AN ORDINANCE OF THE CITY OF AUBLrRN, WASHINGTON, PROVIDING FOR
THE REZONING OF PROPERTY LOCATED AT THE NORTHEAST CORNER OF
~A" STREET SW AND 1ST STREET SW, WITHIN THE CITY OF AUBURN,
WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM
C-3 (HEAVY COMMERCIAL) TO C-2 (CENTRAL BUSINESS DISTRICT).
WHEREAS,
the Council of the City of Auburn, Washington,
ADAMS, requesting the rezoning of the real
hereinafter described in Section 2 of the Ordinance;
Application No. REZ0004-96 has been submitted to

WHEREAS, said request above referred to, was referred to
the Hearing Examiner for study and public hearing thereon; and
WHEREAS, the Hearing Examiner, based upon staff review,
held a public hearing to consider said petition in the Council
Chambers of the Auburn City Hall, on October 22, 1996, at the
conclusion of which the Hearing Examiner recommended the
approval of the rezoning of said property; and
WHEREAS, the City Council, on November 1, 1996,
considered said request and affirmed the Hearing Examiner's
recommendation for rezone based upon the following Findings of
Fact and Conclusions, to-wit:

FINDINGS OF FACT

The applicant, Marshall D. Adams, applies for a rezone.
The applicant is requesting a rezone from C-3, Heavy
Commercial, to C-2, Central Business District.
The subject property is located at the northeast corner
of A Street SW and 1st Street SW. Currently, the
property is vacant. It consists of two separate platted
lots each 7,200 square feet in area.
The property is designated as downtown in the City's
Comprehensive Plan. The purpose of the C-2 zoning is to
implement the downtown zoning designation.
Surrounding zoning and land uses in the vicinity include
C-2, parking/retail to the north; C-3, automotive, to the
south; C-3, parking, to the east; and C-3, automotive, to
the west. Properties in all directions from the subject
site are designated for downtown uses in the
Comprehensive Plan.
The proposed rezone is to accommodate the construction of
a new restaurant and bakery. While the restaurant and
bakery are allowed in the existing C-3 zone, the
applicant prefers to construct a project with C-2
development standards. The primary difference between
the zones' development standards are the difference in
building setback. The City recently amended the C-2 zone
to require pedestrian amenities in lieu of traditional
setbacks.
The applicant is proposing to reconfigure the public
parking lot to the east to make it function better with
the parking to be provided for the restaurant. While the
revised parking layout is desirable, it is not
necessarily required for the restaurant to proceed.

The staff report, with its recommendation of approval,
and the case file and environmental file, are
incorporated herein by reference and made a part of the
record.

CONCLUSIONS OF LAW
The rezone is consistent with the Comprehensive Plan map
designation, zoning, and existing uses in the area.
A project designed with the pedestrian amenities of the
C-2 zone is more compatible with other uses on Main
Street. It would implement the downtown designation of
the Comprehensive Plan.
For each of the above referenced reasons, the
recommendation of the Hearing Examiner to the Auburn City
Council on this rezone from C-3 (Heavy Commercial) to C-2
(Central Business District) is approved and affirmed.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, DO ORDAIN AS FOLLOWS:
