3 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, RELATING TO PLANNING; ADOPTING COMPREHENSIVE PLAN

TEXT AMENDMENTS PURSUANT TO THE PROVISIONS OF R.C.W. CHAPTERS
5 36.70A AND 35A.63 OF THE LAWS OF THE STATE OF WASHINGTON;
DESIGNATING THESE AMENDMENTS AS GUIDELINES FOR EXERCISING THE
6 CITY'S AUTHORITY UNDER THE WASHINGTON STATE ENVIRONMENTAL
POLICY ACT (SEPA); DIRECTING THAT THIS ORDINANCE AND
7
COMPREHENSIVE PLAN AMENDMENTS IT ADOPTS AND APPROVES BE FILED
8 WITH THE AUBURN CITY CLERK AND BE AVAILABLE FOR PUBLIC
INSPECTION.

WHEREAS, the City of Auburn on August 18, 1986 adopted a
]0
]1 Comprehensive Plan by Resolution No. 1703 which includes Map
12 establishing the location of the Comprehensive Plan Land Use
Designations throughout the City; and
14
WHEREAS, the City of Auburn on April 17, 1995 adopted
]5
Comprehensive Plan Amendments by Resolution No. 2635 to comply
16
]7 with the Washington State Growth Management Act; and
18 WHEREAS, the City of Auburn on September 5, 1995
]9
reaffirmed that action by Ordinance No. 4788; and
20
WHEREAS, Draft Comprehensive Plan text amendments were

22 prepared by the Planning Department as proposed revisions to
23 the City~of Auburn Comprehensive Plan; and

WHEREAS, the Comprehensive Plan text amendments were
2
transmitted to the Auburn City Planning Commission in October,
1996; and
4
5 WHEREAS, the environmental impacts of the Draft
6 Comprehensive Plan text amendments were considered in
7
accordance with procedures of the State Environmental Policy
8
Act; and
9
10 WHEREAS, after proper notice published in the City's
]1 official newspaper at least ten (10) days prior to the date of
12 hearing, the Auburn Planning Commission on November 5, 1996,
conducted a public hearing on the proposed amendments; and
14
WHEREAS, at the hearing, the Auburn City Planning
15
]6 Commission heard public testimony and took evidence and
17 exhibits into consideration of said proposed amendments; and
18 WHEREAS, thereafter the Auburn City Planning Commission
19
recommended approval of the Draft Comprehensive Plan text
20
amendments and transmitted a copy of its recommendation to the
21
22 Auburn City Council through the Mayor, who acknowledged
23 receipt thereof and directed the Clerk to certify thereon the
24 date of receipt; and

WHEREAS, the Planning and Community Development Committee
2
of the Auburn City Council reviewed the Planning Commission's
recommendations and recommended approval to the Auburn City
4
5 Council; and
6 WHEREAS, within sixty (60) days from the receipt of the

Auburn City Planning Commission recommendati6n for the
8
proposed amendments the Auburn City Council, at a public
9
10 meeting, held after proper notice published in the City's
]1 official newspaper at least ten (10) days prior to the date of
]2 hearing on December 2, 1996, considered the proposed
amendments as recommended by the Auburn City Planning
]4
Commission and the Planning and Community Development
15
Committee; and
17 WHEREAS, on December 16, 1996, the Auburn City Council
18 further considered and voted on the proposed amendments.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN,

WASHINGTON, DO ORDAIN AS FOLLOWS:

Section 1. The Planning and Community Development
2
Committee's Recommended Amendments are herewith adopted and
3
4 approved and it is herewith directed that they be filed along
5 with this Ordinance with the Auburn City Clerk and be
6 available for public inspection.

Section 2. The Comprehensive Plan text amendments modify
8
the Comprehensive Plan adopted on August 18, 1986 by
9
Resolution 1703.

11 Section 3. The Comprehensive Plan and amendments is
12 herewith designated as a basis for the exercise of substantive
13
authority under the Washington State Environmental Policy Act
14
by the City's responsible environmental official in accordance
15
16 with R.C.W. 43.21C.060.
17 Section 4. If any section, subsection, sentence, clause,
18 phrase or portion of this Ordinance or any of the
19
Comprehensive Plan amendments adopted herein, is for any
20
reason held invalid or unconstitutional by any Court of
21
22 competent jurisdiction, such portion shall be deemed a
23

separate, distinct and independent provision, and such holding

shall not affect the validity of the remaining portions
thereof.

5 Section 5. The Mayor is hereby authorized to implement
6 such administrative procedures as may be necessary to carry
7
out the directions of this legislation 'to include
8
incorporating into one document the adopted Comprehensive Plan
9
text amendments, attached hereto as Exhibit "A" and preparing

1] and publishing the amended Comprehensive Plan.
12 Sect.ion 6. This Ordinance shall take effect and be in
force five days from and after its passage, approval, and
]4
publication as provided by law.

Drive In Titcaters: This Special Planning Area is located east of Auburn Way North just south of
2771h. The existing drive in theater is an appropriate use for this site. However, if the o~vners
extended to serve Lea Hill this arc-a would bc appropriate as a commercial sitc due to its access to
two major regional m-terials. However, if the bridge is not extended, commercial designation
would not be appropriate east of Auburn Way. A more appropriate use would be multiple family.

Service Area:
The City will provide water services to all residents of the City. In addition, the City will provide
water service to those located outside the city limits, but within the city water service
although service may be conditioned upon an agreement that development will be in compliance
with city Devclopment-st,andards. Thi~--eonelit-io~ing-of-ses4ce ensures that the wat-er--syst-em~oes
not require significant upgradc upon annexation, and that development is consistent ,Mth the City
Comprehensive Plan. New customers within the city's Potential Annexation Area are asked to
sign an Annexation Agreement before a Water Availability Certificate is issued.
