately 20 acres of the site
adjacent to the City airport; and
WHEREAS, the City would prefer on off-site location for
the mitigation to avoid creating a potential safety problem
for flight ad ground movements of nearby aircraft;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:

donation of approximately 20 acres of land and a permanent
