HomeMy WebLinkAbout4964 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ORDINANCE NO. 4 9 6 { AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, APPROVING AN APPROPRIATION OF GRANT FUNDS IN THE AMOUNT OF FOUR THOUSAND SIX HUNDRED TEN AND 00/100 DOLLARS, ($4,610.00) , AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CONTRACT WITH THE SOUTH KING COUNTY COMMUNITY NETWORK FOR THE "PEERS EDUCATING PEERS" PROGRAM WITHIN THE CITY OF AUBURN. W~EREAS, must adopt and approve pursuant to Chapter 35A.33 the Auburn City Council of the all appropriations RCW; and City of Auburn by Ordinance NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: ~ Pursuant to Chapter 35A.33 RCW the City hereby approves the expenditure and appropriation of a total amount of FOUR THOUSAND SIX HUNDRED TEN and 00/100 DOLLARS ($4,610.00), which constitutes a grant pursuant to the Contract between the City of Auburn and the South King County Community Network. ~ The Mayor and City Clerk of the City of Auburn are hereby authorized to execute a contract with the South King County Community Network to accept said grant Ordinance NO. 4964 April 10, 1997 Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 which will provide the "Peers contract is is grant funding to the City of Auburn for Educating Peers" program. Reynolds, City Attorney Published: Ordinance No. 4964 April 10, 1997 Page 3 South King County Community Network Contract for Services--1997 Mini Grants The parties ("Parties") to this Agreement are the South King County Community Network ("Network") and City of Auburn ("Service Provider"). The Network and Service Provider agrees to the following terms and conditions: 1. Services. The Service Provider shall provide those services described in its mini grant proposal and any conditions or revisions approved by the Network attached to this Agreement. No changes may be made to the content of the proposal after this contract is signed by the Network unless the Network agrees to each change in writing. 2. Term. The term of this Agreement shall begin March 14, 1997 and end June 15, 1997, subject to the conditions stated in this Agreement. This Agreement may be terminated or suspended immediately by the Network through written notice to the Service Provider. 3. Compensation. The Network agrees to pay the Service Provider an amount not to exceed the sum of $4,610 to reimburse the actual expenses of the Service Provider according to the terms of the budget form attached to this Agreement. Progress reports and receipts must be submitted to the Network in order for the Service Provider to receive payment. 4. Indemnification. The Service Provider agrees to indemnify and hold harmless the Network, its Board members, staff, and the State of Washington from any and all claims, demands, losses, actions, and liabilities (including costs and attorney fees) to or by any and all persons or entities, including without limitation their respective agents, licensees, or representatives, arising from, resulting from, or connected with this Agreement to the extent caused by the negligent acts, errors, or omissions of the Service Provider, its partners, shareholders, agents, employees, or by the Service Provider's breach of this Agreement. The provisions of this section shall survive the suspension, expiration, or termination of this Agreement. 5. Non-Discrimination. (Network Activities) No person shall on the grounds of race; religion; color; national origin; gender; disabled veteran or veteran of the Vietnam era status; marital status; age; sexual orientation; the presence of physical, mental, or sensory handicaps; or any other protected status (under local, state, or federal law) be excluded from participation in, be denied benefits of, or otherwise be subjected to discrimination under any activities of the Network. (General Non-Discrimination) In all of the Service Provider's services, programs, activities, or hiring and employment there shall be no discrimination by the Service Provider or the Service Provider's employees, agents, subcontractors, or representatives on the basis of gender, veteran's status, age (except minimum age and retirement provisions established by law), race, color, creed, national origin, marital status, or the presence of any disability, including sensory, mental, or physical handicaps, unless based on a bona fide occupational qualification relating to hiring and employment. Page I of 2 Exhibit "A" Ordinance No. 4964 6. Independent Contractor/Assignment. The Service Provider is an independent contractor and not the agent or employee of the Network. 7. Records. The Service Provider agrees to provide a complete accounting for expenditures of all funds within thirty (30) days of the project's completion or June 15, 1997, whichever occurs first. Receipts and documentation of expenses shall be submitted for all expenditures. 8. Performance and Evaluation. The Service Provider agrees to conduct an outcome-based evaluation of the project acceptable to the Network. The evaluation method will be submitted to the Network by April 18, 1997, or the beginning of service, whichever is later, and attached to this contract as an addendum after approval by the Network. A final report will be submitted to the Network within thirty (30) days of the project's completion. The Service Provider agrees to accept a site visit and/or program audit by staffand/or Board members of the Network when requested to do so. 9. Community Notification.
